Two versions of the draft Bycatch Action Plan for the Shark Bay Prawn Managed Fishery have been released for public comment. The ‘Full Report’ (this document - Fisheries Management Paper No. 147) is a comprehensive version of the plan containing detailed rationale and justification for the objectives and actions proposed in the plan. The Full Report also provides detailed background information regarding issues such as the natural environment in Shark Bay, current management arrangements within the prawn fishery and existing information on bycatch. A Risk/Cost Framework For Logistics Policy Evaluation: Hazardous Waste Management, Kimberly Hollister

The management of hazardous waste disposal operations is extremely complex involving a multitude of environmental, engineering, economic, social and political concerns. This article proposes a framework to assist policy makers in the evaluation of logistic policies. A spatial general equilibrium based policy evaluation model is developed to calculate risk, cost, and risk equity tradeoff curves. This framework provides policy makers a tool with which they can relate resulting logistics patterns and their associated risk, cost, and equity attributes to original policy goals.

Juries, Judges, And Punitive Damages: An Empirical Study, Theodore Eisenberg, Neil Lafountain, Brian Ostrom, David Rottman, Martin T. Wells

This Article, the first broad-based analysis of punitive damages in judge-tried cases, compares judge and jury performance in awarding punitive damages and in setting their levels. Data covering one year of judge and jury trial outcomes from forty-five of the nation's largest counties yield no substantial evidence that judges and juries differ in the rate at which they award punitive damages or in the central relation between the size of punitive awards and compensatory awards. The purpose of this ESD policy is to outline a way forward by showing in a practical manner: • how the ESD principles will be interpreted and applied within the fisheries context generally and within the Department of Fisheries specifically, • the conceptual framework that will be used to assess performance against ESD principles, • the methods for reporting on and auditing this performance, and • how these principles and the framework relate to other relevant state, national and international treaties and instruments.

The question of how societies secure cooperation and order in the absence of state enforced sanctions has long vexed law and economics scholars. Recently the concept of social norms--informally enforced rules of behavior--has occupied the attention of a large number of these theorists, who are concerned with understanding why economically rational actors would bother to follow rules whose costs seem to outweigh their benefits. On Legal Interpretations Of The Condorcet Jury Theorem, Paul H. Edelman

There has been a spate of interest in the application of the Condorcet Jury Theorem to issues in the law. This theorem holds that a majority vote among a suitably large body of voters, all of whom are more likely than not to vote correctly, will almost surely result in the correct outcome. Its uses have ranged from estimating the correct size of juries to justifying the voting of creditors in Chapter 11 reorganizations.
