A Study Of The Determinants Influencing The Legislative Success Of A Government-Proposed Bill In Korea, Byung Jun Ahn Jan 2017

A Study Of The Determinants Influencing The Legislative Success Of A Government-Proposed Bill In Korea, Byung Jun Ahn

MPA/MPP/MPFM Capstone Projects

As there is a widespread perception of legislative gridlock and subsequent failure in addressing national problems in Korea, this study examines what factors influence the legislative success and legislative time of a government-proposed bill in Korea. This study uses government-proposed bills from 1988 to 2016 to estimate the effect of explanatory variables such as divided government, the year of presidential term (one to five year), the presidential approval rate, the unemployment rate, filibusters, jurisdictional area of a bill, and the ratio of members’ bills to government-proposed bills.

The results of regression analyses show that there is no evidence divided government …

Consumer Response To Increases In The State Cigarette Tax, Patrick Nolan Jan 2017

Consumer Response To Increases In The State Cigarette Tax, Patrick Nolan

MPA/MPP/MPFM Capstone Projects

In this paper I look at consumer responsiveness to the cigarette tax. Cigarette taxes are motivated by wanting to raise money for the state and wanting to deter smoking in the state’s population. Obviously reducing smoking in the population would reduce the externalities caused by smoking. We know the health effects are completely detrimental to the consumer, and detrimental to those around them. In addition to this we know that tobacco is an addictive substance, meaning than is inherently extremely inelastic.

To find on how consumers respond to tax increases I conducted a difference in difference analysis of tax revenue …

Low Bono Legal Counsel: Closing The Access To Justice Gap By Providing The Middle Class With Affordable Attorneys., Steven A. Krieger Jan 2017

Low Bono Legal Counsel: Closing The Access To Justice Gap By Providing The Middle Class With Affordable Attorneys., Steven A. Krieger

The Scholar: St. Mary's Law Review on Race and Social Justice

The middle class is often underserved when it comes to retaining legal services. Individuals at or below poverty level qualify for pro bono services, and the wealthy have the resources to pay. Federal funding for free legal assistance is distributed by the Legal Services Corporation (LSC). Unfortunately for the middle class, funds are limited and are used primarily for pro bono services. Funding from Congress is unlikely to increase because the allocation of funds is dependent on the federal poverty guidelines. Relying on the federal guidelines is erroneous because the guidelines have not been updated since the 1960s, and therefore …

The Police-Community Partnership: Civilian Oversight As An Evaluation Tool For Community Policing., Nathan Witkin Jan 2017

The Police-Community Partnership: Civilian Oversight As An Evaluation Tool For Community Policing., Nathan Witkin

The Scholar: St. Mary's Law Review on Race and Social Justice

Citizen review boards (CRBs) tend to act as unofficial criminal courts for police misconduct. Without the binding, legal powers of the court, these civilian oversight bodies are often ineffective and draw resistance from law enforcement. “Community policing,” or community-oriented policing (COP) is a law enforcement strategy that emphasizes the use of problem-solving skills through community engagement and partnerships, but performance through arrests/citation statistics only. Without a process to evaluate public relations skills, the COP strategy encourages officers to reduce distance between them and the community while retaining a crime-fighting focus—a dynamic that increases tension and violence between police and crime-prone …

Education And Its Discontents: The Decriminalization Of Truancy And The School-To-Prison Pipeline In Texas., Steven E. Gilmore Jan 2017

Education And Its Discontents: The Decriminalization Of Truancy And The School-To-Prison Pipeline In Texas., Steven E. Gilmore

The Scholar: St. Mary's Law Review on Race and Social Justice

The Texas Legislature ended the longstanding criminalization of truancy violations in Texas schools. With the passage of House Bill (H.B.) 2398, the manner in which the courts, school districts, and the Texas Education Agency (TEA) are expected to handle truant students has been greatly altered. Nonetheless, it remains to be seen what material effect these new measures will have on Texas schools, students, and their families. In order to understand the extent to which the new laws and regulations may affect the lives of students and their parents, it is important to examine the material consequences of the school-to-prison pipeline …

