Bryane Michael
Bryane Michael (bryane.michael@stcatz.ox.ac.uk)
Canada And Russia In The North Pole: Cooperation, Conflict, And Canadian Identity In The Interpretation Of The Arctic Region, Nick J. Sciullo
Canada And Russia In The North Pole: Cooperation, Conflict, And Canadian Identity In The Interpretation Of The Arctic Region, Nick J. Sciullo
Nick J. Sciullo
The Arctic debate touches on a number of important international issues: national security, energy exploration and policy, environmental concerns, and maritime commerce are but a few. The North Pole, the Arctic more generally, is becoming increasingly important to a number of international actors as climate change causes ice to melt and the Arctic's waters become increasingly navigable. The pressure to lay claim to the Canadian North is intense, as countries clamor for the right to firmly plant their flags and lay the foundations for their military bases and research facilities.
Canadians must confront threats to sovereignty that they have not …
Comentario Del Artículo De Alfonso Herranz-Loncán "Railroad Impact In Backward Economies: Spain, 1850 - 1913", Javier Agudo
Comentario Del Artículo De Alfonso Herranz-Loncán "Railroad Impact In Backward Economies: Spain, 1850 - 1913", Javier Agudo
Javier Agudo

Comentario Del Artículo De Joan R. Rosés Y Blanca Sánchez-Alonso "Regional Wage Convergence In Spain 1850 - 1930", Javier Agudo
Javier Agudo
The Changing Role Of The State In The British Economy Between 1914 And 1921, Javier Agudo
The Changing Role Of The State In The British Economy Between 1914 And 1921, Javier Agudo
Javier Agudo
The First World War represented the first high profile war that took place after the developed world had experienced the Industrial Revolution, and the international economic relations between countries had never been so strong. Based principally in the work by R. H. Tawney "The abolition of economic controls, 1918-1921" (Tawney; 1943), I am going to try to explain in this essay the role of the state during the conflict and how the Government reacted to the different problems that aroused in this period.
Comentario Del Artículo De Joan R. Rosés "Why Isn’T The Whole Of Spain Industrialized? New Economic Geography And Early Industrilalization, 1797-1910", Javier Agudo
Javier Agudo

In Harm's Way: Justification, Excuse, And Civilian Safety In Just War Theory, Sam Grey
In Harm's Way: Justification, Excuse, And Civilian Safety In Just War Theory, Sam Grey
Sam Grey
Just War Theory asserts that armed conflict can be fought in a way that safeguards moral and legal norms while responding to pragmatic/military imperatives. One of the ways in which it seeks to safeguard justice is through specific provisions for the immunity of, and due care for, the vulnerable and innocent. Unfortunately, two doctrines within Just War Theory – the Doctrine of Double Effect and the Doctrine of Supreme Emergency – suspend or vacate these provisions. The net effect is to render justifications inaccessible, leaving only excuses, the use of which establishes that no one is truly accountable, no meaningful …

The Levers Of Legal Design: Institutional Determinants Of The Quality Of Law, Gillian K. Hadfield
The Levers Of Legal Design: Institutional Determinants Of The Quality Of Law, Gillian K. Hadfield
Gillian K Hadfield
In the past decade a comparative law and economics literature has emerged that is largely organized around an effort to explain differences in country economic performance in terms of differences between common law and civil code systems. Assumptions about differences between common law and civil code regimes and the correspondence between legal regimes and judicial behavior are, however, still only weakly based in real institutional features of modern legal systems. In this paper, I examine the institutional determinants of the quality of law developed by a legal regime, drawing on a model from Hadfield (2006) which identifies five key parameters …

Excerpt From Conspiracy Theories: Secrecy And Power In American Culture (Revised And Updated Edition), Mark Fenster
Mark Fenster
This is the introduction to the revised and updated edition of Conspiracy Theories: Secrecy and Power in American Culture (Minneapolis: University of Minnesota Press, forthcoming 2008). The book challenges the dominant academic and popular approach to conspiracy theories, which views them as a paranoid, extremist expression of marginal groups and individuals that pathologically challenges the basic assumptions of American history and the pluralistic political system of the United States. The book is premised on the contrary proposition that the prevalence of conspiracy theories is neither necessarily pernicious nor external to American politics and culture but instead an integral aspect of …

