General Statement:

The Law School was established as a part of Richmond College in 1870. In 1890 the family of the late Mr. T. C. Garrison Diversion Unit. Letter From The Secretary Of The Interior, Transmitting A Report On The Garrison Diversion Unit, North Dakota And South Dakota, Missouri River Basin Project, United States Congress, Us House Of Representatives, United States Department Of The Interior

US Government Documents Related to Indigenous Nations

This collection of letters and reports, dated February 4, 1960, contains correspondences from the US Department of the Interior, the US Bureau of Reclamation, the US Fish and Wildlife Service, the US Bureau of the Budget and other “interested federal agencies.” These correspondences discuss the risks and benefits of further development of the Missouri River Basin project in order to provide irrigation, more dependable municipal water supply, more dependable water supply to local industries and wildlife areas, as well as further development of flood control, drainage, and recreation. This extension would primarily benefit areas in North and South Dakota. The …

Consult Primary Authorities--Step Three In The Research Process

Research in Virgil Hawkins' World of Print--Historical Print Research Project No. 1: Abortion

The next likely step would have been to look up the statutes and the case that were listed in Florida Law and Practice to find additional information. To find both the statute and corresponding annotations, the student would have used the Florida Statutes Annotated. Since they found the citations for the statute in Florida Law and Practice, there is no need to use the index and the student would go directly to the volume of the set that contained the statute and annotations. At the time, F.S. § 782.10 held that intentionally causing a woman to miscarry would carry …

Conclusion And Fast Forward

Research in Virgil Hawkins' World of Print--Historical Print Research Project No. 1: Abortion

After analyzing statutes and case law information on abortion in Florida, the student could conclude and state that offering to help a woman obtain an abortion was illegal in the 1960’s and, if a miscarriage subsequently occurred due to aid provided, the person who helped obtain the abortion could be convicted of 3rd degree manslaughter.

In 1973, the Supreme Court case of Roe v. Wade established that women had the right to seek an abortion and that states had to balance their ability to regulate health against a woman’s health care decision power and the potentiality of human life. 410 …

Research Strategy And Resources

Research in Virgil Hawkins' World of Print--Historical Print Research Project No. 1: Abortion

The first step in any research process is to create a research strategy and organize your plan. The first step in most legal research is the use of secondary sources in order to gain an overview of a legal issue and to find cases and statutes that discuss the topic. A possible source about the state of the law in Florida on the topic of abortion was Florida Law and Practice.

Historical Research Project On Abortion Jan 1960

Historical Research Project On Abortion

Research in Virgil Hawkins' World of Print--Historical Print Research Project No. 1: Abortion

This document represents an historical research project, from start to finish, as it would have been accomplished during the time Virgil Hawkins was fighting to gain entry into the University of Florida law school. The student would have used print resources to resolve this legal question regarding abortion, a topic about which the law has changed significantly since the time this research would have been performed.

American Enterprise In The European Common Market: A Legal Profile. Volume 1., Eric Stein, Thomas L. Nicholson Jan 1960

American Enterprise In The European Common Market: A Legal Profile. Volume 1., Eric Stein, Thomas L. Nicholson

Michigan Legal Studies Series

The rapid expansion of international trade during the past fifteen years has confronted the American business counselor with a great variety of new problems. Solutions to these problems were not expounded to him in his pre-war legal education, nor are they to be found in the rich proliferation of advance sheets, digests, and loose-leaf services with which the modern American lawyer is blessed. When he turns to foreign counsel, he finds that a lack of common legal background makes meaningful professional communication difficult. This book has been prepared with the primary purpose of helping those American lawyers who, because of …

The Conflict Of Laws: A Comparative Study, Second Edition. Volume Two. Foreign Corporations: Torts: Contracts In General, Ernst Rabel

Michigan Legal Studies Series

The second volume of Ernst Rabel's comparative treatise on the conflict of laws was originally published in 1947. This new edition completes the plan to revise the first two volumes, as arranged with the approval of the author before his death on September 7, 1955. Pursuant to this plan, the present edition has been made possible through the continued support of the work by the University of Michigan Law School and the generous cooperation of the Max Planck-Institut für aüslindisches und internationales Privatrecht in Hamburg, in making available the competent services of a member of the staff of the Institut, …

Fraud On The Widow’S Share, W. D. Macdonald Jan 1960

Fraud On The Widow’S Share, W. D. Macdonald

Michigan Legal Studies Series

This study seeks the answer to a troublesome question: What should be done about gratuitous inter vivos transfers in alleged "evasion" of the widow's statutory share? My thesis is that the statutory share should be replaced by the type of decedent's family maintenance legislation found in the British Commonwealth, and that this legislation should be buttressed with anti-evasion provisions. Inter vivos "evasions" seem to be a permanent and increasingly serious concomitant of our forced share system. Part I, dealing with matters of policy, explores the chief aggravating factors. These factors include the high rate of remarriage, which induces transfers to …

The Evolution Of British Planning Legislation, Beverley J. Pooley Jan 1960

The Evolution Of British Planning Legislation, Beverley J. Pooley

Michigan Legal Studies Series

A part of the Legal Problems of Metropolitan Area Studies series by the Legislative Research Center of the University of Michigan Law School. Excerpt from the foreword by William J. Pierce, Director, Feb 2 1960:

This study, by Beverley J. Pooley, is the first in a series of monographs which will be published by the Center. It deals with the problems which have confronted British legislators and with the resultant Parlimentary enactments-- particularly in the post World War II era. This topic is necessarily broad, and therefore this monograph contains little detailed legal analysis of the various acts. Rather, the …

Authorizing Enrolled Members Of The Three Affiliated Tribes Of The Fort Berthold Reservation, N. Dak., To Acquire Trust Interests In Tribal Lands Of The Reservation, And For Other Purposes, United States Congress, Us Senate

US Government Documents Related to Indigenous Nations

This report submitted by the United States (US) Senate Committee on Interior and Insular Affairs, dated September 1, 1959, was written to accompany Senate Bill 1352 which proposed (with the consent of the Three Affiliated Tribes tribal council) to authorize enrolled tribal members to acquire tribal lands. Many who were relocated due to the construction of the Garrison Dam did not have adequate funds to reestablish themselves in their new location. Since it is prohibited to sell the tribal lands of an organized tribe, US Senate Bill 1528 would allow for individual tribal members to purchase tribal land to establish …
