Crisp-Set Qualitative Comparative Analysis (Csqca) And Criminology, Belinda L. Parker Nov 2017

Crisp-Set Qualitative Comparative Analysis (Csqca) And Criminology, Belinda L. Parker

Qualitative Criminology (QC)

"This article presents Qualitative Comparative Analysis (QCA; Ragin, 1987, 2000) as a useful methodological approach for criminological research. The aim is to introduce QCA’s logic and assumptions and a step-by-step guide to its application of crisp-set QCA using an illustrative hypothetical example. While QCA is a relatively new method and not widely used within criminological research thus far, it offers a unique approach that is particularly well suited to the field. This article is intended to serve as an introduction to those researchers interested in QCA and to demonstrate how they may incorporate it into their research."

Employment Pathways: How Former Offenders Navigate To Employment, Breanne Pleggenkuhle, Alaina Bearsby Steele, Elle Gray Teshima Nov 2017

Employment Pathways: How Former Offenders Navigate To Employment, Breanne Pleggenkuhle, Alaina Bearsby Steele, Elle Gray Teshima

Qualitative Criminology (QC)

"Employment is one of the most critical dimensions of reintegration, and much research documents the barriers formerly incarcerated persons experience in seeking out steady work. However, most offenders are ultimately successful in obtaining some form of employment. Less research discusses how offenders manage these barriers or examines the practice by which offenders navigate employment pathways, and even less examines whether particular offense categories further challenge the process. The current research utilizes qualitative data to examine the methods by which ex-offenders seek out and obtain employment, with an emphasis on the function of self-motivating practices, access to services, and the utilization …

“Losing The Humanity Of The Street”: Retired Police Officer Narratives Of The Evolution Of Low-Level Enforcement In New York City, Megan Welsh Nov 2017

“Losing The Humanity Of The Street”: Retired Police Officer Narratives Of The Evolution Of Low-Level Enforcement In New York City, Megan Welsh

Qualitative Criminology (QC)

"Low-level enforcement activities such as pedestrian and traffic stops, the issuance of criminal court summonses (tickets or citations), and misdemeanor arrests comprise the vast majority of police-citizen encounters relative to the policing of more serious, felony-level offenses. The complexities of these activities – particularly from the perspectives of the police officers who carry them out – have received relatively little scholarly attention. In an effort to more fully understand the nuances of low-level enforcement, in particular how such activities have changed over time and how police officers have experienced such changes, in-depth interviews were conducted with a small sample of …

Forrest Stuart, Down, Out, And Under Arrest: Policing And Everyday Life In Skid Row, Jordan Denton Nov 2017

Forrest Stuart, Down, Out, And Under Arrest: Policing And Everyday Life In Skid Row, Jordan Denton

Qualitative Criminology (QC)

"Aggressive crime control strategies such as stop-and-frisk and poverty governance bring forth contentious debates on their impact. Proponents argue the policies are needed to combat crime, while opponents contend they are oppressive, harmful, and discriminatory. It is rare in these discussions that the perspectives of the control agents and the public impacted by the policies are simultaneously engaged. Forrest Stuart in his book Down, Out, and Under Arrest: Policing and Everyday Life in Skid Row fills this gap using ethnographic and historical data to depict how poverty governance impacts the everyday interactions of Skid Row residents, police, and community organizations. …

‘It Just Be Like That’:Young Men’S And Women’S Attributions Of Negative Sexual Behavior, Christopher W. Mullins, Daniel R. Kavish Nov 2017

‘It Just Be Like That’:Young Men’S And Women’S Attributions Of Negative Sexual Behavior, Christopher W. Mullins, Daniel R. Kavish

Qualitative Criminology (QC)

"This paper provides an examination of the role that male peer support plays in negative sexual attitudes and behaviors vis-àvis women. Drawing on semi-structured interview data collected from at risk high school students in an urban Midwestern town, we are able to qualitatively explore attitudes, behaviors, and experiences within this group of young men and women as they relate to negative sexual behaviors. We integrate routine activites theory with a male peer support theory of violence to to obtain a more holistic view of negative sexual behaviors. Male peer support models provide us with a theoretical explanation of the variation …

Dean's Desk: Past And Present, Women Play Key Roles At Iu Maurer, Austen L. Parrish

Austen Parrish (2014-2022)

Under first lady Laurie Burns McRobbie’s leadership, Indiana University founded Women’s Philanthropy as one way to celebrate alumnae leadership and to make the achievements of our most talented and trailblazing women graduates more visible. As the IU Maurer School of Law’s 175th year draws to a close, consistent with these larger University efforts, it’s an opportune time to celebrate some of the law school’s extraordinary women graduates. Their stories are powerful and inspiring, and I’m pleased to share just a few.

