Environmental Law and Justice Clinic

Founded in 1994, the Environmental Law and Justice Clinic serves the dual mission of training law students to be effective and ethical advocates and assisting low-income communities and communities of color to reduce the disparities of pollution. The clinic is staffed by ten to twelve law students, two full-time professors, a part-time staff scientist, and a Graduate Fellow. The State Bar certifies the law students to perform lawyerly tasks under the supervision of their professors.

The clinic’s 2011 work focused primarily on reducing the disparities of air pollution. This Fall 2011 report highlights some of the clinic’s work and accomplishments …

Environmental justice advocates have long been concerned about the health impact of elevated air pollution levels found in disadvantaged communities across the country. Sustained public pressure on this issue has motivated regulators to initiate a variety of programs to better characterize the combined or “cumulative” air pollution exposure in localities with multiple pollution sources. In the last decade, local and state agencies have completed a number of relevant San Francisco Bay Area studies and the results are now being used to develop new pollution control policies. The concept of non-regression is not one that is familiar to environmental law in the United States. Nevertheless, Congress and federal agencies have adopted programs to prevent degradation of existing high quality environments and to prevent revisions of individual emissions restrictions by making them more lenient. The first programs are known as nondegradation or anti-degradation programs. The others preclude “backsliding” by prohibiting slippage in performance by regulated entities complying with regulations that are later loosened. This chapter explores the history and current status of nondegradation and anti-backsliding programs under U.S. water and air pollution control legislation. It describes the justifications …

Bruce Finley's article lauded trees for absorbing smog. Trees also mitigate CO2 emissions. But not all trees are equally beneficial: some species emit more volatile organic compounds than they absorb. In urban environments, we need more restrictions to avoid negative impacts on those around us: e.g., wood burning or watering restrictions. Sunlight plays an increasing role in energy solutions - for solar energy and urban gardens. Trees that mature at over 70 feet can create shade pollution for neighbors up to three lots away. Inhaling air pollutants can lead to a variety of adverse respiratory and cardiovascular health effects. This potential risk for health impacts is likely greater when the mixture of pollutants that exists in ambient air, rather than isolated pollutants, are inhaled. Despite the evidence of potential cumulative impacts, EPA has continued to focus its analysis of health impacts on isolated pollutants instead of the actual mixture we breathe. This article proposes that EPA should evaluate and consider cumulative health impacts when it sets national ambient air quality standards under the Clean Air Act. Coal-Fired Powerplants Dominate Climate Change Litigation, Michael B. Gerrard

Litigation aiming to reduce emissions of greenhouse gases (GHGs) is coming to be dominated by battles over coal-fired power plants. Ten of the last 20 judicial or administrative decisions or case filings in matters aiming to reduce GHGs have concerned such plants. A concerted effort by the environmental community to fight the use of coal is behind much of this litigation. According to the Energy Information Administration, the combustion of coal is the largest source of GHG emissions in the United States; motor vehicles are a not-very-close second.

This book chapter reviews United States efforts to comply with Agenda 21's prescriptions germane to air quality over the last five years and to meet the goals in the Rio Declaration. It concludes that the United States has improved air quality over the last five years, but that the United States has failed to meet the ambitious goals suggested by the Rio Declaration. The paper recommends that the United States move toward a phaseout of fossil fuels, better support advanced technology, and improve monitoring and enforcement.

Part II of this Note provides an overview of how the regulatory framework has developed with regard to federal control technology requirements governing major stationary sources. It focuses on the statutory language of the 1970 Clean Air Act and the 1977 Clean Air Act Amendments and subsequent administrative and judicial interpretations. Part III examines the development of the land-use doctrine governing the regulation of preexisting nonconforming uses and highlights its theoretical similarities to the air pollution context. Part IV looks specifically at the jurisprudence surrounding the use of amortization provisions in the zoning context. By and large, a court's acceptance …

I argue that the public has a current and continuing interest in the air resource. This commonly held interest requires that where the government has sanctioned the private trading of this asset the government must account for the profits of such trades. In short, it is not the government's property to give away. Ancillary benefits associated with cleaner air do not offset the public's interest in the value of the resource, especially where the regulatory scheme has effectively precluded private action in defense of the resource. The environmental assessment process established by NEPA has been a success and was a step forward on the path of integrating environmental and economic policy. The national pollution abatement laws that were adopted in the decade after NEPA, however, operate in a very different fashion. My title, but nothing else, owes to Anthony Burgess.' I like the ambiguity of Burgess's words. They could be a play on what an anchor says when she brings the night's news of the world to a close ("and that's the end of.. ."), or they could be the name of a doomsday periodical, or a headline announcing the bankruptcy of a tabloid, or, at the extreme, a reference to the end of the world. For my purposes, however, they signify the end of an era.

In March 1993, the EPA auctioned off 150,010 sulfer dioxide emissions permits at the Chicago Board of Trade. The auction brought in $21.4 million and ushered in the Clean Air Act's market-based approach to sulfur dioxide control. Congress created these marketable pollution allowances (MPAs) under Title IV of the Clean Air Act Amendments of 19903 to regulate acid rain pollution. While most MPAs were bought by utilities, to be exchanged as a commodity according to need, some MPAs were removed from the market solely to prevent their use by polluters.
