A Historical Reassessment Of Congress's "Power To Dispose Of" The Public Lands, Jeffrey M. Schmitt
A Historical Reassessment Of Congress's "Power To Dispose Of" The Public Lands, Jeffrey M. Schmitt
School of Law Faculty Publications
The Property Clause of the Constitution grants Congress the “Power to Dispose” of federal land. Congress uses this Clause to justify permanent federal land ownership of approximately one-third of the land within the United States. Legal scholars, however, are divided as to whether the original understanding of the Clause supports this practice. While many scholars argue that the text and intent of the framers show that Congress has the power to permanently own land within the states, others contend that these sources demonstrate that Congress has a duty to dispose of all federal land not held pursuant to another enumerated …

Fashioning Worker Protections To Combat The Thin Ideal's Cost On Fashion Models And Public Health, Erin E. Meyers
Fashioning Worker Protections To Combat The Thin Ideal's Cost On Fashion Models And Public Health, Erin E. Meyers
Vanderbilt Journal of Entertainment & Technology Law
Studies linking thin-obsessed media consumption to poor health outcomes for women have permeated the medical literature for years. The pressures female fashion models face to sacrifice their health for their jobs are perhaps even more disturbing. These harrowing issues are symptoms of the "thin ideal," the social norm glorifying a female body type so thin it is unattainable for most women. Despite the clear harm imposed by the thin ideal, the United States has done little to combat its effect on the working conditions of fashion models and on public health more generally. This Note suggests that the US fashion …
Beyond Copyright: Applying A Radical Idea--Expression Dichotomy To The Ownership Of Fictional Characters, Tze Ping Lim
Beyond Copyright: Applying A Radical Idea--Expression Dichotomy To The Ownership Of Fictional Characters, Tze Ping Lim
Vanderbilt Journal of Entertainment & Technology Law
Copyright protection for fictional characters in the United States is expanding on an uncertain and incoherent basis. With the event of the case Towle v. DC Comics, courts have now applied three different tests to discern a character's copyrightability. Towle was a significant decision because it was the first time a US court had held that a car (the Batmobile) was a copyrightable character. Although courts have utilized the ideas-expression dichotomy to differentiate unprotectable character "ideas" from protectable character 'expressions', the dichotomy is unlikely to alleviate the law's uncertainty and incoherence. Both the US ideas-expression dichotomy and character copyrightability doctrines …

Bigger And Better Patent Examiner Statistics, Shine Tu
Bigger And Better Patent Examiner Statistics, Shine Tu
Faculty & Staff Scholarship
The American government charges the United States Patent and Trademark Office (USPTO) with reading and reviewing patent applications to determine what new or improved inventions, machines, and processes qualify for patent protection. Each application is reviewed by a specific patent examiner who theoretically applies the standards of patentability in an even, fair, unbiased and consistent manner. This task requires the examiner to not only be internally consistent with the applications she reviews but also consistent with the behavior of other examiners within the same technology center. I have conducted two studies based on data from hundreds of thousands of patents, …
A Tale Of Two Wives: 404(B) Evidence Simplified, Josiah Beamish
A Tale Of Two Wives: 404(B) Evidence Simplified, Josiah Beamish
University of Colorado Law Review
Federal Rule of Evidence 404(b) is a constant source of confusion, contempt, and convoluted reasoning. Rule 404(b) prohibits evidence of an individual's prior bad acts when used to prove conformity with a character trait. No Federal Rule of Evidence generates more appellate pages. This Comment argues that there are foundational issues with a rule that generates so much dispute. That proposition becomes even more evident through examination of the murder conviction of Harold Henthorn. The government's case against Mr. Henthorn relied heavily on the introduction of evidence surrounding his first wife's death. That evidence of prior uncharged conduct-404(b) evidence-became the …

