Of Truths, Secrets, And Loyalties: Political Belonging And State Building In Poland After State Socialism, Saygun Gokariksel
Of Truths, Secrets, And Loyalties: Political Belonging And State Building In Poland After State Socialism, Saygun Gokariksel
Dissertations, Theses, and Capstone Projects
This dissertation is an ethnographic study of the accusations of 'collaboration' with the communist-era secret service in Poland's capitalist democracy. Situated in the global context of the 1989 'revolutions,' it examines the role of law in redrawing the moral and political boundaries of the new body politic and redefining the loyalties of the new citizen-subject of the neoliberalizing state. Specifically, my research concentrates on the legal process called 'lustration' (lustracja) in Poland, the state-centered purges of real or imagined secret communist agents, informers, and spies. Focusing on the contentious legal-political struggles from 2005 to 2008 and their aftermath, it explores …
Do Free Mobile Apps Harm Consumers?, J. Gregory Sidak
Do Free Mobile Apps Harm Consumers?, J. Gregory Sidak
San Diego Law Review
Google distributes proprietary applications for its open-source Android mobile operating system (OS) free of charge. Some of those applications (apps) are offered together as a suite of apps known as Google Mobile Services (GMS). Manufacturers of mobile devices can agree, pursuant to Google's Mobile Application Distribution Agreement (MADA), to install the suite of apps on their devices at a price of zero. Some theorize that Google's policy of offering some applications together as a suite of apps harms competitors or menaces consumer welfare. In April 2015, the European Commission expressed such concerns when it initiated a formal antitrust investigation that …
Whose Genome Is It Anyway?: Re-Identification And Privacy Protection In Public And Participatory Genomics, Sejin Ahn
San Diego Law Review
This Comment advocates for a comprehensive solution to achieve the balance between privacy rights and availability of information. In particular, a strong ban on malicious re-identification and broader anti-discrimination and privacy legislation are necessary to ensure the participants' privacy protection and encourage participation in genomics projects. In addition, the scientific community should establish data standards that can aid in implementation of protective measures to minimize privacy violations. Part II provides an overview of recent developments in genomic technologies and public and participatory genomics. Part III summarizes the privacy issues present in public genomics. Part IV reviews current legislation on genetic …
Legal Aspects Of Satellite Communications—A Mini Handbook, Frans G. Von Der Dunk
Legal Aspects Of Satellite Communications—A Mini Handbook, Frans G. Von Der Dunk
Space, Cyber, and Telecommunications Law Program: Faculty Publications
Satellite communications, the most extensive, commercialized, and applications-oriented of outer space activities, is not a sector ruled by a single, coherent legal regime even at the international level. Already at present at least ten regimes would potentially or actually impact any particular satellite operation, service, or scenario. The current contribution, intended as a “mini-handbook” excerpted from the 2015 Handbook of Space Law published by the present author, addresses only the three generally most important of those regimes: the generic body of international space law, the regime developed in the context of the International Telecommunication Union (ITU), and the trade regime …
Incentivizing Corporate America To Eradicate Transnational Bribery Worldwide: Federal Transparency And Voluntary Disclosure Under The Foreign Corrupt Practice Act, Peter Reilly
Faculty Scholarship
In 1977, it was discovered that hundreds of U.S. companies had spent hundreds of millions of dollars in bribes to improve business overseas. In response, Congress passed the Foreign Corrupt Practices Act (FCPA), thereby making it illegal to bribe foreign officials to obtain a business advantage. A major tension has emerged between the federal agencies charged with enforcing the FCPA (i.e., the DOJ and SEC), and the corporate entities trying to stay within the legal and regulatory bounds of the statute. Specifically, while the government appears to be trying to maximize discretion and flexibility in carrying out its enforcement duties, …
Breach Of Agreement Versus Vexatious, Oppressive And Unconscionable Conduct: Clarifying Their Relationship In The Law Of Anti-Suit Injunctions, Wei Yao, Kenny Chng
Breach Of Agreement Versus Vexatious, Oppressive And Unconscionable Conduct: Clarifying Their Relationship In The Law Of Anti-Suit Injunctions, Wei Yao, Kenny Chng
Research Collection Yong Pung How School Of Law
Cases warranting the grant of an anti-suit injunction can be divided into three main categories: breach of agreement, vexatious, oppressive, or unconscionable conduct, and abuse of process. A series of Singapore cases have demonstrated that the boundaries between the first two categories are ambiguous in Singapore law. This ambiguity reflects a lack of clarity about the principles underlying anti-suit injunctions and creates uncertainty as to the applicable analysis for each category. This article argues that the two categories should be distinct in kind, with both categories remaining part of the court’s equitable jurisdiction. Such an approach will provide a good …
The Singapore Legal System, Eugene K. B. Tan, Gary Kok Yew Chan
The Singapore Legal System, Eugene K. B. Tan, Gary Kok Yew Chan
Research Collection Yong Pung How School Of Law
The Singapore legal system is a rich tapestry of laws, institutions, values, history and culture. Like the Singapore-made quilt, each strand of the legal system is woven together to form a jurisprudential kaleidoscope bounded by a unique national identity.
The legal system will inevitably undergo tension as socio-economic and politico-legal changes unfold with increased globalisation and regionalisation. Thus, Singapore has to respond swiftly and deftly in creating new laws and institutions or adapting existing ones.
In this regard, Singapore is and has been ready and willing to learn from the legal developments taking place in foreign jurisdictions with similar aspirations. …

