Dealing With A Depressed Workforce: Are American Employers Doing Enough To Support The Mental Health Challenges Affecting Today's Employees., Charity Felts
The Scholar: St. Mary's Law Review on Race and Social Justice
This comment focuses on what American employers should be doing to recognize and deal with an employee population afflicted by mental illness. Americans suffer from a variety of mental health challenges. The symptoms of these mental illnesses vary from mild to severe. Often, if left untreated, these challenges can turn into full blown mental disorders. Employers typically ignore these issues due to high employee turnover rate and lack of employee loyalty. The cost attributable to mental illness every year is twenty-three billion dollars. However, when calculating the indirect costs like loss of productivity and absenteeism, the actual cost reaches $249 …

A Pregnant Teenager's Right To Education In Texas., Amber Hausenfluck
The Scholar: St. Mary's Law Review on Race and Social Justice
Texas must work to better protect the legal rights of pregnant teenagers within its school districts. Without statewide requirements to ensure the elimination of pregnancy discrimination against students, school districts’ policies vary greatly and often include policies counter to the protections afforded both in Title IX and the Texas Education Code. Title IX requires the choice to attend an alternative school be completely voluntary. However, upon inspection, many Texas schools seem to violate this requirement by compelling or pressuring pregnant students to attend alternative education programs instead of adequately informing them of their educational options. The Texas Education Code guarantees …

Reckoning With Rapanos: Revisiting "Waters Of The United States" And The Limits Of Federal Wetland Regulation, Jonathan H. Adler
Reckoning With Rapanos: Revisiting "Waters Of The United States" And The Limits Of Federal Wetland Regulation, Jonathan H. Adler
Faculty Publications
Rapanos v. United States is the latest episode in the serial effort to identify the precise meaning of "waters of the United States." Federal courts have struggled to define the scope of federal regulatory jurisdiction under the Clean Water Act ("CWA") since the law was adopted.
Although no single opinion in Rapanos commanded a majority of the Court, the Court delivered a discernible holding. Specifically, the Court held that CWA jurisdiction over private lands is limited...and reaffirmed that federal regulatory authority only extends to those wetlands that have a "significant nexus" to navigable waters of the United States. Nonetheless, the …

Corporate Investigations, Attorney-Client Privilege, And Selective Waiver: Is A Half-Privilege Worth Having At All?, Colin P. Marks
Faculty Works
As the title suggests, this article is an analysis of the selective waiver doctrine, which allows a party to disclose materials protected by the attorney-client and work product privileges to the government during investigations without waiving the privilege as to third-party litigants. Specifically, the article analyzes the development of the selective waiver doctrine and why recent polices adopted by governmental agencies, specifically the Department of Justice and SEC, have made this doctrine a forefront of conversation amongst litigators, legislators and academics. But is a blanket adoption of the selective waiver doctrine wise?
Courts have taken a variety of approaches to …

Just Say "No Fishing": The Lure Of Metaphor, Elizabeth G. Thornburg
Just Say "No Fishing": The Lure Of Metaphor, Elizabeth G. Thornburg
University of Michigan Journal of Law Reform
The phrase "fishing expedition" is widely used in popular culture and in the law. In the legal setting, reliance on the metaphor can act as a substitute for rigorous analysis, disguising the factors that influence the result in a case. At best, it is uninformative. Worse, the fishing metaphor may itself shape the court's attitude toward the issue or claim in a lawsuit.
This Article begins by tracing the development of the "fishing expedition" metaphor in civil cases, demonstrating how its changing uses reflect and contribute to the legal controversies of each era. The policies that originally supported limited use …

Globalization And Genocidalism: Fictional Discourse Without Borders (For Fun And Profit), Aleksandar Jokić, Tiphaine Dickson
Philosophy Faculty Publications and Presentations
In this essay we explore the relationship between globalization and genocidalism. “Globalization” is understood as “freedom and ability of individuals and firms to initiate voluntary economic transactions with residents of other countries,” while “genocidalism” is defined as “(i) the purposeful neglect to attribute responsibility for genocide in cases when overwhelming evidence exists, and as (ii) the energetic attributions of “genocide” in less then clear cases without considering available and convincing opposing evidence and argumentation.”
The hypothesis that we defend here as explanatory of globalization’s “surprising” failure to live up to its often repeated theoretical promise that it is not a …
Inside The Administrative State: A Critical Look At The Practice Of Presidential Control, Lisa Schultz Bressman, Michael P. Vandenbergh
Inside The Administrative State: A Critical Look At The Practice Of Presidential Control, Lisa Schultz Bressman, Michael P. Vandenbergh
Michigan Law Review
From the inception of the administrative state, scholars have proposed various models of agency decision-making to render such decision-making accountable and effective, only to see those models falter when confronted by actual practice. Until now, the "presidential control" model has been largely impervious to this pattern. That model, which brings agency decision-making under the direction of the president, has strengthened over time, winning broad scholarly endorsement and bipartisan political support. But it, like prior models, relies on abstractions - for example, that the president represents public preferences and resists parochial pressures that do not hold up as a factual matter. …
The Neglected Political Economy Of Eminent Domain, Nicole Stelle Garnett
The Neglected Political Economy Of Eminent Domain, Nicole Stelle Garnett
Michigan Law Review
This Article challenges a foundational assumption about eminent domain- namely, that owners are systematically undercompensated because they receive only fair market value for their property. In fact, scholars may have overstated the undercompensation problem because they have focused on the compensation required by the Constitution, rather than on the actual mechanics of the eminent domain process. The Article examines three ways that "Takers" (i.e., nonjudicial actors in the eminent domain process) minimize undercompensation. First, Takers may avoid taking high subjective value properties. (By way of illustration, Professor Garnett discusses evidence that Chicago's freeways were rerouted in the 1950s to avoid …
There's No "I" In "League": Professional Sports Leagues And The Single Entity Defense, Nathaniel Grow
There's No "I" In "League": Professional Sports Leagues And The Single Entity Defense, Nathaniel Grow
Michigan Law Review
This Note argues that outside of labor disputes, sports leagues should be presumed to be single entities. Part I argues that professional sports leagues are single entities in disputes regarding league-wide, non-labor policy. In particular, the focus of the Supreme Court's jurisprudence on economic reality rather than organizational form necessitates a finding that professional sports leagues are single entities in non-labor disputes. Part II argues that professional sports leagues are not single entities for purposes of labor disputes; sports leagues, on the whole, do not involve a unity of interest for labor matters. More importantly, existing precedent outside of the …

