A Comprehensive Approach To Law School Access Admissions, Jeffrey Minneti Jan 2018

A Comprehensive Approach To Law School Access Admissions, Jeffrey Minneti

Faculty Articles

This article provides a theoretical framework fo building an effective law school access admission program and it gives that framework flesh, color, and voice through a description of the access admission program at Seattle University School of Law. The framework describes the neurobiology of learning, links that neurobiology to the self-regulated learning cycle, summarizes the learning challenges that students from underrepresented populations frequently face and provides strategies law school faculty and administers can implement to address those challenges. The article then demonstrates how the framework operates in a law school setting through a description of the Academic Resource Center's work …

The 'Blurred Lines' Of Marvin Gaye's 'Here, My Dear': Music As A Tortious Act, Divorce Narrative And First Amendment Totem, Bryan Adamson Jan 2018

The 'Blurred Lines' Of Marvin Gaye's 'Here, My Dear': Music As A Tortious Act, Divorce Narrative And First Amendment Totem, Bryan Adamson

Faculty Articles

"In 1977, singer Marvin Gaye did an audacious thing: Anna Gordy-Gaye was divorcing him, and asking for $1 million dollars. Despite having a wildly successful career up to that point, Marvin was near financial ruin. His attorney, Curtis Shaw, hit upon an idea: Motown, Marvin’s record label, had given him $305,000 as an advance for his upcoming-but-undeveloped album. Marvin would give Anna the $305,000, and pledge the first $295,000 of the royalties yielded from that recording. Instead of $1 million, Anna agreed to the $600,000, as did Motown’s CEO Berry Gordy, Anna’s brother. The judge wrote up an Order to …

#Sowhitemale - Federal Civil Rulemaking, Brooke D. Coleman

Faculty Articles

116 out of 136. That is the number of white men who have served on the 82-year old committee responsible for creating and maintaining the Federal Rules of Civil Procedure. The tiny number of non-white, non-male committee members is disproportionate even in the context of the white-male-dominated legal profession. Were the rules simply a technical set of instructions made by a neutral set of experts, perhaps these numbers might not be as disturbing. But that is not the case. The Civil Rules embody normative judgments about the values that have primacy in our civil justice system, and the rulemakers—while expert—are …

Market Power And American Express, John B. Kirkwood Jan 2018

Market Power And American Express, John B. Kirkwood

Faculty Articles

The Second Circuit ruled that American Express did not have market power because it operated in a two-sided market and any leverage it exercised over merchants derived from its successful competition for cardholders. As a result, the relevant market had to include both sides of a credit card transaction, the company’s market share was modest, and it could not exploit both merchants and cardholders. In Market Power and Antitrust Enforcement (forthcoming in B.U. L. REV.), I propose a new approach that infers market power from the likely effects of the challenged conduct. This approach shows that American Express clearly exercised …

Micro-Housing: Seattle’S Contradictory Approach To Affordable, Sustainable Housing, Nick Quijas Jan 2018

Micro-Housing: Seattle’S Contradictory Approach To Affordable, Sustainable Housing, Nick Quijas

Seattle Journal of Environmental Law

Seattle, along with many other cities, is facing a housing crisis the likes of which it hasn't seen in at least half a century. A lack of affordable housing is exacerbating a homelessness crisis, and is arguably contributing to sprawl. In the face of all of this, Seattle has allowed one of the densest housing options to become economically unfeasible to build at an affordable rate.

Addressing The Prior Appropriation Doctrine In The Shadow Of Climate Change And The Paris Climate Agreement, Kait Schilling Jan 2018

Addressing The Prior Appropriation Doctrine In The Shadow Of Climate Change And The Paris Climate Agreement, Kait Schilling

Seattle Journal of Environmental Law

Climate change is the new lens through which the world needs to view water. Such a viewpoint is prudent, as the western United States is in a state of water scarcity that requires a reevaluation of how fresh water resources are being used. Western states have entrenched themselves in a system of prior appropriation that ensures senior water users retain priority over, and protection from the impacts of, new water users. Unfortunately, allocating new water rights under prior appropriation has become difficult as streams are increasingly fully appropriated with no new water rights allocations available. Climate change is exacerbating this …

