Post-Conviction Relief For Federal Prisoners: A Survey And A Suggestion Under 28 U.S.C. 2255, Gerald F. Uelmen

West Virginia Law Review

In answer to the complaints of numerous federal judges that they were being engulfed by a flood of habeas corpus petitions, Congress in 1948 enacted a complete revision of the habeas corpus provisions of the Judicial Code. Part of this revision was title 28, section 2255, of the United States Code which "restates, clarifies and simplifies the procedure in the nature of the ancient writ of error coram nobis." Adopted upon the recommendation of the Judicial Conference of the United States, its declared purpose was to provide "an expeditious remedy for correcting erroneous sentences without resort to habeas corpus." The …

Judicial Review: A Tri-Dimensional Concept Of Administrative-Constitutional Law, Frank R. Strong

West Virginia Law Review

In an earlier issue of the present volume of the Review, an effort was made to dispel the seeming absurdity that "Separation of Powers, the cardinal principle upon which the federal and all state governments are founded, a great American contribution to the science of government, violates the due process clause!" The quotation is from an able and exhaustive article on Judicial Review of Administrative Action in West Virginia, written by Kenneth Gulp Davis at the beginning of a teaching and writing career which has brought him preminence in the field of Administrative Law. The article appeared in Volume 44 …

Judicial Review: A Tri-Dimensional Concept Of Administrative-Constitutional Law, Frank R. Strong

West Virginia Law Review

In the pages of Volume 44 of the West Virginia Law Quarterly, Professor Kenneth Culp Davis, then a young law teacher in this College of Law, found in certain decisions of the supreme court of this State and of the Supreme Court of the United States the paradox that "Separation of powers, the cardinal principle upon which the federal and all the state governments are founded, a great American contribution to the science of government, violates the due process clause!" To Professor Davis this result seemed exceedingly absurd, and in this adverse judgment he has had with him the great …

The Testator's Intent--Vague Meanings Of Clear Sounding Phrases, Londo H. Brown

West Virginia Law Review

One of the greatest dangers that a lawyer faces is the danger that he may not recognize that there is a real problem involved when a client calls upon him for advice. Once the lawyer sees that there is a problem and is able to correctly diagnose the problem, the solution of the problem is usually relatively easy. In other words, there is more danger that the lawyer will overlook the problem than that he will fail to find the proper solution after he has found the problem. Furthermore, he may create a problem in drafting legal instruments if he …
