The Davis-Bacon Act: Cost Impact On The Air Force, Raymond Carpenter Sep 1992

The Davis-Bacon Act: Cost Impact On The Air Force, Raymond Carpenter

Theses and Dissertations

This study was performed to determine what cost impact, if any, the Davis-Bacon Act has on the cost of Air Force construction contracts. The Davis- Bacon Act is a federal labor statute requiring the payment of pre-established wages to workers employed under Federally funded construction projects. The research found that contract award prices could be approximately 22% lower if the payment of these wages were not required. This estimate was made based on the results of a survey of bidders competing for award of construction contracts issued by bases within the former Strategic Air Command. Additional findings and survey response …

State-Interest Analysis And The Channelling Function In Family Law, Carl E. Schneider Sep 1992

State-Interest Analysis And The Channelling Function In Family Law, Carl E. Schneider

Articles

I want to develop some themes I advanced in my article entitled State-Interest Analysis in Fourteenth Amendment "Privacy" Law: An Essay on the Constitutionalization of Social issues. In that article I noted that while courts and commentators have lavished effort on the fundamental-rights side of privacy law, they have scanted the state-interest side, thereby producing crucial weaknesses in that law. I felt that state~interest discussions in privacy cases often seemed to me unsatisfying. This is an attempt to see why. A major difficulty is that states tend to advance and courts tend to accept quite narrow specifications of a statute's …

The Georgia Jury And Negligence: The View From The (Federal) Bench, R. Perry Sentell Jr. Sep 1992

The Georgia Jury And Negligence: The View From The (Federal) Bench, R. Perry Sentell Jr.

Scholarly Works

This is the second part of a two-part inquiry into the quality of jury performance in Georgia negligence cases. Evaluation begins from within. That is an especially prominent truth in respect to the trial of negligence cases. The lay-professional partnership composing the civil trial system is unique. the professional's continuity provides a point of perfect perspective on the transient lay component--both its capacity and its performance. If the professional will share that perspective, it can structure a benchmark for foundational appraisal. To their great credit, the state and federal trial judges of Georgia are unstinting in assisting to construct that …

Subject: Object, Jeanne L. Schroeder

Articles

The article explores the concept of objectivity in legal theory, examining its complexity and the various ways it is defined and applied. It critiques the left's tendency to associate objectivity with liberalism and masculinity, while highlighting the right's defense of subjectivity. The analysis emphasizes the need for a nuanced understanding of objectivity's forms and implications in legal discourse.

Dear Wendy,

Thanks for sending me the recent pair of articles. I just had a chance to read them today while I'm getting my furnace and AC replaced. I enjoyed them very much, both for the chance to think about copyright issues and to read yet again your creative and insightful approach to them.

The most intriguing thing about the Dayton piece was the asymmetric mar- ket failure idea. (I'll come back to the prisoners' dilemma in connection with the LCP paper!) Your point that justifying copyright requires the belief that intellectual property markets won't work without copyright and that …

Blackmail And Moralisms: Victimhood And Aristotelian Pride - 1992, Wendy J. Gordon Aug 1992

Blackmail And Moralisms: Victimhood And Aristotelian Pride - 1992, Wendy J. Gordon

Scholarship Chronologically

Of those persons who favor laws against blackmail, many take that position because of the moral nastiness of the blackmailing act ("pay me or I'll tell ...") These commentators are sometimes blind to where the self-interest of the so-called victim lies, for the victim often prefers paying for silence to having his secrets revealed. Much of the sophisticated literature on blackmail focuses on this gap in vision. Blackmail is called paradoxical because (among other things) it is a crime that a victim would often rather suffer than have discovered and prosecuted.

Blackmail And Transactional Structure - 1992, Wendy J. Gordon

The Coase Theorem operates in a world where mistaken allocations can be cured by trade. But blackmail involves two areas where mistaken allocations are likely to be permanent: free speech and reputation.