No Un Jurado De Mis Pares: Juror Exclusion Of Limited English Proficient Speakers., Michael Mccann Jan 2017

No Un Jurado De Mis Pares: Juror Exclusion Of Limited English Proficient Speakers., Michael Mccann

The Scholar: St. Mary's Law Review on Race and Social Justice

In the context of fulfilling civic duties as a citizen, accessibility to language assistance programs ensures every individual, including those with limited English proficiency (LEP), is afforded the opportunity to exercise their fundamental rights. Preservation of the integrity of the justice system must be provided in a comprehensive manner, not merely in one part of the legal proceedings or isolated to one part of the courthouse. LEP citizens should be integrated in public society, not disqualified from it. Statutes that create overly burdensome language proficiency standards create problems with the jury selection process. These standards limit and often deny LEP …

The Texas Supreme Court Retreats From Protecting Texas Students, Albert Kauffman Jan 2017

The Texas Supreme Court Retreats From Protecting Texas Students, Albert Kauffman

The Scholar: St. Mary's Law Review on Race and Social Justice

This Article criticizes the 2016 Texas Supreme Court school finance decision, the latest of seven decisions starting in 1989, for its disregard of both the record in the case and the realities of the Texas Constitution and Texas politics. The Article also focuses on how standards for reviewing legislation have changed and the Texas Supreme Court's irrational and unfounded retreat to the "money doesn't make a difference" theory of school finance. Finally, the Article recommends a return to an objective, comprehensible, enforceable and constitutional system of review, and concludes with a prayer for holdings that recognize the inequities of the …

Protecting America's Elections From Foreign Tampering: Realizing The Benefits Of Classifying Election Infrastructure As Critical Infrastructure Under The United States Code, Allaire M. Monticollo

Law Student Publications

In just the past five years, the United States has suffered numerous hacks into important entities and institutions across the country by ill-intentioned actors. Private companies and government agencies alike have felt the negative impacts of security breaches by hackers infiltrating proprietary and protected systems. Even the United States political landscape has proven vulnerable to bad actors in the realm of cyber security. Furthermore, analysts have attributed some of the most recent highly publicized hacks to state-sponsored groups. As cyber security threats and opportunities for foreign hackers to infiltrate critical systems become more prevalent, it is natural to wonder where …

The Uncertain Status Of The Puerto Rico Ports Authority: Working Towards A Uniform Arm-Of-The-State Test, Jessica Landry Wildeus Jan 2017

The Uncertain Status Of The Puerto Rico Ports Authority: Working Towards A Uniform Arm-Of-The-State Test, Jessica Landry Wildeus

Law Student Publications

Many port authorities are allocated special status and therefore partake in the parent state’s Eleventh Amendment immunity as effective arms-of-the-state. This serves several important policy goals, yet the precedent surrounding the arm-of-the-state test is muddled. This results in different tests and standards, depending on the court hearing the case, leading to different results for different entities. The Port Authority of Puerto Rico (“PRPA”) is in an especially vulnerable situation, due to its dual function as a governmental and corporate entity. The unclear status of what role the function of an entity should play in determining its status under the Eleventh …

Responsible Resource Development And Prevention Of Sex Trafficking: Safeguarding Native Women And Children On The Fort Berthold Reservation, Kathleen Finn, Erica Gajda, Thomas Perin, Carla Fredericks Jan 2017

Responsible Resource Development And Prevention Of Sex Trafficking: Safeguarding Native Women And Children On The Fort Berthold Reservation, Kathleen Finn, Erica Gajda, Thomas Perin, Carla Fredericks

Publications

In 2010, large deposits of oil and natural gas were found in the Bakken shale formation, much of which is encompassed by the Fort Berthold Indian reservation, home to the Mandan, Hidatsa, and Arikara Nation (“MHA Nation” or “Three Affiliated Tribes” or “the Tribe”). However, rapid oil and gas development has brought an unprecedented rise of violent crime on and near the Fort Berthold reservation. Specifically, the influx of well-paid male oil and gas workers, living in temporary housing often referred to as “man camps,” has coincided with a disturbing increase in sex trafficking of Native women. The social risks …

Siri-Ously 2.0: What Artificial Intelligence Reveals About The First Amendment, Toni M. Massaro, Helen Norton, Margot E. Kaminski Jan 2017

Siri-Ously 2.0: What Artificial Intelligence Reveals About The First Amendment, Toni M. Massaro, Helen Norton, Margot E. Kaminski

Publications

The First Amendment may protect speech by strong Artificial Intelligence (AI). In this Article, we support this provocative claim by expanding on earlier work, addressing significant concerns and challenges, and suggesting potential paths forward.

