In 2014, an undercover investigator working for Mercy For Animals documented horrific animal cruelty at the Dry Creek Dairy in Hansen, Idaho. Video of the abuse was released nationally. The owners of the dairy instituted reforms and the abusers were prosecuted. But the law that was passed this time, within months of the video’s release, protects neither the animals nor the food supply, but the agriculture industry.

Regulation-Tolerant Weapons, Regulation-Resistant Weapons And The Law Of War, Sean Watts
International Law Studies
The historical record of international weapons law reveals both regulation-tolerant weapons and regulation-resistant weapons, identifiable by a number of criteria, including effectiveness, novelty, deployment, medical compatibility, disruptiveness and notoriety. This article identifies these criteria both to explain and inform existing weapons law, and also to facilitate efforts to identify weapons and emerging technology that may prove susceptible to future law of war regulation. By charting both the history and methodology of weapons law with a view toward identifying forces and influences that have made some weapons susceptible to international regulation and made others resistant, this article offers a starting point …

Do Law School Outcomes Follow The Legal Myth Of Thirds?: An Analysis Of The After The J.D. Study, Michael W. Raphael, Tanesha A. Thomas
Graduate Student Publications and Research
The legal myth of thirds is the belief that each graduating class of law students can be divided into thirds where the top third end up becoming law professors, the middle third become judges and the bottom third become lawyers. Such discourse is indicative of a meritocratic society and a 2014 survey done at a small New England law school found that 36.9% of respondents (N=92) have indeed heard that this was the case. The authors feel that the mere existence of such a rumor suggests that there is concern regarding intra-professional stratification. Using data from the American Bar Foundation’s …
Emerging Technologies And Loac Signaling, Eric Talbot Jensen
Emerging Technologies And Loac Signaling, Eric Talbot Jensen
International Law Studies
As States seek to weaponize new technologies such as robotics, cyber tools and nanotechnology, the current law of armed conflict (LOAC) that guides the employment of existing weapons will signal rules and principles that should guide national decisions on what new technologies to weaponize and how to do so in a way that ensures compliance with battlefield regulation. LOAC has served this "signaling" function historically with respect to innovative weapon systems such as balloons, submarines, airplanes, and nuclear weapons, and will continue to do so as nations look forward to potentially weaponizing emerging technologies.

Michigan V. Environmental Protection Agency, Lindsay Ward
Public Land & Resources Law Review
What’s the price of clean air? The Supreme Court found that the EPA, tasked with setting limits on hazardous pollutants, unreasonably declined to consider cost when regulating power plant emissions under the Clean Air Act. 42 U.S.C. § 7412 gives the EPA the authority to regulate power plants under the Clean Air Act as long as the Agency finds that “regulation is appropriate and necessary.” In the instant case, the EPA concluded that regulation met both these requirements. Finding the agency’s decision unreasonable, the majority struck down the EPA’s rule. The minority, however, asserted that the decision was unsound; it …

Public Land & Resources Law Review
The Ninth Circuit employed Chevron deference in their decision to confirm BSEE’s approval of Shell’s Oil Spill Response Plans. This holding represents a potential nail in the coffin for the parties seeking to block offshore drilling permits. Although the dissent refutes the majority’s interpretation of the ESA and NEPA consultation processes, this case stands as an example of how ambiguity in statutory language can have dire consequences on citizens seeking to enforce harsher environmental standards under an APA challenge.
