Fighting The Tofu: Law And Politics In Scholarship And Adjudication, Stephen M. Feldman
Cardozo Public Law, Policy & Ethics Journal
Law professors and political scientists often aim to deny, control, or otherwise tame the dynamic interactions of law and politics that are integral to adjudication. The University of Chicago Law Review recently published an issue containing two such articles: Charles L. Barzun's Impeaching Precedent and Eric A. Posner and Adrian Vermeule's Inside or Outside the System. Both articles sought to police the boundary between law and politics, between the internal and external. The two articles, however, struggled to reach that shared goal in strikingly different and ultimately irreconcilable ways, both of which were unavailing. And that is my point: …

The Effect Of International Adoption As An Orphan Care Method In Uganda, Amy N. Bergey
The Effect Of International Adoption As An Orphan Care Method In Uganda, Amy N. Bergey
Selected Honors Theses
International adoption has been gaining popularity since the end of the twentieth century (Selman, 2002). Throughout this increase in international adoptions, the focus has drifted away from its original goal of providing homes that are in the best interest of the children (Graff, 2008). It has become more common for international adoption agencies to conduct international adoptions as a profitable business strategy, as international adoptive parents pay an average of $40,000 for a child (MGLSD, 2012; Graff, 2008). While this is not always the case, corruption is prevalent in the system and can endanger children to trafficking and illegal adoptions …

Schooling The Police: Race, Disability, And The Conduct Of School Resource Officers, Amanda Merkwae
Michigan Journal of Race and Law
On March 25, 2015, police officers effectuated a violent seizure of a citizen in Kenner, Louisiana: [T]he police grabbed her by the ankles and dragged her away [from the tree]. . . . [She was] lying face down on the ground, handcuffed with her face pressed so closely to the ground that she was having difficulty breathing due to the grass and dirt that was so close to her nose and mouth. An officer was kneeling on top of her, pinning her down with a knee squarely in [her] back. Several other officers, as well as several school administrators, stood …
Incubating Community Law Practices: Post-Graduate Models For Lawyer Training & Access To Law, Luz E. Herrera
Incubating Community Law Practices: Post-Graduate Models For Lawyer Training & Access To Law, Luz E. Herrera
Faculty Scholarship
While the greatest number of lawyers practice in solo and small firms, law schools do not devote sufficient resources to preparing law students for the opportunities and challenges that these types of law firms present. The recent economic recession has highlighted the need to better train lawyers to launch law practices right out of law school. However, experienced lawyers, law professors and state bar policy makers worry that individuals who start their own practices are not sufficiently trained to practice and could irreparably harm a client. Many new lawyers share that concern but also worry about the financial instability that …
Bringing Out The Small Guns: Title 50 Covert Operations As A Response To Unconventional Threats In The Modern Era, Anthony J. Fontanella
Bringing Out The Small Guns: Title 50 Covert Operations As A Response To Unconventional Threats In The Modern Era, Anthony J. Fontanella
Connecticut Journal of International Law
The international interests of the United States currently face an onslaught of unconventional tactics from parties looking to expand their spheres of influence. The international laws of armed conflict, written in the aftermath of World War II, sought to set the parameters of future armed conflicts, but many parties in the modern era have found that not operating within those parameters confers a strategic advantage. Terrorism, warfare via proxies, and cyber attacks are the tools offorce projection in this brave new world. The US. government has come to realize that a conventional military response is of limited effectiveness against these …
Secession, The Rule Of Law And The European Union, Frederick V. Perry, Scheherazade Rehman
Secession, The Rule Of Law And The European Union, Frederick V. Perry, Scheherazade Rehman
Connecticut Journal of International Law
One of the most pressing discussions in international law today pertains to the rights of portions of states (or parts of coalitions of states) to secede. At the end of World War II, there were 51 states worldwide; today, there are nearly 200. Twentysix have been formed since 1990.1 As recently as the autumn of 2015 Scotland held a national referendum on independence from the United Kingdom. s Plans for Scotland's secession from Great Britain and the United Kingdom were in the news nearly every day leading up to the vote and kept the British leadership up at night worrying …

Ten Types Of Israeli And Palestinian Violations Of The Laws Of War And The Icc, Jordan J. Paust
Connecticut Journal of International Law
This article will address international law that is relevant to longstanding and politically contentious issues regarding four types of conduct that Israel has been found to have authorized or facilitated in territories that Israel occupied after the 1967 war. The article will also address six types of manifest violations of the laws of war by Palestinians since mid-June 2014. In particular, the focus in Part II will be on what laws of war are applicable to use of collective punishment, deportation of civilians, infusion of one's own nationals into occupied territory, and annexation of occupied territory. The focus in Part …
The Necessity Of A Human Rights Accountability For The United Nations, Gerhard Niedrist
The Necessity Of A Human Rights Accountability For The United Nations, Gerhard Niedrist
Connecticut Journal of International Law
The United Nations is an exceptional organization that covers nearly all states of the world. The UN has not only contributed greatly to the maintenance of international peace and security but has also contributed significantly to the development of the present international human rights regime. With the end of the Cold War and the new geopolitical order in the early nineties, the concept of peace maintenance changed more and more to active peace-enforcement. UN operations gradually turned into "peace-making" operations, like those in Yugoslavia and Rwanda in the first half of the nineties. This new type ofpeacemaking also led to …

Beyond The Visiting Room: A Defense Counsel Challenge To Conditions In Pretrial Confinement, Amber Baylor
Faculty Scholarship
Defense attorneys are well acquainted with the ill-considered and extreme use of solitary confinement in local jails. Isolation is one of many problems clients face while locked up in jail awaiting trial. Other common conditions of pretrial confinement include lack of mental health treatment, inadequate medical care, violence from corrections staff, and lack of protection from the violence of others. "Owing time", a recently dismantled practice, is just one example of jails' frivolous use of extreme isolation practices. At times, youth in the juvenile facility at Rikers were placed in solitary so often that there was a waitlist at the …
When Biopharma Meets Software: Bioinformatics At The Patent Office, Saurabh Vishnubhakat, Arti K. Rai
When Biopharma Meets Software: Bioinformatics At The Patent Office, Saurabh Vishnubhakat, Arti K. Rai
Faculty Scholarship
Scholars have spilled much ink questioning patent quality. Complaints encompass concern about incoming applications, examination by the U.S. Patent and Trademark Office (“USPTO”), and the USPTO’s ultimate output. The literature and some empirical data also suggest, however, that applications, examination, and output may differ considerably based on technology. Most notably, although definitions of patent quality are contested, quality in the biopharmaceutical industry is often considered substantially higher than that in information and communications technology (ICT) industries.
This Article presents the first empirical examination of what happens when the two fields are combined. Specifically, it analyzes the creation and early history …

Toward A Global Regime Of Vessel Anti-Fouling, James Kraska, Daniel Rittschof
Toward A Global Regime Of Vessel Anti-Fouling, James Kraska, Daniel Rittschof
Duke Environmental Law & Policy Forum
Vessel anti-fouling is key to the efficient operation of ships, and essential for effective control of invasive species introduced through international shipping. Anti-Fouling Systems, however, pose their own threats to marine environments. The Anti-Fouling Convention of 2001 banned the use of organotin compounds such as Tributyltin, and created a system for adoption of alternative anti-fouling biocides. In 2011, the Marine Environmental Protection Committee of the International Maritime Organization (IMO) released guidelines on bio-fouling management record keeping, installation, inspection, cleaning, maintenance, design and construction. Though these Guidelines provide a template for more effective and environmentally sound anti-fouling control and implementation, they …
