"Green" Performance: The Future Of Performance-Based Executive Compensation?, Ben Schwefel Jan 2015

"Green" Performance: The Future Of Performance-Based Executive Compensation?, Ben Schwefel

San Diego Journal of Climate & Energy Law

Although sustainability performance appears to be a logical extension of the traditional performance-based compensation model, the effect and result of such performance remains unclear and untested across the market. The adoption of broad-based sustainability performance measures may be dangerous because, often times, these measures are tailored to the corporation and may decrease total shareholder return in the short run. Regardless of whether or not the corporation decides to introduce these measures, their effect on total shareholder return and other corporate interests requires an individualized analysis.
Part II of this Comment discusses the current state of executive compensation, including the use …

Solar Energy, Utilities, And Fairness, Troy A. Rule Jan 2015

Solar Energy, Utilities, And Fairness, Troy A. Rule

San Diego Journal of Climate & Energy Law

This Article analyzes the primary fairness arguments that utilities are leveling against net metering programs and electricity rate designs as rooftop solar energy expands across the country. By categorizing and more thoroughly evaluating these arguments, this Article seeks to enhance the dialogue between utilities, legislators, state regulators, and the solar energy industry over how to best orchestrate the nation’s shift toward more sustainable electricity strategies.
Part II of this Article describes how net metering programs and other factors are spurring dramatic growth in distributed solar energy generation in the United States and how utilities are increasingly lobbying for policy changes …

Unhealthy Determinations: Controlling "Medical Necessity", Janet L. Dolgin Jan 2015

Unhealthy Determinations: Controlling "Medical Necessity", Janet L. Dolgin

Hofstra Law Faculty Scholarship

The notion of medical necessity has been the operative tool through which healthcare coverage determinations in the United States have been rendered and justified. Now, for most people, decisions about coverage translate into decisions about healthcare since few people can afford to pay for their own healthcare. The notion of medical necessity constitutes a necessary component of any healthcare system that is committed to providing high-quality healthcare at a sustainable cost. In practice, however, reliance on medical necessity to determine healthcare coverage is only as productive as the larger health care system within which medical necessity determinations occur. Definitions of …

Intellectual Property Infringement As Vandalism, Irina D. Manta, Robert E. Wagner Jan 2015

Intellectual Property Infringement As Vandalism, Irina D. Manta, Robert E. Wagner

Hofstra Law Faculty Scholarship

Defenders of strong intellectual property rights often maintain that intellectual property infringement is theft and that the sanctions associated with it ought to be high. Others are skeptical of the property comparison and think that much lower sanctions are appropriate.

In this Article, we argue that a careful analysis demonstrates: 1) that intellectual property infringement can be analogized to a property crime, but 2) that the more analogous crime is vandalism or trespass rather than theft. This categorization takes the rhetorical punch out of the property comparison. In addition to analyzing the natures of the various offenses, this Article investigates …

Keeping The State’S Secrets: Ireland’S Road From ‘Official’ Secrets To Freedom Of Information, Michael Foley

Books/Book chapters

The introduction of the Freedom of Information act in Ireland in 1997 was a profound change for a state, a civil service and political system far more comfortable with official secrets. It has had a transformational effect on relations between citizen and the state, and has been useful for journalists despite many challenges. After its introduction it was then amended, with high costs and limitations imposed. It has subsequently been amended again to restore much of its previous powers.
