Civil Images Of Battered Women: The Impact Of Domestic Violence On Child Custody Decisions, Naomi R. Cahn

The purpose of child custody decisions is to develop an arrangement that is in the best interest of the child by awarding the child to one or both natural parents.' The critical factors in determining the child's best interest are those that have a direct impact on the child and the child's relationships. The question of which factors are most relevant to the child's best interest is unsettled,' and the answers that have been developed are "highly contingent social construction[s]." Protecting Battered Women: A Proposal For Comprehensive Domestic Violence Legislation In New York, Lisa R. Beck

This note proposes that New York implement a mandatory arrest policy for certain types of domestic violence. The author first examines New York's current methods of addressing domestic violence, including previous attempts at decriminalization, judicial remedies, and the effectiveness of orders of protection. The author then describes the issues of the current discretionary arrest policy. The note examines domestic violence legislation in other states, then proposes a comprehensive statutory scheme to address domestic violence in New York state.

The police strive to settle the vast majority of wife battering cases without arrest or through mediation, often leading to terrible results for the abused wife. This Note supports holding a city and its police liable under the equal protection clause for the inadequate police protection of battered wives. The Note finds the best legal strategy under the equal protection clause would involve showing impermissible gender-based discrimination.

If gun control were an effective method to reduce the number of guns available in the urban households, then it is quite possible that many family quarrels and other arguments would not end with someone's death. The availability of firearms makes the gun a readily accessible vehicle of violence. If the regulation of this vehicle were more strict, then perhaps this type of domestic violence would be less frequent.
