The Canon Wars, Anita S. Krishnakumar, Victoria F. Nourse
The Canon Wars, Anita S. Krishnakumar, Victoria F. Nourse
Faculty Publications
Canons are taking their turn down the academic runway in ways that no one would have foretold just a decade ago. Affection for canons of construction has taken center stage in recent Supreme Court cases and in constitutional theory. Harvard Dean John Manning and originalists Will Baude and Stephen Sachs have all suggested that principles of “ordinary interpretation” including canons should inform constitutional interpretation. Given this newfound enthusiasm for canons, and their convergence in both constitutional and statutory law, it is not surprising that we now have two competing book-length treatments of the canons—one by Justice Scalia and Bryan Garner, …

Digital investment advice, or robo-advice, is a growing trend in the financial services industry. It is expected that by 2022, robo-advisers will manage over $4 trillion in assets. Robo-advice covers a wide range of services, however all involve advice derived from algorithms. This article will discuss what robo-advice is as well as how it is regulated by the SEC and FINRA.
Brand Renegades Redux, Jeremy N. Sheff
Brand Renegades Redux, Jeremy N. Sheff
Faculty Publications
In "Brand Renegades," 1 NYU J. Intell. Prop. & Ent. L. 128 (2011), I identified a new frontier in trademark enforcement: consumers who use branded products out of affiliation with some aspects of the image cultivated by the brand owner, but whose conspicuous consumption of the brand generates social meanings that are inconsistent with that image. As far-right political movements have built momentum in the consumer economies of the West, this type of "brand renegade" consumption has taken a much darker turn. Over the past two years, neo-Nazis and white supremacists have conspicuously adopted well-known brands in their bids to …
... Because "Yes" Actually Means "No": A Personalized Prescriptive To Reactualize Informed Consent In Dispute Resolution, Elayne E. Greenberg
... Because "Yes" Actually Means "No": A Personalized Prescriptive To Reactualize Informed Consent In Dispute Resolution, Elayne E. Greenberg
Faculty Publications
This paper proposes a radical departure from the status quo approach to securing a client’s informed consent about settlement options and refocuses informed consent practice back to what informed consent is about, the client. As it exists today, the status quo approach to securing a client’s informed consent about whether or not to use an alternative dispute resolution procedure to resolve the client’s case is inadequate. It thwarts a client’s right to exercise party self- determination and stymies a client’s ability to make informed justice choices. Lawyers, courts, ADR providers and neutrals routinely provide litigants with generic information about the …
The Search For Third Options In A Two-Bathroom Society, Sharon R. Cruz
The Search For Third Options In A Two-Bathroom Society, Sharon R. Cruz
Student Articles & Notes
This Note presents a narrative on and the history of transgender bathroom rights in this country, beginning with the reasoning for a two-bathroom society and the development of “bathroom laws”. The development of the two-bathroom society is intertwined with and rooted in beliefs that have remained prevalent since the Victorian Era, ideas about core differences between men and women, and how best to protect the virtues of women. In order to weave this narrative, this Note focuses particularly on current cases that are making their way through our Courts: the stories of Gavin Grimm and Coy Mathis, whose battles are …

Resolving Self-Driving Car Patent Conflicts: Arbitration In Waymo V. Uber And Future Autonomous Vehicle Patent Disputes, Ilya Gorelik
Resolving Self-Driving Car Patent Conflicts: Arbitration In Waymo V. Uber And Future Autonomous Vehicle Patent Disputes, Ilya Gorelik
Cardozo Journal of Conflict Resolution
Waymo and Uber should have entered into a mutually agreed upon arbitration agreement to resolve their patent claims, and future conflicting self-driving car developers should consider doing the same. Uber was already willing to enter arbitration, and while Waymo resisted being forced into arbitration in the past, it would have the opportunity to influence the terms of the arrangement. Arbitration would benefit both Waymo and future patent holders, as well as Uber and future parties accused of patent infringement, as it would provide a cheaper alternative to litigating those claims while also keeping the procedure more confidential, providing Waymo a …
Is Disgorgement A Penalty In The Antitrust-Enforcement Realm?: Exploring Mediation As The Ftc's Response To Kokesh In The Context Of Reverse Payment Settlements, Jennifer Kim
Cardozo Journal of Conflict Resolution
This Note seeks to answer the following question: How can the FTC respond to the potential influence of Kokesh by utilizing mediation to settle with and recover monetary relief from brand drug companies? Part II of this Note discusses the FTC's role in competition cases historically, as well as the Commission's proactive pursuit of monetary remedies, primarily disgorgement relief. It also provides a general overview of the Hatch-Waxman Act and its influence on the rise of patent infringement litigation, which, in effect, resulted in the rise of "pay-for-delay" settlements between brand and generic drug companies. Part III dissects the Supreme …

