The Eichmann Trial, The Jewish Question, And The American-Jewish Intelligentsia, Pnina Lahav May 1992

The Eichmann Trial, The Jewish Question, And The American-Jewish Intelligentsia, Pnina Lahav

Faculty Scholarship

The abduction, trial, and execution of Adolf Karl Eichmann by the state of Israel, fifteen years after the shutdown of the crematoria at Auschwitz, challenged the American Jewish intelligentsia to confront the Jewish question.4 What does it mean to be a Jew in America and who is an American Jew? Is the Jewish history of anti-Semitism and the Holocaust also a part of American-Jewish history? Is there a lesson in the destruction of European Jewry-the triumph of anti-Semitism, the failure of assimilation-relevant to American Jews? Is there a national component to being Jewish? Are Jews a people? If so, is …

Talking About Rights, Carl E. Schneider May 1992

Talking About Rights, Carl E. Schneider

Reviews

In recent years, a growing recognition of the power of rights talk in American law and life has surfaced in the writing of legal academics, along with a gnawing doubt about that power. In Rights Talk The lmpaverishrnent of Political Discaurse, Mary Ann Glendon, a professor of law at Harvard University, gives those doubts systematic, thoughtful, and lucid expression. Glendon has long been one of our most penetrating students of family law and one of our most enlightening students of comparative law. In this book (as in its predecessor and forebear, Abartion and Divorce in We5tem Law), she brings this …

Competition Among Municipalities As A Constraint On Land Use Exactions, Stewart E. Sterk May 1992

Competition Among Municipalities As A Constraint On Land Use Exactions, Stewart E. Sterk

Articles

The article examines the limitations of competition among municipalities in constraining the abuse of land use exactions and impact fees, arguing that while competition provides some checks, it is insufficient to prevent distortions in land markets. It critiques the Tiebout hypothesis, which assumes that intermunicipal competition leads to efficient allocation of public goods, and highlights how monopoly power in certain land uses undermines this theory. The analysis emphasizes the need for legal constraints to address the exploitation of landowners and ensure exactions align with the external costs of development.

Charles Handbook On Assessment Of Damages In Personal Injury Cases, Roger Harris May 1992

Charles Handbook On Assessment Of Damages In Personal Injury Cases, Roger Harris

Dalhousie Law Journal

This is the second edition of Professor Charles' aptly titled Handbook. The first edition was a simple reprint of a thirty-three page article that was originally published in the Canadian Cases on the Law of Torts, together with the 1978 Supreme Court "Trilogy"judgements themselves. While it provided a convenient capsulization of the issues, it clearly lacked the depth necessary to deal fully with many of the complexities involved, and the rationale for its publication was questionable (no matter how eminent its author or handsome its presentation, can any case comment really be worth $40.00?). Happily, the second edition has developed …

The Aids Blood-Transfusion Cases: A Legal And Economic Analysis Of Liability, Ross D. Eckert May 1992

The Aids Blood-Transfusion Cases: A Legal And Economic Analysis Of Liability, Ross D. Eckert

San Diego Law Review

Through 1991 over 4,000 persons contracted AIDS through transfusion. Statutes in forty-nine states exempt blood banks from strict liability, and the usual negligence rule is weak. Analyzing the medical literature, regulation, and case law, Eckert argues that blood bankers have superior information for reducing risk and that stronger liability rules should be reconsidered. He finds that industry-wide standards of care often emerge from agreements among the three associations of blood banks, and that joint liability for blood banks should be considered. The Article concludes that blood banks should be subject to strict liability in tort, and Eckert discusses the effects …

Flying The Warsaw Convention's Not-So-Friendly Skies: Should Air Carriers' Wilful Misconduct Go Unpunished, Thomas P. O'Brien May 1992

Flying The Warsaw Convention's Not-So-Friendly Skies: Should Air Carriers' Wilful Misconduct Go Unpunished, Thomas P. O'Brien

San Diego Law Review

This Comment examines the possibility of awarding punitive damages for wilful misconduct of an air carrier resulting in passengers injured or killed during an international air flight. The Warsaw Convention is the governing law regarding the rights and liabilities of passengers and cargo involved in international air travel. It is silent on this issue, which has led to a variety of United States judicial decisions regarding the availability of punitive damages, which in turn has caused a split of authority on the issue. A review of United States judicial decisions regarding this issue is provided, along with an examination of …

The Need For An International Criminal Court In The New International World Order, M. Cherif Bassiouni, Christopher L. Blakesley May 1992

The Need For An International Criminal Court In The New International World Order, M. Cherif Bassiouni, Christopher L. Blakesley

Vanderbilt Journal of Transnational Law

In this Article, Professors Bassiouni and Blakesley argue that the institution of an international criminal court would provide an effective means of dealing with international problems that are created by or unaddressed in a unilateral or bilateral international system. Rather than deflecting domestic concentration on law enforcement, the proposed tribunal will be a complementary and incremental effort, which will enhance criminal justice enforcement. The authors address several questions concerning the implementation of the tribunal, including questions related to sovereignty and bases for jurisdiction, which crimes will be within the court's jurisdiction, which law will apply to the cases, and practical …
