Extrajudicial Settlement Of Consumer Disputes In The Energy Field, Wojciech Modzelewski
Extrajudicial Settlement Of Consumer Disputes In The Energy Field, Wojciech Modzelewski
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
Polish regulations on consumer protection in the energy sector are still far behind other European countries where Alternative Dispute Resolution (ADR) is more popular. This article examines new regulations that aim to introduce ADR in the energy field. The Consumer ADR Act introduced into the polish legal system entity acting as a mediator in disputes between an energy company and consumers, in this area mediator replaced existing consumer court.
Transmission Corridors In The Legislation Of The United States Of America, Mateusz Sokół
Transmission Corridors In The Legislation Of The United States Of America, Mateusz Sokół
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
The present article chooses as its subject a somewhat unpopular, at least in Polish literature, matter of transmission corridors in the United States of America, as one of the elements that are to ensure widely understood energy security. A transmission corridor is a normatively isolated terrain of a special legal status (with its existence sometimes manifested in a factual way), where transmission infrastructure are, or will be located, which plays specific roles that define the very essence of the corridor. The author begins with the deliberation on the issue of the right of transmission entrepreneurs to use the land (covered …

Colby Magazine
Fetal Alcohol Spectrum Disorder is a preventable disorder that affects an estimated one in 20 children in the United States. It can be difficult to diagnose, and while widespread in the general population, is often only identified in in adopted children or those in the foster care system. Doug Waite '84 and Diane Smith Howard '86 are on the front lines of the battle against it.
Oliari And The European Court Of Human Rights: Where The Court Failed, Vito John Marzano
Oliari And The European Court Of Human Rights: Where The Court Failed, Vito John Marzano
Pace International Law Review
The European Court of Human Rights revisited the issue of legal recognition for same-sex partnerships on July 21, 2015 when it decided Oliari and Others v. Italy. This Note explores the implications of that decision and what it may mean for same-sex couples within Italy and throughout the Council of Europe. Through a careful analysis of the decision, this Note concludes that Oliari provides slight yet important movement on the issue of a Contracting State’s obligation to afford legal recognition for same-sex partnerships, but a practical implementation of the Court’s holding likely will yield little additional movement in more conservative …

Masterpiece Cakeshop, Ltd. V. Colorado Civil Rights Commission: Brief Of Amici Curiae Public Accommodation Law Scholars In Support Of Respondents, Samuel Bagenstos
Appellate Briefs
Amici are legal scholars with expertise in the historical and contemporary applications of the public accommodation laws. This brief argues that the First Amendment exemption Masterpiece claims would subvert the historic purpose of these laws: to promote equal dignity in the marketplace.
For more than half a century, state public accommodation laws across the country have protected against denials of dignity and equal treatment in the public marketplace. Throughout that period, this Court has consistently rejected arguments that businesses open to the general public have a constitutional right to provide less than the full and equal services required by such …