Utilizing Adr As A Vehicle For Effective Communication And Success Of Payment In Urgent Care, Stephanie R. Goldberg
Cardozo Journal of Conflict Resolution
Section II of this Note provides background on urgent care and ADR. Section III will elaborate on current payment procedures and explain some of the pitfalls that create a need for a supplementary payment solution. Section IV lays out a four-step plan incorporating a logical progression of ADR techniques that would enable quality of care and ease and success of financial arrangements, and vastly improved patient-provider relations. The feasibility of this plan will be demonstrated through application of its steps to hypothetical examples, representative of various realistic patient experiences, in Section V. This plan is intended to aid the millions …

Utilizing Adr Between Automakers, The European Union, And The United Kingdom To Avoid Automobile Tariff Increases Arising From Brexit, Nicholas Gliagias
Cardozo Journal of Conflict Resolution
In order to ensure that there are new and stable trade agreements to replace the previous trade agreements, mediation strategies between automakers, the European Union, and the UK should be explored so that new tariffs on cars do not negatively and drastically change the UK's economic landscape after Britain exits from the European Union. In Part II, this Note discusses the pre-Brexit and current tariff situation in the UK as a member of the European Union, explains what mediation is, the methods of mediation, the history of mediation, and the benefits of using mediation. Part III discusses the implications of …
Proposing A Federal Post-Natural Disaster Mediation Program, Michelle Shaykevich
Proposing A Federal Post-Natural Disaster Mediation Program, Michelle Shaykevich
Cardozo Journal of Conflict Resolution
Section II explores the history of state and federal natural disaster mediation programs. Currently, there are three primary disaster mediation processes used by states. First, and most common, are ad-hoc programs. These programs are developed after a natural disaster has occured. Second is a program utilized exclusively by North Carolina, whereby an institutional organization maintains a "state of readiness" in the event of a declared disaster. The third type is a mediation program that is run by the state but specifically excludes the mediation of flood insurance claims. Regarding federal post-natural disaster mediation programs, Section II discusses current legislative and …
Access To Justice: Accelerating The Abandonment Of Fgm/C, Gretchen Kail
Access To Justice: Accelerating The Abandonment Of Fgm/C, Gretchen Kail
Cardozo Journal of Conflict Resolution
This Note discusses the role comprehensive legislation traditionally plays through a top-down approach and proposes the use of bottom-up approaches to better leverage national laws and new legal norms to support collective societal action. The discussion views legislation and FGM/C through a social norm lens: "a comprehensive, multi-sectorial, culturally sensitive approach that incorporates a social perspective to impact collective change."
Section II of this Note defines FGMIC as a health issue, a human rights violation, and a social norm. Section III discusses relevant international and regional human rights frameworks; state obligations; divergent views on the effects and usefulness of national …

The Devil's Advocate Also Wears Prada: The Impracticality Of Adr In Counterfeiting Disputes And The Prospect Of Arbitration, Anan Kahari
Cardozo Journal of Conflict Resolution
The purpose of this Note is to posit that arbitration, tailored for counterfeiting disputes, could potentially serve as a reliable method for fashion companies to combat counterfeiting. Part II discusses the background of IP rights and the relationship between counterfeiting and fashion. Part III highlights the traditional advantages of ADR and how some of those advantages may become disadvantages when applied to counterfeiting disputes. Lastly, Part IV argues that arbitration can be designed to be applicable to counterfeiting disputes described in this Note.

