Journal Articles
In June 2015, after much anticipation and a few leaks, Pope Francis released his encyclical entitled “Laudato Si’: On Care for Our Common Home. “Laudato si’” means “praise be to you,” a phrase that appears repeatedly in Saint Francis’ Canticle of the Sun poem. The encyclical itself has been widely praised and widely reported, far more than one would expect from an explicitly religious document. The encyclical is breathtakingly ambitious. Much of it is addressed to “every person living on this planet,” while specific parts speak to Catholics and others to religious believers generally. It surveys a sweeping range of …

Horizontal Innovation And Interface Patents, Bernard Chao
Horizontal Innovation And Interface Patents, Bernard Chao
Sturm College of Law: Faculty Scholarship
Scholars understandably devote a great deal of effort to studying how well patent law works to incentive the most important inventions. After all, these inventions form the foundation of our new technological age. But very little time is spent focusing on the other end of the spectrum, inventions that are no better than what the public already has. At first blush, studying such “horizontal” innovation seems pointless. But this inquiry actually reveals much about how patents can be used in unintended, and arguably, anticompetitive ways.
This issue has roots in one unintuitive aspect of patent law. Despite the law’s goal …

South Africa's Agricultural Sector Twenty Years After Democracy (1994 To 2013), Jan C. Greyling, Nick Vink, Edward Mabaya
Professional Agricultural Workers Journal
Abstract
South Africa’s agricultural sector has undergone substantial policy reform since the dawn of democracy in 1994. Now, twenty years later, it is an opportune time to look back at this period to review key successes and failures. This article revisits South Africa’s context and policy at the start of this period, the reforms that followed, and evaluates the transformational effect (or lack thereof) on the sector. For this purpose, the article pulls from both qualitative sources and descriptive statistics to provide both a historical context and current perspective. The analysis shows that redistributive land reform and smallholder support programs …

Nevada Supreme Court Summaries
The Court considered an appeal from a district court order dismissing a medical malpractice complaint. The Court held that because NRS § 41A.071 creates threshold requirements for bringing medical malpractice suits, it must be construed consistently with the liberal pleading requirements. The Court reversed and remanded.

If banks are not providing credit to the poor, the state should provide it directly. The existing post office framework represents the most promising path toward effectuating such a public option. American banks long ago deserted their most impoverished communities, but post offices, even two centuries later, have remained — still rooted in an egalitarian mission. There have never been barriers to entry at post offices, and their services have been available to all, regardless of income.

Nevada Supreme Court Summaries
The Court concluded that the promissory note, which had security interest by both a deed of trust of Arizona real property and personal guaranties, was governed by Nevada limitations period because of the Nevada choice-of-law provision within the contract. Consequently, the Court held that the party seeking deficiency judgment was time-barred pursuant to NRS 40.455(1) because the judgment was not sought within six months of the foreclosure sale of the collateral property.

Nevada Supreme Court Summaries
The Court held that an employment arbitration agreement, which contains a clause waiving the right to initiate or participate in class actions, constitutes a valid contract, even though it is not signed by the employer. The Court further determined that the Federal Arbitration Act applies to all transactions involving commerce and does not conflict with the National Labor Relations Act, which permits and requires arbitration. Finally, the Court found that a party does not automatically waive its contractual rights to arbitration by removing an action to federal court.
