Extraordinary Writ Of Prohibition In Missouri, The (Continued), J. P. Mcbaine

The distinction has often been made between instances where the court has no jurisdiction whatsoever over the pending case and instances where the court has jurisdiction over the pending case, but is about to do some act, in the course of the trial, that it has no power to do. There is a distinction between no jurisdiction and an act in excess of jurisdiction. In either situation prohibition will issue.

Extraordinary Writ Of Prohibition In Missouri, The, J. P. Mcbaine
Extraordinary Writ Of Prohibition In Missouri, The, J. P. Mcbaine
University of Missouri Bulletin Law Series
The frequent use of the writ of prohibition by the Bar of this state has incited the writer to investigate the Missouri decisions and, if possible, to classify them to the end that we may make an orderly and analytical statement of the Missouri law on this important topic.
Judicial Control Of The Missouri Public Service Commission, James W. Simonton
Judicial Control Of The Missouri Public Service Commission, James W. Simonton
University of Missouri Bulletin Law Series
The control of the relations between the public and the various public service commissions or boards is now quite general throughout the country. The movement started during the last third of the nineteenth century with the formation of the various railroad boards and railroad commissions, to which were usually given certain powers of control over relations between the public and the railroads. But the courts, under the influence of the extreme individualistic notions of the time, were so hostile to any exercise of any real power by such administrative boards that these boards were almost completely paralyzed, and, as one …

Legal Education And American Law Institute, Herbert S. Hadley
Legal Education And American Law Institute, Herbert S. Hadley
University of Missouri Bulletin Law Series
During the last three years there have been two developments in the legal profession that have reached the stage of achievement and that promise to have far-reaching consequence. One is the effort to raise the standards of legal education, and the other to improve the law and bring it into harmony with modern life through its restatement.
Domicile Of A Married Woman, The, James L. Parks
Domicile Of A Married Woman, The, James L. Parks
University of Missouri Bulletin Law Series
Originally the rule was that the domicile of a married woman was that of her husband. It made no difference what the actual facts were, a wife would not be heard to say that she had a separate domicile. This notion was largely due to the law's conception of a married couple as one person, which idea was based on a wife's duty to be with her husband, he in turn being bound to support her.

Statutory Covenants For Title In Missouri, James W. Simonton
Statutory Covenants For Title In Missouri, James W. Simonton
University of Missouri Bulletin Law Series
The Missouri statute providing that the use of the words, "grant, bargain and sell", in a fee simple conveyance shall be construed as imposing on the grantor certain covenants of title, is not only interesting in respect to its history, but, as it stands at present, it appears to be different in scope from any statute on the subject in any other jurisdiction. Furthermore, this statute has been construed by the Missouri Supreme Court so that the final joint product of the legislative and the judicial branches of the state is surprising.

Law School Curriculum As Seen By The Bench And Bar, The, Cuthbert W. Pound
Law School Curriculum As Seen By The Bench And Bar, The, Cuthbert W. Pound
University of Missouri Bulletin Law Series
The Association of American Law Schools ask the Bench and Bar to indicate their views of the methods of legal education adopted by the schools. The request is timely. So large a proportion of the training for the profession of law has become the function of the law schools that lawyers and judges have the keenest interest and concern in the lines along which legal education is now developing. Of 643 students trying the New York State Bar examinations in June, 1922, for the first time, only nine had no law school training and of the nine three were college …
