Market participants are preparing for the tax and trade policies pursued by the second Trump administration. Regarding taxes, proposals include making expiring Tax Cuts and Jobs Act provisions permanent, ending green energy subsidies from the Inflation Reduction Act, and exempting certain income from taxation. Proposed tariffs range from retaliatory measures-in-kind to targeting Chinese market participation to a universal 20% import tariff. On the campaign trail, the President often presented these proposals as part of a shift of financial burdens from domestic taxpayers to foreign companies. In a panel discussion with tax and trade experts, we will seek to determine the …

Lastly, we plan to have an additional panel dedicated to exploring the judicial ideologies of Justice Jackson and Justice Barrett, specifically examining how their theories of constitutional interpretation diverge from other justices.

In the mid-1840s, American settlers flocked westward on the Oregon Trail, unknowingly bringing with them measles and other foreign diseases to which the Cayuse peoples along the trail had no immunity. Hundreds of Cayuse children were brought to Narcissa and Marcus Whitman at the Whitman Mission for treatment, but ultimately these children could not be saved. In 1847, members of the Cayuse Tribe, acting under Cayuse law to dispose of false doctors (medicine men, or tewat), participated in an attack on the Presbyterian Whitman Mission in Walla Walla Washington, killing the Whitmans and eleven others. After a two-year pursuit, the …

i. Introduction This National Report describes the legal framework of domestic and international arbitration in the Bolivarian Republic of Venezuela (“Venezuela”). It includes the most relevant and recent case law, and other important aspects that have shaped the development and use of commercial and investment treaty arbitration in recent times. This Report also discusses the regulation and use of mediation/conciliation given its distinction – alongside arbitration – as a non-judicial form of dispute resolution. The description offered here also considers the social, economic and political context insofar it is relevant to the discussion about arbitration in Venezuela. This Report is …

2025
This book has been designed to help law students learn to write analytically in a straight-forward, simple, yet effective style. I have included text to explain the particular writing concepts and videos that explain concepts clearly. Different modalities can be useful in order to appeal to different learning styles. My hope is to demonstrate that mastering the art of legal writing can positively impact all aspects of law school and all aspects of a legal career.

The Court We Need: Why The Supreme Court Is Worth Saving—Especially From Itself With Professor Steven I. Vladeck, Stephen I. Vladeck
2025 Event Invitations
For all of the ink that has been spilled over the Supreme Court in recent years, no one has been able to bridge the growing divide between those who think we should bury the Court and those who think we should praise it. Meanwhile, public faith in the Court continues to decline. The result has been an erosion of the Court’s moral authority and an impasse about how to restore it at the exact moment when we most need it—with the other institutions of government increasingly unable or unwilling to check each other. Now, more than ever, we need a …

There has never been quite such an attention-getting spree of these directives. Executive orders are not new; every President since George Washington has issued them. But they are often misunderstood. Professor Herz will discuss the history, nature, and effect of executive orders. The two will also answer questions raised by student attendees.

Solving The Public Defense Crisis In Kansas, Malia N. Brink, Pamela R. Metzger
Deason Center Reports
Kansas has a constitutional obligation to provide counsel to any arrested person who cannot afford to hire a private attorney. But attorney shortages in Kansas threaten this core constitutional right. According to the American Bar Association, there are an average of four attorneys per 1,000 people nationwide. However, only six of Kansas’s 105 counties have two or more attorneys per 1,000 people. In 44 counties, there is just one attorney or fewer per 1,000 residents. The situation is particularly worrisome in rural Kansas. In 2023, nearly half of Kansas’s population lived in rural counties, but 80% of its lawyers lived …

Constitutional Freedoms is an undergraduate text for courses in civil rights and liberties. It covers most of the subject areas of other undergraduate texts, although it rearranges some in ways that are more conducive to student learning. The major difference is that freedoms of speech and press are treated together as aspects of communication, rather than separately because so distinguished in the US Constitution. The book includes sections on Supreme Court procedure, methods of interpretation, and tests for unconstitutionality, as well as information about experiential learning opportunities for students.

Voices For Justice: Firsthand Accounts Of Innocent People Fighting For Access In New York’S Post-Conviction Process, Perlmutter Center For Legal Justice At Cardozo Law
Perlmutter Center Reports
In 2018, the New York State Court of Appeals’ decision in People v. Natascha Tiger created an insurmountable obstacle for wrongfully convicted individuals pursuing innocence claims. The ruling held that a guilty plea precluded persons accused of crime from challenging their conviction in the absence of newly discovered, exculpatory DNA evidence. This is a troubling fact given 97% of felony convictions and 99% of misdemeanor convictions in New York State are resolved by guilty plea. The National Registry of Exonerations documented that 24% of all exonerated people across the United States pled guilty to crimes they did not commit. According …
