Open To Merit Of Every Description? An Historical Assessment Of The Constitution's Qualifications Clauses, John C. Eastman

In U.S. Term Limits, Inc. v. Thornton, the Supreme Court, by a split 5-4 decision, invalidated an Arkansas term limits provision because it effectively imposed a qualification for office and, according to the Court's reading of the historical and textual evidence,. . .neither Congress nor the States . . . possess the power to supplement the exclusive qualifications set forth in the text of the Constitution. The Court relied heavily on the historical assessment made previously by the court in Powell v. McCormack. This essay looks at the frustrations and challenges facing a pluralistic society in the context of general liberal institutions, such as democracy, the market and the rules and regulations that underwrite personal autonomy. It is the author’s opinion that the principal challenge to such a pluralistic society, a society which owes its origin to liberal institutions, is a personal one and is related to the many life styles that are made possible in such a society. Mismanagement And Misinterpretation: U.S. Judicial Implementation Of The Warsaw Convention In Air Disaster Litigation, Perry S. Bechky

This article explores the implementation of the Warsaw Convention in international air disaster lawsuits in U.S. courts, including their approach to mass tort management and treaty interpretation. Specifically, the article evaluates the Warsaw Convention cases according to the rules of treaty interpretation codified in the Vienna Convention on the Law of Treaties and a test for mass tort management developed by Judge Jack Weinstein.