A Political Companion To James Baldwin, Susan J. Mcwilliams Nov 2017

A Political Companion To James Baldwin, Susan J. Mcwilliams

Civil Rights

In seminal works such as Go Tell It on the Mountain, Notes of a Native Son, and The Fire Next Time, acclaimed author and social critic James Baldwin (1924–1987) expresses his profound belief that writers have the power to transform society, to engage the public, and to inspire and channel conversation to achieve lasting change. While Baldwin is best known for his writings on racial consciousness and injustice, he is also one of the country's most eloquent theorists of democratic life and the national psyche. In A Political Companion to James Baldwin, a group of prominent scholars assess the prolific …

Background Note: Standard Essential Patents, Innovation And Competition: Challenges In India, Arpan Banerjee Nov 2017

Background Note: Standard Essential Patents, Innovation And Competition: Challenges In India, Arpan Banerjee

IP Theory

In September 2014, a few months after a landslide election victory, the Indian Prime Minister Narendra Modi announced the launch of “Make in India,” an ambitious program designed to turn India into a global manufacturing hub. One of the factors widely thought to be responsible for Modi’s victory was support from India’s “neo-middle class”—a young, newly- urbanized section of the electorate seeking employment and improved living standards but struggling amidst an economic downturn. In a speech inaugurating Make in India, Modi linked the program with the aspirations of this section of society. Modi stated the need to elevate the status …

Smith V. Van Gorkom And The Kobayashi Maru: The Place Of The Trans Union Case In The Development Of Delaware Corporate Law, Robert T. Miller Nov 2017

Smith V. Van Gorkom And The Kobayashi Maru: The Place Of The Trans Union Case In The Development Of Delaware Corporate Law, Robert T. Miller

William & Mary Business Law Review

Although it is dangerous to attempt to say anything new about Smith v. Van Gorkom, the most controversial decision in the history of Delaware corporate law, this Article tries to do so by arguing that the extensive development of Delaware law since the time of the case allows us a perspective on Van Gorkom not available when the case was decided in 1985 or, indeed, for a long time thereafter. In particular, Van Gorkom had as important a role in the evolution of Delaware law as the three other outstanding cases decided by the Delaware Supreme Court in the …

Losing The Digital Shirt Off Your Back: Applying The Unlawful Internet Gambling Enforcement Act To Virtual Property Betting, Erik Gerstner Nov 2017

Losing The Digital Shirt Off Your Back: Applying The Unlawful Internet Gambling Enforcement Act To Virtual Property Betting, Erik Gerstner

William & Mary Business Law Review

In recent years, a myriad of websites have been established, which offer gambling to U.S.-based customers via the Internet, using virtual items existing only within the realms of online video games as currency. A relatively new development, this virtual property has been addressed by courts very little, leaving many questions about how the law of the U.S. would and should treat it for purposes including but not limited to gambling. Because virtual property shares many characteristics with tangible property, it is likely to be found to share many of the same legal aspects as the latter, which would permit the …

Changing Tides In Water Management: Policy Options To Encourage Greater Recycling Of Fracking Wastewater, Romany M. Webb Nov 2017

Changing Tides In Water Management: Policy Options To Encourage Greater Recycling Of Fracking Wastewater, Romany M. Webb

William & Mary Environmental Law and Policy Review

The U.S. has recently experienced a domestic energy renaissance, made possible by technological advances, enabling the development of unconventional oil and gas resources. Vital to this development is hydraulic fracturing (“fracking”), whereby fluid is injected underground at high pressure to fracture the rock, thereby enabling the flow of oil and gas. Fracking has recently faced growing opposition with many concerned about its environmental impacts, particularly its potential to adversely affect water resources, because fracking uses vast amounts of fresh water that ends up as contaminated wastewater. Most of this wastewater is disposed of through underground injection, resulting in its permanent …

A Fix For A Thirsty World - Making Direct And Indirect Reuse Legally Possible, Heather Payne

William & Mary Environmental Law and Policy Review

Reliably providing safe drinking water to the public is an essential function of state and local governments. Across the United States, government officials and public water system managers are exploring mechanisms for ensuring water security. One method for increasing public drinking water security that has garnered the attention of water officials and the public is returning treated wastewater to the drinking water supply. However, in the absence of federal regulations on water reuse, states need guidance to develop the statutory framework necessary to make potable reuse legal. This Article details the processes of direct and indirect potable reuse and reviews …

Maximizing Ponzi Loss Deductions For Estate And Income Tax Purposes: Are Taxpayers Better Off Dead?, Valrie Chambers, Brian Elzweig

William & Mary Business Law Review

There is a long history of cases interpreting whether a theft loss deduction for securities fraud is allowable for personal income taxes. The cases require that for a theft loss to be actionable as such, it would have to meet the requirements of the common law definition of theft in the U.S. state in which it occurred. This generally requires direct privity between the person claiming the loss and the person who committed the theft. Because most securities transactions are brokered, the direct privity is lost and a theft loss deduction is denied in favor a capital loss. Recently, in …
