When a defendant’s criminal actions cause loss or damage to a victim’s property, section 775.089, Florida Statutes, requires that the court order the defendant to pay restitution to the victim. The purposes of section 775.089 are both to compensate the victim and to serve the rehabilitative, deterrent, and retributive goals of the criminal justice system. Recently, more and more cases have been decided in which the State was unable to prove the amount of loss sustained by the victim due to precise measurements of value and demanding methods of proof. The Google Art Project is an ambitious attempt by Google to curate worldwide artwork online in the highest resolution possible. Google accomplishes this by partnering with museums where museums provide access to art collections and Google provides the technology to capture high quality images. Abstract: Most aspects of construction projects mainly fall under contractual regime. However, when things go wrong such as when the project is abandoned for various reasons, they may create two different scenarios: a contract that is breached and a fixed structure that is left on the land which may constitute an incomplete benefit that is acquired by one of the parties. The transfer of such benefit is initially made with a legal ground, but that ground has since ceased to exist. If some aspect of that benefit cannot be recovered under a contract, enrichment rules may be competent to solve …

This article explores both the competition and the environmental aspects of the electricity sector in Hong Kong, and a possible linkage between them.There has been considerable public pressure to liberalize the electricity sector in Hong Kong due to longstanding discontent with the persistently high profit of the sector and a regulatory structure that is widely perceived to be ineffective. In light of the government’s seeming reluctance to pursue liberalization, this article examines an alternative approach – litigation under the recently adopted Competition Ordinance. An Empirical Evaluation Of The Connecticut Death Penalty System Since 1973: Are There Unlawful Racial, Gender, And Geographic Disparities?, John J. Donohue

This article analyzes the 205 death-eligible murders leading to homicide convictions in Connecticut from 1973–2007 to determine if discriminatory and arbitrary factors influenced capital outcomes. A regression analysis controlling for an array of legitimate factors relevant to the crime, defendant, and victim provides overwhelming evidence that minority defendants who kill white victims are capitally charged at substantially higher rates than minority defendants who kill minorities, that geography influences both capital charging and sentencing decisions (with the location of a crime in Waterbury being the single most potent influence on which death-eligible cases will lead to a sentence of death), and …

In this paper we examine the Italian rules governing the selling of media “premium” rights by the Italian professional Soccer League. These rights are currently commercialized centrally, i.e. by the League itself for a three years period. We argue that in light of technological evolution and convergence, the practice of selling these rights “per platform” and according to a “no single buyer rule” may harm dynamic efficiency. Interplatform distribution exclusivity should thus prevail, unless these rights were to be considered not only significant in terms of audience and advertisement, but as an essential facility for downstream pay-Tv markets. En una reciente sentencia casatoria, la Sala Civil Permanente de la Corte Suprema ha hecho prevalecer el embargo inscrito frente a la propiedad no registrada. En opinión del autor, esta sentencia, a diferencia de anteriores pronunciamientos, invoca argumentos distintos a los tradicionales, por lo que marca un punto de referencia imprescindible para cualquier análisis de la tendencia jurisprudencial sobre la materia. Este artículo tiene por objeto brindar y analizar algunos datos empíricos sobre el funcionamiento de la Justicia Penal Adolescente luego de siete años de la entrada en vigencia de la Ley N° 20.084. Uno de los objetivos de esta reforma fue adecuar la legislación en la materia a los estándares del Derecho Internacional de los Derechos Humanos, entre los cuales se encuentran el criterio de intervención penal especial reducida o moderada y la utilización de la privación de libertad como medida de ultima ratio.
