Crime, War & Romanticism: Arthur Andersen And The Nature Of Entity Guilt, David N. Cassuto

In 2002, Arthur Andersen, LLP stood trial for obstruction of justice. The prosecution offered several theories as to who at the firm had committed the crime but no one theory satisfied all twelve jurors. In an attempt to break its deadlock, the jury asked whether it could convict i f some jurors thought Person A at Andersen had done it and some thought it was Person B. Following argument, the judge ruled that it could convict. This article argues that the court's response to the jury's query was wrong as a matter of law and policy. The ruling misconstrues the …

Late last year, IEEE SSIT was invited to put together a paper for the centennial edition of Proceedings of the IEEE that was published in May 2012. The paper titled, “Social Implications of Technology: The Past, the Present, and the Future,” brought together five members of SSIT with varying backgrounds, and two intense months of collaboration and exchange of ideas. I personally felt privileged to be working with Karl D. Stephan, Emily Anesta, Laura Jacobs and M.G. Michael on this project.

In January 2010, the IRS published its Return Preparer Review Final Report, recommending extensive increases in oversight of the tax return preparer industry. The IRS suggests achieving these increases in oversight through numerous measures, including preparer registration, competency testing, continuing professional education, ethical standards, and enforcement. Effective August, 2011, new paid preparer regulation requires all tax return preparers who offer their services for a fee to register and obtain a unique Preparer Tax Identification Number (PTIN) that must be used to sign all returns they prepare. The adoption of mobile technologies for emergency management has the capacity to save lives. In Australia in February 2009, the Victorian Bushfires claimed 173 lives, the worst peace-time disaster in the nation’s history. The Australian government responded swiftly to the tragedy by going to tender for mobile applications that could be used during emergencies, such as mobile alerts and location services. Misdemeanor convictions are typically dismissed as low-level events that do not deserve the attention or due process accorded to felonies.  And yet with ten million petty cases filed every year, the vast majority of U.S. convictions are misdemeanors.  In comparison to felony adjudication, misdemeanor processing is largely informal and deregulated, characterized by high-volume arrests, weak prosecutorial screening, an impoverished defense bar, and high plea rates.  Together, these engines generate convictions in bulk, often without meaningful scrutiny of whether those convictions are supported by evidence.  Indeed, innocent misdemeanants routinely plead guilty to get out of jail because they cannot afford bail.  …

This dissertation seeks to understand the extent to which community-level or organizational-level factors are related to the level of racial disparity in traffic enforcement in Massachusetts. Prior research has demonstrated that racial disparities exist in the ways traffic laws are enforced in Massachusetts and in many other communities across the United States. Little research, however, has focused on what factors may be associated with these disparities. Two theoretical frameworks suggest potential explanations for the disparities that have been identified: racial-threat theory and police-organizational theory. LBSN is the convergence between location based services (LBS) and online social networking (OSN). This paper unpacks the slippery slope argument as it pertains to assisted death. The assisted-death regimes of the Netherlands, Belgium, Luxembourg, Switzerland, and the states of Washington and Oregon are discussed and examined with respect to the slippery slope analytical rubric. In addition to providing a preliminary explanation of how the slippery slope argument has been academically defined and constructed, the paper examines assisted-death models from the perspective of considering what might exist at the top and at the bottom of the slippery slope.