Clean Energy Federalism, Felix Mormann
Clean Energy Federalism, Felix Mormann
Faculty Scholarship
Legal scholarship tends to approach the law and policy of clean energy from an environmental law perspective. As hydraulic fracturing, renewable energy integration, nuclear reactor (re)licensing, transport biofuel mandates, and other energy issues have pushed to the forefront of the environmental law debate, clean energy law has begun to emancipate itself. The emerging literature on clean energy federalism is a symptom of this emancipation. This Article adds to that literature by offering two case studies, a novel model for policy integration, and theoretical insights to elucidate the relationship between environmental federalism and clean energy federalism.

Drugs On Tap: Managing Pharmaceuticals In Our Nation’S Waters, Gabriel Eckstein
Drugs On Tap: Managing Pharmaceuticals In Our Nation’S Waters, Gabriel Eckstein
Faculty Scholarship
Pharmaceuticals in the environment and public water supplies are believed to have serious impacts on human and environmental health. Current research suggests that exposure to certain drugs and their residues may result in a variety of adverse human health effects. Other studies more conclusively show that even minute concentrations of pharmaceuticals in the environment can have detrimental effects on aquatic and terrestrial species. Unfortunately, the cost of removing these pernicious substances is out of the financial reach of most municipalities and wastewater and drinking water treatment operators.
Despite the concerns, little effort has been made to develop broad management, mitigatory, …

Griswold, Geduldig, And Hobby Lobby: The Sex Gap Continues, Maya Manian
Griswold, Geduldig, And Hobby Lobby: The Sex Gap Continues, Maya Manian
Scholarly Articles in Law Reviews & Journals
In her article, The (Non)-Right to Sex, Professor Mary Ziegler excavates the fascinating legal history of the “sex gap” — the historical failure to address sexual liberty — in the constitutional canon and offers an important cautionary tale for contemporary advocacy of marriage equality. By surfacing lost efforts to expand sexual liberty, and by linking that liberty to intersectional concerns about class, gender, and racial equality, Professor Ziegler both explains why sexual freedom has received such limited constitutional protection and shows how incrementalist litigation strategies aimed at progressive legal change have inadvertently strengthened the state’s power to delimit sexual expression. …
Fashioning A General Common Law For Employment In An Age Of Statutes, Michael C. Harper
Fashioning A General Common Law For Employment In An Age Of Statutes, Michael C. Harper
Faculty Scholarship
In the current post-Erie age of statutes the Supreme Court continues to have potential influence over the development of a “general” common law used to decide recurring issues governed by state law. This influence, which has drawn little commentary, derives from the Court’s authority to consider analogous issues when filling gaps in federal statutes, sometimes through express reliance on general common law. The influence is through the power to persuade, like that of the federal judiciary in its general common lawmaking age of Swift, rather than through the power to command, like that of the federal judiciary in the formulation …

Assessment Of Damages In Intellectual Property Cases: Some Recent Examples Of "The Exercise Of A Sound Imagination And The Practice Of A Broad Axe"?, Gordon Ionwy David Llewelyn
Research Collection Yong Pung How School Of Law
There are few cases outside the US that deal with the assessment of damages for infringement of intellectual property rights. When they do, as Lord Shaw said: “[It involves] the exercise of a sound imagination and the practice of the broad axe.” This article discusses decisions where the infringer has ended up paying at the low end of what it would have paid as a legitimate user. One of the fundamental rights of the owner of an intellectual property right is the freedom to decide if others can use it, so the courts’ concern to avoid high awards can mean …
Equity In The Age Of Statutes, Hang Wu Tang
Equity In The Age Of Statutes, Hang Wu Tang
Research Collection Yong Pung How School Of Law
It has been said that we have moved from a legal system dominated by the common law to one where statutes represent the primary source of the law. Where does that leave equitable jurisprudence in the age of statutes? This article examines the tricky interplay between statute law and equity. It is suggested that there are broadly three categories of cases when the court is considering the application of equitable doctrines in the context of a statute. First, the statute may explicitly or implicitly abolish the application of a relevant equitable doctrine. In this case, the relevant equitable doctrine should …