This is not a claim about the state of technology. Whether strong AI — as-yet-hypothetical machines that can actually think — will ever come to exist remains far from clear. It is instead a claim that discussing AI speech sheds light on key features of prevailing First Amendment doctrine and theory, including the surprising lack of humanness at its core.

Courts and commentators wrestling with free …

The Algorithm As A Human Artifact: Implications For Legal [Re]Search, Susan Nevelow Mart

The results of using the search algorithms in Westlaw, Lexis Advance, Fastcase, Google Scholar, Ravel, and Casetext are compared. Six groups of humans created six different algorithms, and the results are a testament to the variability of human problem solving. That variability has implications both for researching and teaching research.

Administrative Dissents, Sharon B. Jacobs Jan 2017

Administrative Dissents, Sharon B. Jacobs

Publications

Commissioners, like judges, dissent. They do so at length, with vigor, and with persistence. Yet while separate judicial decisions are the subject of a rich literature, their administrative counterparts have long languished in obscurity. A closer look is warranted, however, because studying administrative dissent can enhance our understanding of internal agency operations as well as the relationships between agencies and other actors. This Article presents the results of an original review of separate statements at the Federal Energy Regulatory Commission and the Nuclear Regulatory Commission dating back four decades. It uses these findings to move beyond two common generalizations about …

Can Practicing Mindfulness Improve Lawyer Decision-Making, Ethics, And Leadership?, Peter H. Huang Jan 2017

Can Practicing Mindfulness Improve Lawyer Decision-Making, Ethics, And Leadership?, Peter H. Huang

Publications

Jon Kabat-Zinn, the founder of mindfulness-based stress reduction, defines mindfulness as paying attention in a curious, deliberate, kind, and non-judgmental way to life as it unfolds each moment. Psychologist Ellen Langer defines mindfulness as a flexible state of mind actively engaging in the present, noticing new things, and being sensitive to context. Langer differentiates mindfulness from mindlessness, which she defines as acting based upon past behavior instead of the present and being stuck in a fixed, solitary perspective, oblivious to alternative multiple viewpoints. Something called mindfulness is currently very fashionable and has been so for some time now in American …

Government Speech And The War On Terror, Helen Norton Jan 2017

Government Speech And The War On Terror, Helen Norton

Publications

The government is unique among speakers because of its coercive power, its substantial resources, its privileged access to national security and intelligence information, and its wide variety of expressive roles as commander-in-chief, policymaker, educator, employer, property owner, and more. Precisely because of this power, variety, and ubiquity, the government's speech can both provide great value and inflict great harm to the public. In wartime, more specifically, the government can affirmatively choose to use its voice to inform, inspire, heal, and unite -- or instead to deceive, divide, bully, and silence.

In this essay, I examine the U.S. government's role as …

Entrepreneurial Administration, Philip J. Weiser Jan 2017

Entrepreneurial Administration, Philip J. Weiser

Publications

A core failing of today’s administrative state and modern administrative law scholarship is the lack of imagination as to how agencies should operate. On the conventional telling, public agencies follow specific grants of regulatory authority, use the traditional tools of notice-and-comment rulemaking and adjudication, and are checked by judicial review. In reality, however, effective administration depends on entrepreneurial leadership that spearheads policy experimentation and trial-and-error problem-solving, including the development of regulatory programs that use non-traditional tools.

Entrepreneurial administration takes place both at public agencies and private entities, each of which can address regulatory challenges and earn regulatory authority as a …
