Incorporation By Reference And Independent Legal Significance In The New York Law Of Wills Jan 1960

Incorporation By Reference And Independent Legal Significance In The New York Law Of Wills

Fordham Law Review

In the substantive law of wills two theories of law are traditionally relied upon to permit consideration of extrinsic documents in the construction or expansion of a will. These two theories are the common law doctrines of incorporation by reference and independent legal significance. It is the purpose of this comment to analyze these theories of law in a dual aspect, first, to define the doctrines, applying them to their logical legal conclusions, and second, to assess the validity of various writings under existing New York law.

Towards A World Rule Of Law-Customary International Law In American Courts, Alan Schechter

Fordham Law Review

A major factor in the development of a world rule of law is the attitude of municipal courts toward questions possibly involving international customary law. Mr. Schechter reviews the practice of American federal and state courts since the end of World War II, concentrating on the types of evidence considered to establish the existence of customary rules.

Federal Protection Of Employee Rights Within Trade Unions, Richard A. Givens

Fordham Law Review

The "Bill of Rights" provision of the Labor-Management Reporting and Disclosure Act of 1959 are designed to guarantee and protect employee representation in industrial government. The author, pointing to the method of Mr. Chief Justice Stone in Steele v. Louisville & N.R.R., suggests that the act's purpose may be advanced by an interpretation guided by the consitutional precedents applicable to public government.

Migratory Alimony: A Constitutional Dilemma In The Exercise Of In Personam Jurisdiction, Wilfred J. Ritz

Fordham Law Review

Obstacles to obtaining binding determinations of domicile often block the personal jurisdiction required for alimony adjudication. A way out of the impasse, Professor Ritz argues, is offered by the mechanism of removing cases to federal courts under the constitutional grant of federal jurisdiction based on diversity of citizenship.

Nonresident Personal Income Tax: A Comparative Study In Eight States, Michael B. Solomon

Fordham Law Review

A majority of the states tax the income of nonresidents. The vexing question today is how the states should strike the balance between the ever-increasing need for revenue and the demand by nonresidents for fair treatment. Mr. Solomon examines the methods eight states have employed or proposed in striking this balance.

Rent Determination And Its Tax Treatment, Lester R. Rusoff

Fordham Law Review

Payments between stockholders and corporations and by lessees to third persons, leases with options to buy and leaseback arrangements involve possibilities of tax avoidance. The Rights Of A Witness Before A Congressional Committee Jan 1960

The Rights Of A Witness Before A Congressional Committee

Fordham Law Review

It is unquestionably the duty of all citizens to cooperate with the Congress in its efforts to obtain the facts needed for intelligent legislative action. It is their unremitting obligation to respond to subpoenas, to respect the dignity of the Congress and its committees and to testify fully with respect to matters within the province of proper investigation. This ... assumes that the ... rights of witnesses will be respected by the Congress as they are in a court of justice.
