Passing The Torch But Sailing Too Close To The Wind: Congress’S Role In Authorizing Administrative Branches To Promulgate Regulations That Contemplate Criminal Sanctions, Reem Sadik Nov 2014

Passing The Torch But Sailing Too Close To The Wind: Congress’S Role In Authorizing Administrative Branches To Promulgate Regulations That Contemplate Criminal Sanctions, Reem Sadik

Legislation and Policy Brief

The Supreme Court has stated that Congress must simply “lay down by legislative act an intelligible principle” to which the agency must conform. If this is done, a court will find the delegation of broad authority to the agency to be constitutional. There is, however, an open issue regarding whether the “intelligible principle” standard applies to delegations of authority that allow for the promulgation of both civil and criminal penalties. In Touby v. United States, the Supreme Court was asked whether “something more than an ‘intelligible principle’ is required” when Congress authorizes an agency to issue regulations that contemplate …

An Innovative Approach To Improving Father-Child Relationships For Fathers Who Are Noncompliant With Child Support Payments: A Mixed Methods Evaluation, John R. Gallagher, Joan R. Rycraft, Tommy Jordan Nov 2014

An Innovative Approach To Improving Father-Child Relationships For Fathers Who Are Noncompliant With Child Support Payments: A Mixed Methods Evaluation, John R. Gallagher, Joan R. Rycraft, Tommy Jordan

Journal of Adolescent and Family Health

Mixed methods were used to evaluate the effectiveness of the Fathers Offering Children Unfailing Support (FOCUS) program. FOCUS is a diversion program which is designed to offer an alternative to incarceration for fathers who are noncompliant with child support payments. Quantitative data were collected through a pretest/posttest design (n = 55) and qualitative data were collected through telephone interviews with FOCUS instructors (n = 2) and community key stakeholders (n = 5) and focus groups with FOCUS participants (n = 76). FOCUS appears to be benefiting children by increasing their fathers’ emotional support, strengthening co-parenting relationships, and promoting their fathers’ …

Charting A New Course: Metal-Tech V. Uzbekistan And The Treatment Of Corruption In Investment Arbitration, Michael A. Losco Nov 2014

Charting A New Course: Metal-Tech V. Uzbekistan And The Treatment Of Corruption In Investment Arbitration, Michael A. Losco

Duke Law Journal Online

This Essay examines Metal-Tech’s treatment of corruption, building upon the analytical structure set forth in this author’s 2014 Note, Streamlining the Corruption Defense. That Note’s framework for analyzing ICSID awards involving allegations of corruption proves useful for examining the Metal-Tech award. Implementing that framework, this Essay concludes that the standard of proof applied by the tribunal represents a departure from prior ICSID jurisprudence. It also questions whether an application of comparative fault principles could have achieved a more just result. Finally, this Essay argues that the tribunal could have resolved some lingering questions by staying the proceedings pending …

Could it be that American international law experts and human rights advocates are suffering from some form of Stockholm Syndrome — so many defeats and dashed hopes at the hands of our government that we sometimes take excessive comfort in small and imaginary crumbs that it drops for us? For an example of this, look no further than the United States’ appearance last week before the UN’s Committee against Torture in Geneva – the body established by the Convention against Torture (CAT) to monitor State compliance with the Convention.

Christian Persecution In Pakistan: An Examination Of Life In The Midst Of Violence, Rebecca Seiler Nov 2014

Christian Persecution In Pakistan: An Examination Of Life In The Midst Of Violence, Rebecca Seiler

Senior Honors Theses

As a nation founded on religious freedom, it is the duty of the United States to recognize those who stand up for these beliefs across the world in solidarity. International persecution of Christians has dramatically increased due to the spread of radical Islam throughout the world, particularly in South Asia. By means of active, violent persecution as well as more passive forms of aggression, daily life for Pakistani Christians is both challenging and dangerous. While there is no easy solution to this issue, it is essential to continue advocating for those facing persecution and punish the oppressors. The American church …

Law And Religion: Sharia Law And The First Amendment, Joseph A. Williamson Nov 2014

Law And Religion: Sharia Law And The First Amendment, Joseph A. Williamson

Senior Honors Theses

America has long been seen as the capital of religious freedom and individual rights. In recent years a debate has arisen over whether an individual can personally adhere to the legal concept of sharia law under the protections of the first amendment. At the center of this debate is precedent that can be drawn from previous interactions between religion and American ideals. Two similar issues that have been settled both judicially and legislatively are the conscientious draft objector and the federal prohibition of polygamy. By studying the roots of Islamic law and then the basis of these two concepts, a …