Singapore’s vibrant dispute resolution sector has been growing on the back of a significant rise in commercial transactions in Asia and a corresponding increase in the number and complexity of cross-border disputes. In particular, Singapore has achieved significant success in the field of international arbitration. Singapore has been recognised as the third most preferred seat of arbitration, after London and Geneva, and the Singapore International Arbitration Centre (“SIAC”) is the fourth most preferred arbitral institution worldwide despite being a relatively young institution. In recent years, Singapore law firms have also ranked amongst the top international arbitration practices in Asia.In order …

Dividing The Single Indivisible Transaction: Balancing The Interests Of Mortgagees And Innocent Occupants, Vincent Ooi
Research Collection Yong Pung How School Of Law
When a mortgagee provides the funds necessary to purchase a property, the law protects the priority of the mortgagee’s security interest from any other interests in the property created after that property was purchased (unless consented to by the mortgagee). The House of Lords affirmed this principle in Abbey National Building Society v Cann (‘Cann’), and rejected the technical argument based on a scintilla temporis in favour of the policy argument concerning the need to ensure that housing loans are available and affordable. The effect of this principle is to allow the mortgagee to enforce the security interest in the …

Broad, Inflexible And Redundant?: Fixing The Anti-Avoidance Rule In Section 75a Finance Act 2003, Vincent Ooi
Research Collection Yong Pung How School Of Law
Sections 75A - 75C of the Finance Act 2003 (‘the Sections’) were enacted with the intention of countering schemes that have the effect of reducing Stamp Duty Land Tax (‘SDLT’) liability. These sections were subjected to criticism right from the start, with practitioners noting its exceptionally broad scope and some going so far as to call it ‘fundamentally deficient’ and ‘almost unworkable in practice’. The recent decisions of the First-Tier Tribunal in Project Blue Ltd v Revenue and Customs Commissioners (‘Project Blue FTT’) and its subsequent appeal to the Upper Tribunal in Project Blue Ltd v Revenue and Customs Commissioners …

Let the letters in the title of the judgment not fool anyone as to the anonymity of the parties involved: the facts that can be gleaned from this and the relevant Austrian judgments (the Kazakhstani plaintiff was alleged to have kidnapped other Kazakhs and lived at various junctures in Austria and Malta) should provide enough information for anyone with rudimentary skills in operating search engines to unearth the sensational beginning and unexpected ending of the protagonist. Such details, unfortunately, belong in a blockbuster movie rather than an academic case note.

Op-ed about being Singaporean, in our historic 2015 elections.
"In the midst of our historic elections, I would like to remind Singaporeans that there remains a wider world out there. That our concerns about CPF money, high housing prices, rising income inequality, foreign workers, transportation woes, and the AHPETC saga, while important, are nonetheless First World problems. We have the luxury of arguing about them because we don’t have to worry about the fundamental problems of survival. Literally.
Thus, as we consider what we would like our country to look like in the coming years, I suggest that we first …

Obergefell’S Prescription: Why The Fourteenth Amendment Trumps State Employees’ Free Exercise Claims, Douglas B. Mckechnie
Obergefell’S Prescription: Why The Fourteenth Amendment Trumps State Employees’ Free Exercise Claims, Douglas B. Mckechnie
ConLawNOW
Soon after the United States Supreme Court’s decision in Obergefell v. Hodges, some elected officials and civil servants objected to the requirement that same-sex couples be offered marriage licenses. In particular, they argued that a government employee whose job duties include issuing marriage licenses cannot be forced to do so if it would violate his or her religion’s dictates. This piece argues that position is unavailing as it ignores the jurisprudence construing the free exercise clause of the First Amendment as well as the mandate created by the Court’s interpretation of the Fourteenth Amendment in Obergefell.

Vat Fraud And Terrorist Funding: The Azizi Extradition, Part Ii, Richard Thompson Ainsworth
Faculty Scholarship
This paper considers the remaining seven (7) Missing Trader Intra-Community (MTIC) fraud schemes alleged (some conceded) to have been conducted by Samir Azizi, a 25 year old German/Afghan citizen, who was extradited from the United States to Germany on April 14, 2015. The MTIC fraud schemes considered in this Part II involve alleged losses of €45,801,403 under 63 further criminal counts.
Underlying both Parts of this assessment is a fundamental (but unanswered) question: “Who exactly is Samir Azizi? Is he the mastermind of a multi-million euro VAT fraud, a fundraising fraudster for terrorist organizations, or a youthful face-of- convenience disguising …
