Crime, War & Romanticism: Arthur Andersen And The Nature Of Entity Guilt, David N. Cassuto
Crime, War & Romanticism: Arthur Andersen And The Nature Of Entity Guilt, David N. Cassuto
David N Cassuto
In 2002, Arthur Andersen, LLP stood trial for obstruction of justice. The prosecution offered several theories as to who at the firm had committed the crime but no one theory satisfied all twelve jurors. In an attempt to break its deadlock, the jury asked whether it could convict i f some jurors thought Person A at Andersen had done it and some thought it was Person B. Following argument, the judge ruled that it could convict. This article argues that the court's response to the jury's query was wrong as a matter of law and policy. The ruling misconstrues the …

Ecos Do Ipiranga. Autonomia, Cidadania E Justiça No Brasil, Paulo Ferreira Da Cunha

Late last year, IEEE SSIT was invited to put together a paper for the centennial edition of Proceedings of the IEEE that was published in May 2012. The paper titled, “Social Implications of Technology: The Past, the Present, and the Future,” brought together five members of SSIT with varying backgrounds, and two intense months of collaboration and exchange of ideas. I personally felt privileged to be working with Karl D. Stephan, Emily Anesta, Laura Jacobs and M.G. Michael on this project.
Book Review: Handbook On Securing Cyber-Physical Critical Infrastructure: Foundations And Challenges (Written By Sajal K. Das, Krishna Kant, Nan Zhang), Katina Michael
Professor Katina Michael
This 800+ page handbook is divided into eight parts and contains thirty chapters, ideal for either an advanced undergraduate or graduate course in security. At the heart of this handbook is how we might go about managing both physical and cyber infrastructures, as they continue to become embedded and enmeshed, through advanced control systems, and new computing and communications paradigms.
Paradigmas Jurídicos Do Ter, Paulo Ferreira Da Cunha
Paradigmas Jurídicos Do Ter, Paulo Ferreira Da Cunha

In January 2010, the IRS published its Return Preparer Review Final Report, recommending extensive increases in oversight of the tax return preparer industry. The IRS suggests achieving these increases in oversight through numerous measures, including preparer registration, competency testing, continuing professional education, ethical standards, and enforcement. Effective August, 2011, new paid preparer regulation requires all tax return preparers who offer their services for a fee to register and obtain a unique Preparer Tax Identification Number (PTIN) that must be used to sign all returns they prepare. Given that additional preparer regulation is expected to come into effect within the next …
Contract And Dispossession, Deborah W. Post
Contract And Dispossession, Deborah W. Post
Deborah W. Post
This Essay, part of a collection of essays on the same theme, argues that contract law has become an instrument of oppression and dispossession rather than liberation. Having offered a critique, the challenge then is to consider whether it is possible to restore the liberatory potential of contract. The symposium, Post-Marxism, Post-Racialism & Other Fables of the Dispossession, was an invitation to consider the contemporary relevance of Marxist theory. There are two reference points in this cultural critique. One is the importance of social position in a jurisprudence that embraces objectivity; the uncritical and unreflective reliance on hegemonic social practices, …

Towards Determining Legal Parentage By Agreement In Israel, Yehezkel Margalit
Towards Determining Legal Parentage By Agreement In Israel, Yehezkel Margalit
Hezi Margalit
In Israel as in other parts of the world, families, parenthood, and relations between parents and children have changed dramatically over the past few decades. So, too, developments in modern medicine have enhanced the ability to separate sexuality from fertility and parenthood. Many researchers feel that the legal system has not kept pace with these changes, and that traditional models of familial relationships no longer provide adequate tools for dealing with them. In order to bridge the gap between a desired social status and current law, a growing number of parents seek to regulate the status, rights, and obligations of …

The Value Of Government Mandated Location-Based Services In Emergencies In Australia, Anas Aloudat, Katina Michael, Roba Abbas, Mutaz Al-Debei

The adoption of mobile technologies for emergency management has the capacity to save lives. In Australia in February 2009, the Victorian Bushfires claimed 173 lives, the worst peace-time disaster in the nation’s history. The Australian government responded swiftly to the tragedy by going to tender for mobile applications that could be used during emergencies, such as mobile alerts and location services. These applications, which are becoming increasingly accurate with the evolution of positioning techniques, have the ability to deliver personalized information direct to the citizen during crises, complementing traditional broadcasting mediums like television and radio. Indeed governments have a responsibility …

Determining Legal Parenthood By Agreement As A Possible Solution To The Challenges Of The New Era, Yehezkel Margalit

Over the past decades, we witnessed changes in the matrimonial and parenting institutions. Medical innovations have further created ethical-legal dilemmas. It is, therefore, essential to create a theory and framework that will determine ways to deal with the resulting dilemma in a fully developed manner. This paper surveys the current, conflicting shifts in family structure and the definition of legal parenthood. In it, I deal with the importance and various aspects of defining legal parenthood. I will also focus on the singularity of this dilemma as it is increasingly apparent in the various fertility treatments. I present the sociological-legal roots …

Book Review Of Hacking: The Next Generation (Written By Nitesh Dhanjani, Billy Rios & Brett Hardin), Katina Michael
Professor Katina Michael
Hacking: The Next Generation demonstrates just how hackers continue to exploit “back doors”. New ways of working and new ways of communicating have meant that the number of attack vectors continue to rise rapidly. This provides hackers with a greater number of opportunities to penetrate systems using blended approaches while organizations struggle to come up to speed with the latest technology developments and commensurate security capabilities. Dealing with anticipated threats is a lot harder than dealing with known threats.

