In these last few years, we have seen public interest in military justice develop far beyond an immediate interest in individual trials or events. Today, we are witnessing the birth and the death of many concepts of justice for the criminal offender in the civilian community and in the armed services as well. The developments in military justice are of particular interest because they represent, in many instances, the concern of society in general for all aspects of criminal law.

Courts-Martial And The Commander, Kenneth J. Hodson

During court-martial, the commander decides on the charge, selects of the jury, and reviews the trial's results. This Article examines these aspects of the military justice system. Currently, the decision to charge is made after the commander's legal advisor reviews the Article 32 investigation. This Article suggests a system where the Article 32 investigation is replaced by a probable cause hearing before a judge. Jury selection, like the decision to charge, is at the commander's discretion, allowing the commander to include and exclude military members. The Article calls for a military judicial system divided into districts from which an independent …

Prosecutorial Discretion: An Overview Of Civilian And Military Characteristics, Robert Emmet Quinn

The military's courts-martial system can be regarded as an integral part of the justice system. This Article compares prosecutorial discretion in the civilian and military justice systems. With respect to all federal crimes, civilian or military, the President controls prosecutorial discretion through the power of his position. Other circumstances, such as money and national security, can also affect prosecutorial discretion in both the civilian and military systems. Prosecutorial discretion in the civilian and military systems differs in capital cases and cases seeking nonjudicial punishment. The author concludes that the military justice system has a greater capability for providing justice in …

Private Trusts For Indefinite Beneficiaries, George E. Palmer

Recently, in McPhail v. Doulton (In re Baden's Deed Trusts), the House of Lords reached a decision that marks an important change in the English law of trusts which could be important also for American law. It held that there is a single test of validity for private trusts and for powers of appointment where the issue is whether the beneficiaries of the trust or the objects of the power are sufficiently definite, and that this single test is that applicable to powers of appointment.
