Can We Act Globally While Thinking Locally: Responding To Stella Burch Elias, The Perils And Possibilities Of Refugee Federalism, Kit Johnson
Faculty Articles
In The Perils and Possibilities of Refugee Federalism, Professor Stella Burch Elias skillfully exposes both the dangers and the opportunities presented by state responses to the resettlement of refugees within their borders. She concludes that states are prohibited from excluding refugees from their territory, but she argues that states have a previously untapped opportunity to legislate at the local level in an effort to promote the integration of refugees into their communities. This Response does not challenge those conclusions. Rather, this Response seeks to provide context to the idea of refugee federalism by further discussing the problem, acknowledged by Professor …
Fast & Furious: The Misregulation Of Driverless Cars, Tracy Hresko Pearl
Fast & Furious: The Misregulation Of Driverless Cars, Tracy Hresko Pearl
Faculty Articles
The United States is on the cusp of a revolution in transportation. The sale and widespread use of both semi-autonomous and fully autonomous vehicles, also known as “driverless cars,” are both imminent and likely to significantly change the way in which citizens commute, interact, and travel. While there is substantial concern amongst state lawmakers and the general public about the overall safety and desirability of these vehicles, experts predict that fully autonomous cars will dramatically improve highway safety, reduce traffic, increase productivity, and enhance the independence of individuals who are unable to obtain licenses. Lawmakers, however, motivated by irrational fears …

Indigenizing Equality, M. Alexander Pearl, Kyle Velte

Notwithstanding the significant victories of the LGBT civil rights movement over the past 20 years, culminating in the declaration of full marriage equality in Obergefell v. Hodges, anti-LGBT sentiment generally, and anti-marriage-equality sentiment in particular, continue to run deep. One pocket of resistance is in some tribal communities. While Obergefell unequivocally resolved the problem of the “patchwork quilt” of marriage equality among the states, the problem of gaps in marriage equality among Tribal Nations has left the problem of the “patchwork quilt” intact. This article answers the question: What is the effect of federal marriage equality on the modern expression …

The Case For Eliminating Patent Law's Inequitable Conduct Defense, Eric E. Johnson
The Case For Eliminating Patent Law's Inequitable Conduct Defense, Eric E. Johnson
Faculty Articles
This paper argues for the elimination of the judicially crafted inequitable conduct defense, which will invalidate a patent upon the defendant’s showing that the patent was obtained by deceiving the patent office. Inequitable conduct commonly comes up as an accusation that the patentee, when applying for her or his patent, failed to live up to a duty of disclosure and candor. This duty and the inequitable conduct doctrine’s enforcement of it are meant to help avoid the issuance of undeserved patents, which would unfairly restrict the rights of the public. Unfortunately, in the real world, the inequitable conduct defense can …
Fifty Years Later: Miranda & The Police, Tracy Hresko Pearl
Fifty Years Later: Miranda & The Police, Tracy Hresko Pearl
Faculty Articles
This symposium asks us to reflect upon the fifty years after Miranda v. Arizona was handed down and to assess what impact Miranda had on law enforcement in this country. More colloquially, it asks whether, on balance, Miranda has been “good news” or “bad news” for the police. As I began to work on answering this question, however, I was troubled by the assumptions seemingly lurking within that question: (1) the assumption that Miranda has mattered at all to the police, (2) the assumption that it has mattered because it has somehow changed the behavior of police and/or the behavior …
On Health, Law, And Religion, Stacey A. Tovino
On Health, Law, And Religion, Stacey A. Tovino
Faculty Articles
The Supreme Court recently decided a number of cases involving health, law, and religion, including Whole Woman's Health v. Hellerstedt, Zubik v. Burwell, and Burwell v. Hobby Lobby Stores, Inc. These cases were important for understanding constitutional undue burden limitations and the boundaries of religious exercise during the Obama Administration. Unfortunately, the Supreme Court's recent opinions addressing health, law, and religion have little value for many health law professors and most practicing health care attorneys. These individuals, tasked with teaching and applying the thousands of federal and state statutes, regulations, and government guidance documents that address a wide …

Teaching The Hipaa Privacy Rule: Illustrative Comparisons, Stacey A. Tovino

Twenty years ago, President Clinton signed the Health Insurance Portability and Accountability Act of 1996 (HIPAA) into law. Over the past two decades, the federal Department of Health and Human Services (HHS) has published several sets of rules implementing the Administrative Simplification provisions within HIPAA as well as the Health Information Technology for Economic and Clinical (HITECH) Act within the American Recovery and Reinvestment Act (ARRA). These rules include, but certainly are not limited to, a final rule published on January 25, 2013, governing the use and disclosure of protected health information by covered entities and their business associates (the …