Cross-Border Aspects Of Litigating In Europe Civil Claims Arising Out Of The Cyprus Problem: Thoughts On The Orams Case (In Greek), Nikitas E. Hatzimihail
Nikitas E Hatzimihail
The European Court of Justice ruling in the Orams v. Apostolides case has served as a landmark in the legal history of the Cyprus problem. It is also of some importance to the evolution of European litigation and the free movement of civil judgments across the EU. This article gives a full story of the case, from its beginnings in the courts of Cyprus to its aftermath in the English Court of Appeals. Its principal argument is that the case should be seen through a triple lens: property rights of the displaced Greek Cypriots, private litigation of public claims and …

Factors Influencing Racial Disparities In Traffic Enforcement In Massachusetts, Jack Mcdevitt
Factors Influencing Racial Disparities In Traffic Enforcement In Massachusetts, Jack Mcdevitt
Jack McDevitt
This dissertation seeks to understand the extent to which community-level or organizational-level factors are related to the level of racial disparity in traffic enforcement in Massachusetts. Prior research has demonstrated that racial disparities exist in the ways traffic laws are enforced in Massachusetts and in many other communities across the United States. Little research, however, has focused on what factors may be associated with these disparities. Two theoretical frameworks suggest potential explanations for the disparities that have been identified: racial-threat theory and police-organizational theory. Racial threat theory suggests that racial characteristics of a community, such as the size of the …

In the recent past, India's economic growth story has attracted world's attention bringing about a new set of challenges such as counterfeits, pass-oflfs and smuggling posing a serious threat to domestic brands and industry. Rapid advancements in information communication and technology are further boosting the growth of such illicit activities. International studies indicate that, by 2015, the total impact of trade in coimterfeits and pirated goods ~ including the value of domestically sold fakes, those traded on the internet and the added costs to society through lost taxes and jobs - will exceed one trillion dollars. All this is; (a) …

Tracking and monitoring people as they operate within their personal networks benefits service providers and their constituents but involves hidden risks and costs.
Automatic identification technologies, CCTV cameras, pervasive and mobile networks, wearable computing, location-based services and social networks have traditionally served distinct purposes. However, we have observed patterns of integration, convergence and coexistence among all these innovations within the information and communication technology industry.1For example, ‘location-based social networking’ can draw on a smart phone's capacity to identify a user uniquely, locate him within 1–2m and share this information across his social network in real time. The resulting ability to …

The Fed’S New Model Of Supervision For “Large Complex Banking Organizations”: Coordinated Risk-Based Supervision Of Financial Multinationals For International Financial Stability, Cynthia C. Lichtenstein
Cynthia C. Lichtenstein
Large internationally active financial institutions, in particular multinational banks, have the capacity to create profound disturbances in the globalized financial markets in the event of failure. For that reason, these entities are supervised and examined in a manner that is completely different than the ordinary business corporation. This piece describes the new methodology that has been developed by the United States' central bank, the Board of Governors of the Federal Reserve System or "the Fed" for short, since 1995, for examining what the Fed calls "large complex banking organizations" or LBCOs and indicates how the system in fact carries out …

Location-Based Social Networking And Its Impact On Trust In Relationships, Sarah Jean Fusco, Roba Abbas, Katina Michael, Anas Aloudat

Location based social networking (LBSN) applications are part of a new suite of social networking tools. LBSN is the convergence between location based services (LBS) and online social networking (OSN). LBSN applications offer users the ability to look up the location of another “friend” remotely using a smart phone, desktop or other device, anytime and anywhere. Users invite their friends to participate in LBSN and there is a process of consent that follows. This paper explores the potential impact of LBSN upon trust in society. It looks at the willingness of individuals to share their location data with family, friends, …

Assisted Death And The Slippery Slope—Finding Clarity Amid Advocacy, Convergence, And Complexity, Mary J. Shariff
Mary J. Shariff
This paper unpacks the slippery slope argument as it pertains to assisted death. The assisted-death regimes of the Netherlands, Belgium, Luxembourg, Switzerland, and the states of Washington and Oregon are discussed and examined with respect to the slippery slope analytical rubric. In addition to providing a preliminary explanation of how the slippery slope argument has been academically defined and constructed, the paper examines assisted-death models from the perspective of considering what might exist at the top and at the bottom of the slippery slope. It also explores the nature and scope of safeguards implemented to avoid slippage, and shows that …

The rapid rise of social media has brought with it an emphasis on the distinct dimensions of the whole person. Social media recognises that the individual has a personal network of extensions- a home life, a work life, a social life, a study life, a hobbyist life, and much more- some of these identities even hidden from full view. Each of these online value networks are now accessible by big business, where opinion leaders and early adopters are easily distinguishable, and where brand commentary between consumers matters manifold more than any form of targeted advertising.

A Crise Económico-Financeira Europeia: Preconceitos E Realidades, Paulo Ferreira Da Cunha