Freshwater Reservoirs: Global Warming’S Best Kept Secret, Beau Baily Jan 2018

Freshwater Reservoirs: Global Warming’S Best Kept Secret, Beau Baily

Seattle Journal of Environmental Law

Fresh water reservoir construction involves the decomposition of plants that were previously able to absorb greenhouse gas and prevent its release into the atmosphere. With these plants no longer able to absorb greenhouse gas, it is released into the atmosphere, making freshwater reservoirs a source of global warming. Due to an increasing demand for clean energy, countries are planning and constructing dams at unprecedented rates. With dams come reservoirs. While hydroelectric energy is clean energy, the methods used to harness that clean energy create environmental problems that contribute to global warming. Ironically, this hydroelectric boom could do more harm than …

The Controversy Over Permit-Exempt Wells In Washington, Jean O. Melious Jan 2018

The Controversy Over Permit-Exempt Wells In Washington, Jean O. Melious

Seattle Journal of Environmental Law

In a groundbreaking 2016 decision commonly referred to as the Hirst decision, the Washington State Supreme Court recognized the interrelationship between land use and water use. The Court held that the state’s Growth Management Act required local governments to protect water resources through measures ensuring that new development would not deprive senior water users of their water rights. The decision focused on development relying on permit-exempt wells. Permit-exempt wells reflect a pioneer mentality that encourages dispersed development by allowing rural property owners and developers to appropriate water without obtaining a permit. Permit-exempt wells are subject to the state law of …

The Holy Trinity: Religion, Identity, And International Law In Egypt, Henry Owen Stonnington Jan 2018

The Holy Trinity: Religion, Identity, And International Law In Egypt, Henry Owen Stonnington

Honors Theses

This thesis investigates the contradiction between Egypt's international legal obligations to protect religious freedom and its state practice. Chapter 1 gives a brief history of the relationship between religious freedom and state authority in the Roman, Islamic, and Holy Roman Empires and the early formations of international legal protections of freedom of religion in the wake of the Thirty Years War and then WWI centuries later. Chapter 2 looks at the formation and content of the current international standards of religious freedom, focusing on the 1948 Universal Declaration of Human Rights (UDHR) and the1966 International Covenant on Civil and Political …

Keeping Gideon's Promise: An Evaluation Of Indigent Defense In The State Of Mississippi, Andie Beth Netherland

Honors Theses

The United States Constitution awards its citizens rights that many other countries do not. One such right is the Sixth Amendment right to a fair trial along with the assistance of counsel. Since the Supreme Court decision Gideon v. Wainwright, the responsibility of providing effective counsel has been pushed on each state. States throughout the nation have fragmented systems of indigent defense that fail to meet their responsibility, and thus many citizens have been denied their Sixth Amendment rights. For many decades, this denial of a constitutional right has been a topic of discussion. Some states have taken steps to …

Child Sexploitation: A Study Of Machismo And The Commercial Sexual Exploitation Of Children In Latin America, Courtney M. Cone Jan 2018

Child Sexploitation: A Study Of Machismo And The Commercial Sexual Exploitation Of Children In Latin America, Courtney M. Cone

Honors Theses

This thesis attempts to explore how the inextricable relationship between machismo and poverty connects to the commercial sexual exploitation of children in Latin America through predatory behaviors in order to provide insight to anti-trafficking campaigns. The overt Latin American culture of machismo contributes to the discrimination of women and children, enhancing their inherent dependency on men for economic survival. The inevitable pattern of dependency on patriarchal figures out of vulnerability to societal constructions is evident in economic, political and social structures. The pervasiveness of dependency is seen through patterns of violence against women, patterns of child abuse, and patterns of …

What Is Sexual Orientation?, Mary Ziegler Jan 2018

What Is Sexual Orientation?, Mary Ziegler

Kentucky Law Journal

At a time when the Supreme Court seems closer than ever before to treating sexual orientation as a suspect classification, consideration of the legal definition of sexual orientation is both timely and important. The Court’s 2015 decision in Obergefell recognizes two guideposts for defining sexual orientation: its immutability and normalcy. While other scholars offer rich and nuanced accounts of the fight for gay, lesbian, transgender, and bisexual rights, they do not fully analyze the history of sexual orientation as a legal category. This Article closes that gap, illuminating the hidden costs of the definition of sexual orientation that Obergefell endorses. …
