"Exclusive" Jurisdiction Of The Juvenile Courts, L. L. P.
West Virginia Law Review
The Attorney General of West Virginia, in a recently released opinion, takes the position that the child welfare provisions of the West Virginia Code, as amended, do not preclude criminal prosecution of juveniles in the circuit courts or other courts having criminal jurisdiction. The importance of the opinion and its possible effect on the future handling of criminal charges against juveniles require a close examination of the juvenile court provisions of the Code and the cases interpreting them.

View By A Judge Sitting In Lieu Of A Jury, R. W. F.
West Virginia Law Review
As stated by Dean Thomas P. Hardman in his article on the evidentiary effect of views, the question whether a judge may have a view and whether what the judge observes upon a view is usable as substantive evidence, has never been judicially decided in West Virginia. However, recently in the case of Westover Volunteer Fire Department v. Barker2 hereinafter referred to as the principal case, the Supreme Court of Appeals of West Virginia was, to a very limited extent, presented with those questions. Because there are today a great number of cases in which the judge sits as the …

The Statutes Of Nonvoting Stock In West Virginia, P. B. H.
West Virginia Law Review
In a recent decision, the Supreme Court of West Virginia decided that certain statutory provisions of the Code were unconstitutional insofar as they permitted a limitation on the right of a stockholder in any corporation to vote for the directors of such a corporation. The constitutionality of the applicable statutes was discussed in two articles printed in this law review twenty-four years ago, but in light of the decision in State ex rel. Dewey Portland Cement Co. v. O'Brien4 (for the purposes of this note, this case will be designated the Dewey Cement Co. case.), there is valid reason to …
Contracts Between A Director And His Corporation, T. E. P.
Contracts Between A Director And His Corporation, T. E. P.
West Virginia Law Review
The law generally recognizes that a director or officer of a corporation occupies a fiduciary relationship to the corporation. This relationship has been described as analogous to that of an agent to his principal or a trustee to his beneficiary.1 Therefore it is logical that a director cannot deal with his corporation like a stranger at arm's length, but is bound by the rules of fairness and good faith which the courts have imposed on fiduciaries for the protection of those whose interests are confided to their care. The courts are greatly divided as to what rules or standards of …

The Defense Of Laches And A Correlative, John W. Plattenburg
West Virginia Law Review
The term laches, when used in a legal sense, generally brings to mind the image of the complainant who has slept on his rights for an unreasonable length of time, and who is now precluded from asserting those rights. Laches connotes the passage of time and a laxness on the part of a party to assert his rights during the time elapsed. The defense of laches, as applied in equity, is a much more restricted doctrine than is apparent in this connotation of the word. The purpose of this note is to show what generally constitutes a defense of laches, …
