Iraq's invasion of Kuwait on August 2, 1990 set in motion a chain of events that would change the world community. In the United States, this unprovoked aggression resulted in the activation of hundreds of thousands of military reserves and National Guard personnel in response to the Iraqi's "naked aggression." As the reservists prepared to enter active military service, a fifty year old law, enacted to protect servicemembers and those making the transition between civilian and military life, rose from obscurity like a phoenix. Surprise and voluminous inquiry erupted, as a new generation of servicemembers and businessmen were introduced to …
Application Of Selected American Laws To United States Companies Transacting Business In Kuwait: Foreign Corrupt Practices Act And Antiboycott Legislation, S. Gregory Joy
Mercer Law Review
American businesses and their subsidiaries working in Kuwait or pursuing business opportunities in that country need not be reminded that they must comply with Kuwaiti business laws and regulations. They will not be transacting business in Kuwait for very long if they do not comply with Kuwaiti law. Equally important are American laws regulating the transaction of business by American companies and their subsidiaries outside the United States. Two of the most important American statutes of concern to Americans transacting business outside the United States are the Foreign Corrupt Practices Act of 1977 ("FCPA"), as amended, and the antiboycott provisions …
Contracting In Postwar Kuwait, Paul F. Wellborn Iii
Contracting In Postwar Kuwait, Paul F. Wellborn Iii
Mercer Law Review
Many of the normal rules governing Government of Kuwait ("GOK") procurements were waived in the initial phases of postwar recovery. Contracts were awarded to large firms on a cost-plus basis and certain agency requirements were waived. It is unclear how long this policy will continue in the various areas of Kuwaiti procurement. The bulk of the postwar procurement policy is likely to closely resemble the pre-war contracting procedures discussed below.

Conscientious Objection In An All-Volunteer Military: An Impermissible Accommodation Of Religious Freedom?, Mary P. Sullivan
Mercer Law Review
The War and National Defense Selective Service Act and its accompanying regulations are the focus of a renewed debate concerning the validity of allowing active-duty service personnel to separate from the services on the grounds of conscientious objection to war. In the past, constitutional analysis of conscientious objection challenges focused on the Free Exercise Clause of the First Amendment. The underlying premise of this analysis was that the government lacked authority to compel a citizen to -act against his conscience by compelling military service. Central to the "analysis was the ability of the government to compel a citizen to "provide …
Some Lesson About The Law From Self-Referential Problems In Mathematics, John M. Rogers, Robert E. Molzon
Some Lesson About The Law From Self-Referential Problems In Mathematics, John M. Rogers, Robert E. Molzon
Michigan Law Review
We first describe briefly mathematician Kurt Gödel's brilliant Incompleteness Theorem of 1931, and explore some of its general implications. We then attempt to draw a parallel between axiomatic systems of number theory (or of logic in general) and systems of law, and defend the analogy against anticipated objections. Finally, we reach two types of conclusions. First, failure to distinguish between language and metalanguage in mathematical self-referential problems leads to fallacies that are highly analogous to certain legal fallacies. Second, and perhaps more significantly, Gödel's theorem strongly suggests that it is impossible to create a legal system that is "complete" in …
Legislative Inputs And Gender-Based Discrimination In The Burger Court, Earl M. Maltz
Legislative Inputs And Gender-Based Discrimination In The Burger Court, Earl M. Maltz
Michigan Law Review
In An Interpretive History of Modem Equal Protection, Michael Klarman poses a powerful challenge to the conventional wisdom regarding the structure of Burger Court jurisprudence. Most commentators have concluded that during the Burger era the Court lacked a coherent vision of constitutional law, and was given to a "rootless" activism or a "pragmatic" approach to constitutional analysis. Klarman argues that, at least in the area of equal protection analysis, the Burger Court's approach did reflect a unifying theme, which he describes as a focus on "legislative inputs." According to Klarman, this approach "directs judicial review towards purging legislative decision-making of …
