The Uniform Laws In Washington, Byron D. Coney

Washington Law Review

Since the organization in 1892 of the National Conference on Uniform State Laws, more than 130 uniform laws have been drafted and approved by that group. A good many of the approved acts have since been superceded or withdrawn and at the present time a total of 58 uniform laws and 26 model acts are being recommended for adoption. All the states have adopted some of these laws and a few, such as Wisconsin or South Dakota have enacted a great number. The Commissioners of late have become interested in taking inventory in each state to determine the extent to …

Our Inadequate Attorneys' Lien Statutes—A Suggestion, George Neff Stevens Mar 1956

Our Inadequate Attorneys' Lien Statutes—A Suggestion, George Neff Stevens

Washington Law Review

The average attorney has little interest in, nor does he realize the inadequacy of, the attorney's lien laws of his state—until he finds himself personally involved. Yet, a glance at the law reviews and pertinent cases indicates that the organized bar and its individual members should show more than a casual interest in the number and variety of problems arising in this field.

Washington Law Review

The present work comprises Soviet Philosophy of Law, Land and Labor Law, State Law, Soviet Justice and also social structure (Soviet Society), International Law (principles and practice) and the legal order in the Soviet satellites. Application of the comparative method allows the author to describe all the differences between the legal system of the modem democratic nations and Soviet law. Owing to the analysis of both systems and their psychological and sociological effects, it becomes easier to understand what the Soviet legal system means for an individual and society, for national economy and morals. It is a new approach to …

Probate Legislation Enacted By The 1955 Session Of The Washington Legislature, J. Gordon Gose, Joseph W. Hawley

Washington Law Review

The purpose of this survey is to focus attention on changes in the probate law of the state as a result of the 1955 session of the legislature. Five separate Acts amending or adding to the law of probate were adopted. These Acts are chapters 98, 141, 154 and 205 of the Laws of 1955 and chapter 7 of the Laws of 1955 (Extraordinary Session). In the aggregate they embody a substantial number of changes, most of which are simple procedural amendments. A few of the amendments present secondary questions of some difficulty. It is not the purpose of this …

Addendum: Taft-Hartley And State Power To Regulate Labor Relations, Donald H. Wollett Mar 1956

Addendum: Taft-Hartley And State Power To Regulate Labor Relations, Donald H. Wollett

Washington Law Review

The article on this subject which appeared in the February, 1955 issue of the Washington Law Review' made reference to three cases which were then pending before the Supreme Court of the United States. Since that time the Court has handed down these decisions. Ordinarily this would not justify additional comment, for one of the risks in writing any article in such a dynamic field is that what appears to be current today may be rendered obsolete or incomplete tomorrow. However, since the subject matter is of continuing and developing importance to all lawyers interested in labor law, and since …

Proposed Procedure For Administering Heart Cases Under The Washington Industrial Insurance Act, Ivan C. Rutledge Mar 1956

Proposed Procedure For Administering Heart Cases Under The Washington Industrial Insurance Act, Ivan C. Rutledge

Washington Law Review

Recent and authoritative medical investigations have convinced qualified cardiologists that the great majority of cardiac patients can perform productive labor without physical harm to themselves. Despite the assurance of cardiologists, many industrial concerns are reluctant to employ workmen suffering from cardiac disorders due to fear of increased industrial insurance costs. The resultant nonemployment of these patients when otherwise employable not only creates needless despair for themselves and their families, but it deprives the industrial community of many skills developed over long years of training. It is the purpose of this article to review the Washington Industrial Insurance Act to determine …

Consideration In Suretyship Contracts In Washington, Richard W. Bartke Mar 1956

Consideration In Suretyship Contracts In Washington, Richard W. Bartke

Washington Law Review

The suretyship relation is a specialized form of contract and in order to be enforceable must satisfy all the requirements of contract formation, one of which is consideration. If this were always kept in mind and the cases analysed on the basis of technical contract rules, much of the difficulties and confusion found in the area would disappear. However, because of the tripartite nature of the suretyship transaction and of the circumstance that, at least historically, the surety generally did not derive any direct economic benefit from the transaction, lending his name and credit for reasons of blood ties or …

Report On Lawyers And The Fifth Amendment, George W. Martin Nov 1955

Report On Lawyers And The Fifth Amendment, George W. Martin

Washington Law Review

Lawyers are familiar with the history and development of the privilege and are keenly aware of the struggle we have had to preserve that right. As a part of our heritage it was placed in the Constitution in the Bill of Rights and was also incorporated in our various state constitutions. No one will deny that this privilege is one of the great landmarks in the struggle for justice, no one in his right mind would advocate that this right be taken away. Questions concerning the exercise and abuse of this privilege by a few lawyers have been aroused in …

Evolution Of Legislation On Proof Of Title To Land, R. G. Patton Aug 1955

Evolution Of Legislation On Proof Of Title To Land, R. G. Patton

Washington Law Review

Possessory titles are recognized by the courts when they protect a first trespassing squatter against acts of a subsequent trespasser. They are given priority over the claims of the conventional title holder when the latter has lost his right to judicial assistance by reason of acts which raise an estoppel or for failure to act within a period of time which the courts or the legislature have fixed as a limitation of action. In these cases the holder of the possessory title may by court action secure a documentary title in the form of a judgment which confirms a title …

Lease Deposits In Washington, John T. Piper Aug 1955

Lease Deposits In Washington, John T. Piper

Washington Law Review

When a lessee deposits with his lessor a sum of money under an agreement that the lessor will return it or apply it in a specified manner if the lessee fully performs his covenants, at least three legal problems may arise. First, in the event that the tenant fails to give full performance, how much of the deposit can the landlord keep? Second, is the obligation of the landlord to return or otherwise apply the deposit a covenant running with the land? Third, when does the landlord pay taxes on the deposit?

Unauthorized Practice Of Law In Washington, Phillip Offenbacker Aug 1955

Unauthorized Practice Of Law In Washington, Phillip Offenbacker

Washington Law Review

Unauthorized practice of law is practice by one who has not been admitted to practice by the supreme court and who is not a member in good standing of the state bar association. It is now undisputed that the supreme court has sole jurisdiction over admission to practice and apparently may deal with unauthorized practice as an incident of its power over admission. However, unauthorized practice has also been the subject of legislative enactment. It follows, therefore, that the sanctions which are imposed to prevent the unauthorized practice of law in this state are of both judicial and legislative creation. …