In Defense Of Penalizing (But Not Punishing) Civil Disobedience, David Lefkowitz
In Defense Of Penalizing (But Not Punishing) Civil Disobedience, David Lefkowitz
Philosophy Faculty Publications
While many contemporary political philosophers agree that citizens of a legitimate state enjoy a moral right to civil disobedience, they differ over both the grounds of that right and its content. This essay defends the view that the moral right to civil disobedience derives from (or is a facet of) a general right to political participation, and the characterization of that right as precluding the state from punishing, but not from penalizing, those who exercise it. The argument proceeds by way of rebuttals to criticisms of both claims recently advanced by Kimberley Brownlee. While in some cases those criticisms fail …
Gender Equality Menace Under Liberia Domestic Relations Law, Yah-Yeplah Dolo-Barbu
Gender Equality Menace Under Liberia Domestic Relations Law, Yah-Yeplah Dolo-Barbu
Maurer Theses and Dissertations
Like most Africa countries, Liberia has a dual legal system, that is, the customary and statutory. Cultural and traditional practices influence some of the laws. Laws in both legal systems discriminate against women in overt ways, especially laws that deal with the private sphere, such as marriage, divorce, custody, domestic violence, property, legitimacy, and inheritance. This dissertation seeks to identify inequality in the Liberian Domestic Relation laws that arise from facially discriminatory laws, facially neutral laws and omissions in the law. It also posits that the court’s role in interpreting these issues has been inadequate, and the legislature is reluctant …
Stakeholder Dialogues And Virtual Reality For The German Energiewende, Arne Spieker
Stakeholder Dialogues And Virtual Reality For The German Energiewende, Arne Spieker
Journal of Dispute Resolution
The German energy system is in a complete overhaul. In the future energy will mainly derive from renewable sources. While in general this is largely socially accepted, new long-range power-lines, needed to distribute that energy, disquiet local communities and lead to political friction. Using stakeholder dialogues, responsible authorities and transmission operators try to direct escalating debates back onto a constructive track. This Article describes the inclusion of public participation in the recently adopted grid expansion acceleration act (NABEG) and a best practice stakeholder dialogue for a high voltage d.c. link. It contextualizes those efforts into the broader debate over citizen …
Fair Use & Fair Play: Olympic Marketing In The Information Age, Alex Locke
Fair Use & Fair Play: Olympic Marketing In The Information Age, Alex Locke
Cardozo International & Comparative Law Review
The note critiques the overreach of intellectual property protections surrounding the Olympics, which have led to hyperlitigation, stifled public engagement, and disproportionately harmed smaller entities while benefiting large corporations. It proposes reforming the Ted Stevens Olympic and Amateur Sports Act by incorporating a fair use framework, modeled after the Copyright Royalty Board, to balance intellectual property enforcement with public participation and transparency. This approach aims to address the challenges posed by ambush marketing and sponsorship protection in the modern media landscape while ensuring equitable opportunities for all stakeholders.
Resolving The Circuit Split Over Consent Based Searches In Shared Living Spaces, Christopher Grimaldi
Resolving The Circuit Split Over Consent Based Searches In Shared Living Spaces, Christopher Grimaldi
Cardozo International & Comparative Law Review
The note argues that the police, not citizens, should bear the responsibility of resolving ambiguities in consent to search cases under the Fourth Amendment. It advocates for a solution that aligns with Supreme Court precedent, particularly Rodriguez and Salinas-Cano, to ensure constitutional protections while maintaining efficient law enforcement. The proposed approach emphasizes the importance of police inquiry to clarify authority over jointly used property, balancing individual privacy rights with practical law enforcement needs.
Not Forgetting Just Obscuring: American And European Attempts To Maintain Privacy In The Digital Age, John Corrado
Not Forgetting Just Obscuring: American And European Attempts To Maintain Privacy In The Digital Age, John Corrado
Cardozo International & Comparative Law Review
The note explores the concept of the right to obscurity as a subset of privacy rights, distinguishing it from the right to be forgotten. It examines how this right is addressed in E.U. and U.S. law, highlighting the E.U.'s robust framework under the GDPR and the more limited, sector-specific protections in the U.S. The analysis emphasizes the importance of balancing individual privacy rights with freedom of expression and the public interest, advocating for a proactive approach to data control rather than retroactive deletion.
The Unexpected Scope Of The Cfaa: And How Netflix Users Could Be Committing A Federal Crime, Michael Levy
The Unexpected Scope Of The Cfaa: And How Netflix Users Could Be Committing A Federal Crime, Michael Levy
Cardozo International & Comparative Law Review
The Ninth Circuit's broad interpretation of the Computer Fraud and Abuse Act (CFAA) in United States v. Nosal II criminalizes everyday activities like password sharing, undermining the Act's original purpose to prevent hacking. The court ruled that accessing a computer after authorization has been revoked constitutes a violation, even if the access is for innocuous purposes. This interpretation disproportionately benefits large service providers, allowing them to suppress legitimate user claims and exposing millions of Americans to potential prosecution for common online practices.

The Violence Against Women Act, Implicit Bias, And Judicial Training, Lorena Espino-Piepp
The Violence Against Women Act, Implicit Bias, And Judicial Training, Lorena Espino-Piepp
Cardozo Journal of Equal Rights & Social Justice
The note argues that the Violence Against Women Act (VAWA) must be amended to include implicit bias training for Family Court judges and staff to address the systemic barriers faced by undocumented Latina immigrant women in accessing justice. These women often face compounded discrimination based on race, ethnicity, and immigration status, which undermines their ability to obtain immigration relief through VAWA protections. The author contends that without such training, the judicial system perpetuates inequities, as judges and court personnel rely on stereotypes that disproportionately harm women of color.

Matal V. Tam-A Victory For The Slants, A Touchdown For The Redskins, But An Ambiguous Journey For The First Amendment And Trademark Law, Mark Conrad
Cardozo Arts & Entertainment Law Journal
Since 1946, Section 2(a) of the Lanham Act, the law governing trademarks, prohibited the registration of trademarks deemed "immoral, deceptive, or scandalous; " or those which may "disparage" individuals. This provision was the subject of a challenge by an Asian-American dance-rock band named "The Slants" after the trademark examiner refused to register the mark because it was deemed "disparaging" to Asians. Tam, a member of the group, challenged the decision, primarily on First Amendment grounds, and the Supreme Court, in several opinions which produced a unanimous result, concluded that the provision unconstitutionally barred the registration. What was a major victory …
