Legal Translation In A Political Context: The Trick Of Choosing Between Alternatives In Translating Electoral Terms, Zakia Deeb Jan 2021

Legal Translation In A Political Context: The Trick Of Choosing Between Alternatives In Translating Electoral Terms, Zakia Deeb

Abdou Filali-Ansary Occasional Paper Series

Legal electoral terminology is a specialist subject within the broader legal language discourse. When translating into Arabic, even basic electoral terms can be translated differently in different Arab countries for various reasons due to different sources of inspiration. Most legal electoral terms have a variety of alternative equivalents within the relevant linguistic field or semi-legal domain. This paper discusses such alternatives while presenting problems related to the existing resources in the field. Data collected from the 2012 election of members of the Libyan General National Congress are analysed to test the consistency in selecting from these alternatives. Furthermore, material presented …

2021: How Gender And Race Affect Justice Now - Final Report, Justice Sheryl Gordon Mccloud, Dana Raigrodski, Sierra Rotakhina, Kelley Amburgey-Richardson

Books

In 1989, the Washington Supreme Court’s Task Force on Gender and Justice in the Courts produced a groundbreaking report on the impact of gender on selected areas of the law. It concluded that gender did affect the availability of justice. We – the Washington State Supreme Court Gender and Justice Commission – are a product of that report and its recommendations. Now, in 2021, we have completed our follow-up study.

Our legal and social science research, our data collection, and our independent pilot projects all led us to the same frustrating conclusion about the effect of gender in Washington State …

Análisis Crítico Del Perjuicio Fiscal En El Régimen Peruano De Precios De Transferencia, In Tratado De Derecho Tributario Iberoamericano: En Homenaje A: Julio A. Fernández Cartagena (Daniel Yacolca Estares Ed., 2021), Fernando Loayza Jordán Jan 2021

Análisis Crítico Del Perjuicio Fiscal En El Régimen Peruano De Precios De Transferencia, In Tratado De Derecho Tributario Iberoamericano: En Homenaje A: Julio A. Fernández Cartagena (Daniel Yacolca Estares Ed., 2021), Fernando Loayza Jordán

Books and Chapters

Microwaving Dreams? Why There Is No Point In Reheating The Hart-Dworkin Debate For International Law, Jason A. Beckett Jan 2021

Microwaving Dreams? Why There Is No Point In Reheating The Hart-Dworkin Debate For International Law, Jason A. Beckett

Faculty Book Chapters

A critique of attempts to transpose Hart and Dworkin's legal theories to international law. I demonstrate why neither approach can provide insights into international law. Hart and Dworkin are institutional theorists, their methodologies are anchored by the need to justify the exercise of socially centralised violence. International law lacks both institutions and centralised violence, and the stabilising force these bring; it is radically indeterminate. Attempts to suppress this indeterminacy have resulted in international lawyers fragmenting into communities of practice, united by their eschatological faith in the international community. I challenge this faith.

Commentary On Emerson V. Magendantz, Lucinda M. Finley Dec 2020

Commentary On Emerson V. Magendantz, Lucinda M. Finley

Contributions to Books

Published as Chapter 13 of Feminist Judgments: Rewritten Tort Opinions, Martha Chamallas & Lucinda M. Finley, eds. (Cambridge University Press 2020). Emerson v. Magendantz assesses how to measure harm when people get pregnant after a negligently performed sterilization, or have disabled children after genetic counseling or prenatal testing misdiagnosed the risk. The court permitted parents to recover child-rearing costs only for disabled children, reasoning that the emotional benefits of a healthy child invariably outweigh its economic burdens. Critiquing this reasoning as a double insult to the disabled and to the importance of reproductive autonomy, the feminist rewritten opinion uses the …

The essay also identifies a number of difficulties that U.S. courts and enforcers face in challenging harmful exclusionary conduct by dominant platforms, and discusses some ways regulation can supplement antitrust law in fostering competition.

Muslims’ Religious Freedom And Religiosity: Measurement And Impact, Hannah M. Ridge Nov 2020

Muslims’ Religious Freedom And Religiosity: Measurement And Impact, Hannah M. Ridge

Political Science Faculty Books and Book Chapters

Multiple measures of religious freedom and states’ regulation of religion are at work in sociology of religion. These scales apply one score to a country or to a subset of its policies. A uniform state score conceals the internal religious diversity and the heterogeneous experiences of religious freedom that can result. These, in turn, encourage ecological fallacies and mask the disparate impact that religious freedom for one’s own community and for other groups can have on individuals’ preferences and decisions. To demonstrate the value of measuring and studying religious freedom at the individual level, this study applies individual-level assessments of …
