In the Blackfeet Tribal Court of Appeals concerning the determination of the best interests of children when deciding custody, the Appellate court remanded the case back to trial court because the children were not afforded the opportunity to have their best interests represented in court so the decision to determine their custody could be made. Child custody cases are not civil matters where failure to appear by one party results in default judgement. Failure of counsel to appear for one parent cannot undermine the rights of the children. If counsel could not appear, the court should have designated an …
The Eleventh Circuit Court Of Appeals—The First Ten Years, John C. Godbold
The Eleventh Circuit Court Of Appeals—The First Ten Years, John C. Godbold
Mercer Law Review
A court is many components. It is a highly structured and formalized institution. It is judges and staff and the internal relationships between them.
A court has history and traditions. It has accomplishments and sometimes disappointments. The court referees, decides, and guides. At its best it performs those tasks successfully and engenders confidence and respect in its work. When it does these things it imparts stability to the world around it.
We look at some of these components of the Eleventh Circuit after its first decade. This is not an in-depth examination of decisions of the Eleventh Circuit, which are …

Administrative Law, J. Michael Davis
Administrative Law, J. Michael Davis
Mercer Law Review
The Eleventh Circuit's 1991 administrative law decisions ran the full gamut of administrative issues and included decisions relating to both state and federal administrative agencies. While the majority of the decisions dealt with straightforward application of accepted principles of administrative law, several decisions included complex fact patterns and the application of both federal and state administrative procedures. The resulting decisions were balanced in terms of their treatment of the agencies and parties appearing before those agencies.
Employment Discrimination, John F. Dickinson, F. Damon Kitchen
Employment Discrimination, John F. Dickinson, F. Damon Kitchen
Mercer Law Review
Two trends in the area of employment discrimination law continued during the 1991 survey period. First, there was a continuation of an overall decrease in the number of cases decided. Second, there was a continuation of the trend toward an increased number of age discrimination claims. The overall decline in the number of cases will most likely change dramatically as a result of passage of the Civil Rights Act of 1991. Nevertheless, both the United States Court of Appeals for the Eleventh Circuit and the United States Supreme Court handed down a number of important decisions addressing a variety of …

Constitutional Law—Civil, Albert Sidney Johnson, Susan Cole Mullis
Mercer Law Review
During the 1991 survey period, the United States Court of Appeals for the Eleventh Circuit continued to struggle with the application of the qualified immunity defense in civil rights actions. Although the court failed to resolve the intracircuit conflict on this issue, the court's opinions did solidify its various approaches to application of the doctrine.
On substantive issues, the court was asked to clarify the constitutionality of governmental action on the controversial issue of AIDS, in both the public employment and custodial contexts. In four cases involving minority set aside and affirmative action programs, the court reinforced standing requirements to …

Between A Rock And A Hard Place In Illinois: Constitutional Responses To Adverse Waste Facility Siting Decisions, Tara Fetherling
Between A Rock And A Hard Place In Illinois: Constitutional Responses To Adverse Waste Facility Siting Decisions, Tara Fetherling
Northern Illinois University Law Review
The author undertakes a critical review of the role of public participation in the Illinois waste facility siting statute, concluding that the statute, as currently written, interpreted and implemented supplies only one demonstrable criterion from which county boards make siting decisions--public opposition. Recognizing that appeals from local siting denials are seldom fruitful for waste management developers, the author explores two constitutional responses to the Illinois siting scheme. First the author provides statutory and regulatory bases for application of preemption doctrine and further demonstrates that a basis for preemption of the Illinois statute may be forthcoming as Congress recognizes waste capacity …
The Commodification Of "Nature's Metropolis": The Historical Context Of Illinois' Unique Zoning Standards, Fred P. Bosselman
The Commodification Of "Nature's Metropolis": The Historical Context Of Illinois' Unique Zoning Standards, Fred P. Bosselman
Northern Illinois University Law Review
Professor Bosselman takes an historical look at the early development of zoning in Chicago and concludes that the nineteenth century view of land as simply another form of capital that could be rendered standardized and fungible through commodification led to the adoption of the LaSalle factors. The author notes the influence of the human ecology theory of urban growth on the development of the LaSalle Bank standards and calls both for a reexamination of the theoretical foundations for the standards and for recognition that a theory based upon nineteenth century life may not accommodate the ecological realities of modern life.

The Public Trust Doctrine And Coastal Zone Management In Washington State, Ralph W. Johnson, Craighton Goeppele, David Jansen, Rachael Paschal
Articles
The public trust doctrine is an ancient doctrine that has recently emerged as a powerful tool to protect the public interest in tidelands and shorelands. Created and developed by the judiciary, the doctrine's principles have found their way into several of Washington's regulatory statutes, such as the Shoreline Management Act and the Aquatic Lands Act. This Article traces the development of the doctrine in Washington, and explains the relation between the state's police power and the public trust doctrine. This Article also sets forth the current contours of the public trust doctrine in Washington, and charts potential future developments of …
Leaving Your Speech Rights At The Bar—Gentile V. State Bar, 111 S. Ct. 2720 (1991), Lester Porter Jr.
Leaving Your Speech Rights At The Bar—Gentile V. State Bar, 111 S. Ct. 2720 (1991), Lester Porter Jr.
Washington Law Review
In Gentile v. State Bar the Supreme Court voided an attorney disciplinary rule regulating trial publicity for vagueness. The Court, however, upheld the substantive standard employed by the rule to identify dangerous speech. This standard restricts more attorney comments to the media than the Court has allowed for the press or public. This Note argues that the standard upheld in Gentile fails First Amendment scrutiny and proposes a response for states reviewing their professional disciplinary rules in light of Gentile. Adoption of this proposal will mitigate the danger of prejudicial trial publicity while recognizing the benefits of attorney publicity.