Assessment Of Pws System Effects On The Random Selection Of Jurors And The Demographic Characteristics Of The Jury Poll In The Superior Court Of Arizona, Maricopa County, Paula Hannaford-Agor, G. Thomas Munsterman
Faculty Publications
In July 2006, the Superior Court of Arizona, Maricopa County (Superior Court), contracted with the National Center for State Courts (NCSC) to review its jury management system. The Superior Court specifically requested that the NCSC Center for Jury Studies determine whether its Proximity Weighted Summoning (PWS) System randomly selects jurors from the master jury list for the county; whether the PWS System systematically excludes any identifiable group or population; and the effect of the PWS System on the demographic characteristics of jurors reporting at the various courthouse facilities in Maricopa County. The Superior Court also requested that the NCSC describe …

York County Court Of Common Pleas, Jury Utilization And Representation Assessment, Paula Hannaford-Agor
Faculty Publications
In May 2006, the York County Office of Court Administration requested that the National Center for State Courts (NCSC) assess its jury management and utilization practices and make recommendations for improvement. The impetus for this request came from concerns both within the Office of Court Administration and from the Administrative Office of the Pennsylvania Courts that existing jury management practices make inefficient use of jurors, imposing excessive and unnecessary costs on the court and on the citizens who report for jury service. The York County Office of Court Administration also expressed concern that its jury pool may not adequately reflect …

Fiduciary Foundations Of Administrative Law, Evan J. Criddle
Fiduciary Foundations Of Administrative Law, Evan J. Criddle
Faculty Publications
An enduring challenge for administrative law is the tension between the ideal of democratic policymaking and the ubiquity of bureaucratic discretion. This Article seeks to reframe the problem of agency discretion by outlining an interpretivist model of administrative law based on the concept of fiduciary obligation in private legal relations such as agency, trust, and corporation. Administrative law, like private fiduciary law, increasingly relies upon a tripartite framework of entrustment, residual control, and fiduciary duty to demarcate a domain of bounded agency discretion. To minimize the risk that agencies will abuse their entrusted discretion through opportunism or carelessness, administrative law …
The Story Of Me: The Underprotection Of Autobiographical Speech, Sonja R. West
The Story Of Me: The Underprotection Of Autobiographical Speech, Sonja R. West
Scholarly Works
This Article begins the debate over the constitutional underprotection of autobiographical speech. While receiving significant historical, scientific, religious, and philosophical respect for centuries, the timehonored practice of talking about yourself has been ignored by legal scholars. A consequence of this oversight is that current free speech principles protect the autobiographies of the powerful but leave the stories of “ordinary” people vulnerable to challenge. Shifting attitudes about privacy combined with advanced technologies, meanwhile, have led to more people than ever before having both the desire and the means to tell their stories to a widespread audience. This Article argues that truthful …

Privileged Evidence And State Security Under The Israeli Law: Are We Doomed To Fail?, Ami Kobo
Privileged Evidence And State Security Under The Israeli Law: Are We Doomed To Fail?, Ami Kobo
Cardozo Public Law, Policy & Ethics Journal
The article examines Israel's legal framework for handling privileged evidence in criminal proceedings, particularly in cases involving state security or public interest. It argues that while Israeli law establishes a balancing test to weigh the need for disclosure against security interests, practical implementation often fails, risking miscarriages of justice. The analysis highlights systemic flaws through cases like Livny and Abu Saada, where the failure to disclose critical evidence led to wrongful convictions. The author suggests procedural reforms to enhance the adversarial process and mitigate these risks.

Panel Report: Secret Evidence In The Investigative Stage: Fisa, Administrative Subpoenas, And Privacy, Jameel Jaffer
Cardozo Public Law, Policy & Ethics Journal
The article examines the increasing reliance on foreign intelligence surveillance tools, such as the Foreign Intelligence Surveillance Act (FISA) and National Security Letters (NSLs), highlighting the tension between national security and civil liberties. It argues that the expansion of these tools under the Patriot Act has raised significant privacy concerns and questions about the adequacy of judicial and public oversight.
