Euthanasia, Morality, And Law Introduction, Lawrence B. Solum
Euthanasia, Morality, And Law Introduction, Lawrence B. Solum
Faculty Scholarship
The topic of euthanasia calls into question the proper relationship between morality and law. In this introduction, I shall focus our attention on two questions, the question of morality and the question of law. Consider first the question of morality. Citizens in a democratic society face a moral question, whether assisted suicide or euthanasia is ever the best choice-the choice that virtue requires. Each of us approaches this moral question from our own standpoint, from the moral and religious traditions in which we participate. And the question has different answers. Some of us believe strongly in the sanctity of human …

Site Visit To New Jersey — State And County Experiences With Welfare Reform And Access To Health Care, Michael Anzick, Richard Hegner
National Health Policy Forum
This site visit was the second in a series to examine what is occurring at the state and local level with respect to welfare reform, Medicaid, public health, and safety net and other supportive services. During this visit, policymaker discovered how state officials, directors, and front-line staff at urban and suburban county welfare offices are working with clients to move them off the welfare rolls into jobs and providing the support services necessary for job retention; heard from clients about how programmatic changes are affecting them and their families; learned how the role of safety net health care and temporary …

Memorandum From University Of Illinois College Of Law Professor Ronald D. Rotunda Memorandum To The Honorable Kenneth W. Starr Regarding Whether A Sitting President Is Subject To Indictment [Portions Redacted], Ronald D. Rotunda
United States Department of Justice: Publications
Re: Indictability of the President, with particular respect to whether President Bill Clinton could be charged with indictable offenses while in federal office.
Excerpt from the New York Times article: “It is proper, constitutional, and legal for a federal grand jury to indict a sitting president for serious criminal acts that are not part of, and are contrary to, the president’s official duties,” the Starr office memo concludes. “In this country, no one, even President Clinton, is above the law.”
A Principaled Approach To Valuing Career Goodwill As Distributable Community Property, Brian K. Matise
A Principaled Approach To Valuing Career Goodwill As Distributable Community Property, Brian K. Matise
Student Thesis Honors (1996-2008)
This essay presents the thesis that the enhanced earnings capacity of a career (human capital) that results from the investment of community labor and community funds during a marriage is an intangible asset, career goodwill, that can be valued in the same manner as other forms of goodwill. Other commentators, most notably Allen Parkman, have proposed valuing human capital in a similar manner. Courts have been inconsistent in their recognition of this goodwill because of conceptual difficulties in understanding the nature of goodwill and because courts fail to understand how to value this goodwill. The essay presents a principled approach …

Pollard Case Is One For The Legal Books, Kenneth Lasson
Pollard Case Is One For The Legal Books, Kenneth Lasson
All Faculty Scholarship
Jonathan Pollard, the former Navy intelligence analyst who was convicted of passing classified information to Israel, has been behind bars for more than 12 years now. His life sentence - by far the harshest ever meted out for a similar offense - continues to make "equal justice under law" seem like little more than a palsied proverb.
Pollard's actions were clearly misguided and rightly punishable, but should he languish for life in prison while others obviously more perfidious have been set free? Americans who expect fairness in their judicial system should be sorely disillusioned at how grossly disproportionate Pollard's treatment …