Charitable Contributions In Lieu Of Salt Deductions, David Gamage
Charitable Contributions In Lieu Of Salt Deductions, David Gamage
Articles by Maurer Faculty
State governments are considering new charitable tax credits designed to circumvent the 2017 federal tax overhaul’s cap on state and local tax deductions. Will these plans work? This essay argues that the answer is: yes, but with some qualifications.
The Interpretation And Effect Of Permissive Forum Selection Clauses Under U.S. Law, Hannah L. Buxbaum
The Interpretation And Effect Of Permissive Forum Selection Clauses Under U.S. Law, Hannah L. Buxbaum
Articles by Maurer Faculty
A forum selection clause is a form of contractual waiver. By this device, a contract party waives its rights to raise jurisdictional or venue objections if a lawsuit is initiated against it in the chosen court. The use of such a clause in a particular case may therefore raise a set of questions under contract law. Is the waiver valid? Was it procured by fraud, duress, or other unconscionable means? What is its scope? And so on. Unlike most contractual waivers, though, a forum selection clause affects not only the private rights and obligations of the parties, but something of …
The Nfl Should Stop Trying To Weed Out Marijuana: Why Medical Marijuana Remedies The League’S Misuse Of Pain Killers, Stephanie Assi
The Nfl Should Stop Trying To Weed Out Marijuana: Why Medical Marijuana Remedies The League’S Misuse Of Pain Killers, Stephanie Assi
Texas A&M Law Review
Is the NFL’s drug-testing policy on medical marijuana out of date? In recent years, the United States has seen a rise in opioid addiction and opioid related deaths. The NFL is not immune from the opioid epidemic, as many current and retired players have addressed the troubled paradigm of needing relief from pain caused by years of playing in the NFL, but the increased risks of opioid use to treat said pain. This article addresses the current NFL policy regarding medical marijuana use and how changing this policy could ultimately benefit the health and safety of the NFL players.

Regulatory Carrots And Sticks In Climate Policy: Some Political Economic Observations, Jason S. Johnston
Regulatory Carrots And Sticks In Climate Policy: Some Political Economic Observations, Jason S. Johnston
Texas A&M Law Review
This Article sets out an informal political economic theory which explains the relative permanence of regulatory carrots—legislative subsidies and mandates for product use—versus the transience of regulatory sticks—traditional costly regulatory requirements. After setting out the elements of this theory, I illustrate it with the dramatic rise in the Obama Administration and abrupt cessation in the Trump Administration of attempts to use conventional U.S. environmental regulatory sticks to end the U.S. coal industry. The Article turns then to describe a concrete example of a regulatory carrot—the U.S. corn ethanol mandate—that has survived despite overwhelming evidence that its environmental benefits, if any, …

One Drunk Driver, Shame On You, Two Drunk Drivers, Shame On Who: Reconciling The Unlawful Acts Doctrine With Comparative Negligence, Alison K. Goodwin
New Mexico Law Review
Two people are drinking and driving. One runs a red light and injures the other. How should fault be apportioned? In 1950, the New Mexico Supreme Court adopted the unlawful acts doctrine – a doctrine that bars a plaintiff from recovering if the plaintiff was committing a “wrong” at the time of the injury. Later, New Mexico adopted comparative fault – a doctrine that apportions fault between defendant and plaintiff and assigns damages accordingly. Recently, the unlawful acts doctrine has seen a resurgence as a defense to tort claims in New Mexico. However, this Comment argues that by New Mexico’s …
You Be The Judge: The Wholesale Implementation Of Bail Schedules By The Judiciary As An Abdication Of Adjudicatory Responsibility Creating A Disparate Impact For African-Americans And Hispanics Accused Of A Criminal Offense, Taurus Myhand
Scholarly Works
The presumption of innocence is not well illustrated in the age-old and widespread use of monetary bail systems by most jurisdictions throughout the United States. In fact, whether a person is detained in jails prior to the final disposition of the case, is not likely to be dependent on the strength of the government’s case toward proving the accusee’s guilt. Rather, pre-trial detention is much more dependent on whether the accusee has the means to pay an amount of money determined by a court.
As the calls for bail reform resurges, many legal professionals are looking for alternatives to monetary …
