The Phoenix And The Perils Of The Second Best: Why Heightened Appellate Deference To Tax Court Decisions Is Undesirable, Steve R. Johnson

Scholarly Publications

In our judicial structure, both courts of general jurisdiction and specialized courts are empowered to adjudicate federal income tax controversies. A proper relationship among those courts has proved difficult to forge and maintain. Absent an enduring intellectual and political consensus, institutional arrangements have been subject to recurring question and challenge.

This Article has four parts. Part I is foundational. It describes the current structure for the litigation of federal tax controversies. Part II discusses the enduring attractiveness to many of enlarging the role of specialist courts in the federal tax adjudication system. It sketches proposals for a national court of …

When "Reason" Is In The Eye Of The Beholder: A Reexamination Of The "Reasonable Man" Standard As Applied To Organizational Management, James R. Jones

Marketing and Management Faculty Proceedings & Presentations

“Specifically, issues of race, gender, disability, status, etc. provide a new context in which to judge the reasonableness of an individual’s actions.” The concept of the "reasonable man" is one of long standing in the legal profession of the United States. As the United States has become an increasingly polyglot society, the need to reexamine the sufficiency of a single "reasonable man" standard is clear. Specifically, issues of race, gender, disability status, etc. provide a new context in which to judge the reasonableness of an individual's actions.

Sex Discrimination And Insurance For Contraception, Sylvia A. Law Apr 1998

Sex Discrimination And Insurance For Contraception, Sylvia A. Law

Washington Law Review

Unintended pregnancy is a serious problem in the United States. Most private insurance plans do not pay for contraception even though they pay for other prescription drugs and devices. This Article argues that this pattern constitutes sex discrimination and is prohibited by Title VII of the Civil Rights Act of 1964, as amended by the Pregnancy Discrimination Act. It discusses the reasons this issue has been neglected and suggests ways federal and state officials might remedy this common form of gender discrimination.

Asymptomatic Hiv As A Disability Under The Americans With Disabilities Act, Elizabeth C. Chambers Apr 1998

Asymptomatic Hiv As A Disability Under The Americans With Disabilities Act, Elizabeth C. Chambers

Washington Law Review

The Americans with Disabilities Act (ADA) does not state whether it prohibits discrimination against individuals who are infected with HIV but asymptomatic. Some courts have held that the language of the ADA is unambiguous and does not cover asymptomatic HIV as a disability because the virus is not an "impairment" that substantially limits a "major life activity." Other courts have looked behind the statutory language and found that Congress intended to protect asymptomatic individuals with HIV because the virus impairs one's ability to procreate and/or engage in sexual relations. This Comment argues that asymptomatic individuals with HIV are indeed protected …
