Defendant-Intervenor Bernalillo County, New Mexico adopts this cross-motion in support of the Federal Defendants' Cross-motion for Summary Judgment and Memorandum in Support (filed June 27, 1997). As set out in the Federal Defendants Memorandum in Support, the administrative record demonstrates that Secretary Hodel's decision not to grant the Pueblo's claim was fully supported by the record and was neither arbitrary nor capricious, and that Secretary Babbitt's inaction on the Pueblo's claim does not constitute reviewable final agency action and/or was not arbitrary and capricious.

Further, Defendant Bernalillo County moves the Court to grant it summary judgment on the same grounds on which it opposes Plaintiff's Summary Judgment Motion.

The purposes of this report are threefold: (1) to analyze the boundaries of the Pueblo of Sandia, as articulated and interpreted by Spanish, Mexican and U.S. Territorial authorities from the establishment of Sandia Pueblo in 1748 until the marking of the boundaries by the Office of Surveyor General in 1860; (2) to define the term, sierra madre in its proper historical context; and (3) to ascertain whether in 1748 Sandia Pueblo was populated by descendants of the original Sandia Pueblo people who had migrated to the Hopi country after the Pueblo Revolt of 1680, or, on the other hand, the …

"'The Pueblo claims that approximately 10,000 acres of land were incorrectly excluded from a patent issued to the Pueblo by the United States in 1864 because the surveyor erred in not including all of the land originally granted the Pueblo by the Spanish in 1748. The major portion of the land claimed is managed by the United States Forest Service as parts of the Cibola National Forest and the Sandia Mountain Wilderness. The land at issue is on the outskirts of Albuquerque, New Mexico, and is within the Sandia Mountain Wilderness. The major portion is owned by the United States Forest Service, with approximately 1151.2 acres in private holdings, and the Juan Tabo Recreation Area. The Pueblo has indicated willingness to waive any claim to the existing private inholdings. After thorough review of the matter, we have concluded that the survey appears to accurately depict the description of the boundary as set forth in the patent. Sandia Pueblo is an Indian community located approximaaiy 13 miles north of Albuquerque, New Mexico on the east bank of the Rio Grande river, a few miles to the west of the Sandia Mountains. Archaeological evidence shows that the village site was occupied around 1300 A.D. and that the village has remained in essentially the same area since then. The surrounding area was occupied by Indian hunters as early as 11,000 years ago and there is evidence of numerous smaller sites around Sandia and in the foothills of the mountain dating in the last millenia. This memorandum confirms the receipt of the January 1983 report of Ward Alan Minge. The report refers to issues and encroachments regarding the eastern boundary area of Sandia Pueblo. The basic conclusion of Dr. Minge's report is that the Sandia Pueblo Grant, as surveyed under the auspices of the United States in 1859, was of such a nature as to deviate from the Spanish grant documents.
