Trade Secrets And The Right To Information: A Comparative Analysis Of E.U. And U.S. Approaches To Freedom Of Expression And Whistleblowing, Sharon K. Sandeen, Ulla-Maija Mylly

North Carolina Journal of Law & Technology

In this so-called “information age,” when numerous companies are collecting and creating more and more data and information, it is important to consider how the interests of these companies can (and should) be reconciled with the public’s interests in information, or what the Universal Declaration of Human Rights labels the “right to information.” Having expended money to create their stores of information, these companies often claim the need to protect it from all “unauthorized” uses, but our laws have never gone so far. To the contrary, information is not protected unless the law says it is, and when it is …

Patent Eligibility Of Disease Diagnosis, Shahrokh Falati Mar 2020

Patent Eligibility Of Disease Diagnosis, Shahrokh Falati

North Carolina Journal of Law & Technology

The U.S. Supreme Court effectively redefined the scope of patent eligible subject matter when it decided Mayo.1 This decision focused on medical diagnostic technology and has had a profound effect on the biotechnology and personalized medicine industries in the United States. Subsequent back-to-back decisions by the Supreme Court in Myriad2 and Alice3 have made it unequivocally clear that there is now wholesale broadening of the judicially created exceptions to statutory laws governing patent eligible subject matter. This has caused havoc in the biopharmaceutical industry by not only making it a near impossibility to obtain a patent in certain fields, but …

Why Removing 101 Won't Be Enough And What To Do Instead, Daniel Cole Mar 2020

Why Removing 101 Won't Be Enough And What To Do Instead, Daniel Cole

North Carolina Journal of Law & Technology

Congress recently released a reform proposal for Section 101 of the U.S. Patent Act. The draft included the following language: “No implicit or other judicially created exceptions to subject matter eligibility including ‘abstract ideas,’ ‘laws of nature, or ‘natural phenomena,’ shall be used to determine patent eligibility under Section 101, and all cases establishing or interpreting those exceptions to eligibility are hereby abrogated.” This is a blatant attempt to overturn Alice Corp v. CLS Bank International, Mayo Collaborative Services v. Prometheus Laboratories, Inc., and related cases which created the judicial exceptions that prevent the patenting of “abstract ideas,” “laws of …

Your Natural Gas Is Not Cyber-Secure: A Two-Fold Case For Why Voluntary Natural Gas Pipeline Cybersecurity Guidelines Should Become Mandatory Regulations Overseen By The Department Of Energy, Madeline A. Labovitz Mar 2020

Your Natural Gas Is Not Cyber-Secure: A Two-Fold Case For Why Voluntary Natural Gas Pipeline Cybersecurity Guidelines Should Become Mandatory Regulations Overseen By The Department Of Energy, Madeline A. Labovitz

North Carolina Journal of Law & Technology

In the past two decades, the United States has increased the production and use of natural gas to fuel every day American life. This increase has resulted in the construction of millions of miles of natural gas pipelines. While this development has produced a number of benefits, natural gas pipelines have introduced the threat of cyberattacks on natural gas infrastructure. This substantial threat is currently managed by voluntary guidelines promulgated by the Transportation Security Administration (“TSA”). While the private industry is satisfied to maintain the status quo and leave these threats essentially self-regulated, voluntary guidelines are not sufficient to defend …

Sextortion: The Hybrid "Cyber-Sex" Crime, Alessandra Carlton Mar 2020

Sextortion: The Hybrid "Cyber-Sex" Crime, Alessandra Carlton

North Carolina Journal of Law & Technology

Sextortion is an increasingly prevalent internet crime, but it is not well-defined or understood. As new technology makes the challenge of combatting sextortion even more difficult, regulators should consider using a broad definition of sextortion to capture the myriad of ways that criminals are extorting victim with their sexual images. This recent development discusses the pervasiveness and methods of the crime, particularly in the context of technology, and the need for federal government action and legislation to promote public awareness of this disturbingly prevalent cyber-sex crime. This article recommends a sextortion attack plan that would involve: (1) enactment of a …