Human And Fundamental Rights And Duties In Portuguese Constitution. Some Reflections, Paulo Ferreira Da Cunha
Human And Fundamental Rights And Duties In Portuguese Constitution. Some Reflections, Paulo Ferreira Da Cunha
Paulo Ferreira da Cunha
The Portuguese Constitution (1976) came after a period of 48 years of authoritarianism and a closed society, in which some happy few enjoyed great privileges while the great majority of people were charged with heavy duties So, by a very understandable "law of human nature", the constituent law givers could not reasonably impose constitutionally many obligations, in an autonomous way. As rights and duties are the twin sides of the same coin, the juridical formulation under the sign of rights also implies obligations, related to those same rights. This is kinder and more pleasant to do by a liberating Constitution...

Princípio Republicano E Virtudes Republicanas, Paulo Ferreira Da Cunha
Princípio Republicano E Virtudes Republicanas, Paulo Ferreira Da Cunha
“Directly or indirectly, Athenian democracy as an extraordinary experiment in social history thus stimulates our own thinking about crucial issues of our own democracy and society, incomparably more complex though they are. The point is precisely that the ancients help us focus on the essentials" - como afirma Kurt A. Raaflaub.

The Centennial Of The Boundary Waters Treaty: A Century Of United States–Canadian Transboundary Water Management, Noah D. Hall
The Centennial Of The Boundary Waters Treaty: A Century Of United States–Canadian Transboundary Water Management, Noah D. Hall
Noah D Hall
The Boundary Waters Treaty of 1909 has now provided the foundation for transboundary United States-Canadian water management for a century. During the one hundred years that the Boundary Waters Treaty has been in place, both the law and the world in which the law operates have changed dramatically. Some of the most relevant and significant changes have been several fold increases in population and thousand fold increases in gross domestic product in North America with correlating increased environmental impacts, the growth of international law and governance institutions, the emergence of modern environmentalism and the resulting creation of domestic and international …
Histéresis Y Desempleo: El Caso De Francia Y Ee.Uu., Javier Agudo
Histéresis Y Desempleo: El Caso De Francia Y Ee.Uu., Javier Agudo
Javier Agudo

Much Ado About Pluralities: Pride And Precedent Amidst The Cacophy Of Concurrences, And Re-Percolation After Rapanos, Donald J. Kochan, Melissa M. Berry, Matthew J. Parlow
Donald J. Kochan
Conflicts created by concurrences and pluralities in court decisions create confusion in law and lower court interpretation. Rule of law values require that individuals be able to identify controlling legal principles. That task is complicated when pluralities and concurrences contribute to the vagueness or uncertainty that leaves us wondering what the controlling rule is or attempting to predict what it will evolve to become. The rule of law is at least handicapped when continuity or confidence or confusion infuse our understanding of the applicable rules. This Article uses the recent U.S. Supreme Court decision in Rapanos v. United States to …
The Soft Power And Persuasion Of Translations In The War On Terror: Words And Wisdom In The Transformation Of Legal Systems, Donald J. Kochan
The Soft Power And Persuasion Of Translations In The War On Terror: Words And Wisdom In The Transformation Of Legal Systems, Donald J. Kochan
Donald J. Kochan
The power of words is the power of persuasion. The exportation of the foundational legal principles that helped form the American republic can serve as instrumental "soft power" tools in the war on terror. Efforts promoting projects like the Arabic Book Program are important vehicles to cross-cultural and cross-lingual international relations. This Article argues that an arsenal of words can be as, or more, powerful than an arsenal of artillery. The West has much to offer, but the rest of the world needs to be able to read it without getting lost in translation. Providing linguistic access to the documents …

The Developer’S Decision Calculus: An Agent-Based Model Of Commercial Development, Mirya R. Holman, Travis Coan
The Developer’S Decision Calculus: An Agent-Based Model Of Commercial Development, Mirya R. Holman, Travis Coan
Mirya R Holman
While considerable research has been devoted to understanding the impact local regulatory environments on housing development, few studies have examined the implications of land-use regulations for commercial development. The paucity of studies is unfortunate given that commercial development often provides municipalities with considerable economic benefits (e.g., employment) and a crucial source of tax revenue. This study presents a formal model of the commercial development process that explicitly incorporates the dynamic interaction of commercial developers and local cities. Specifically, we construct an agent-based model (ABM) of the commercial development process that represents some key features of the development process. We form …
