Property Vs. Political Holdouts. The Case Of The Tgv Rail Line Lyon-Budapest In Italy, Livia C. Navone
Livia C. Navone
While the law and economics literature commonly justifies the takings power on the ground that it is necessary to overcome holdouts and, thus, allow efficient development projects to move forward, this paper shows that the standard theory is highly incomplete. It conveniently ignores the ability of politically powerful groups to block development projects by exercising their de facto veto power over proposed projects. Such groups do not necessarily have rights in any properties directly affected by the project. Consequently, once these groups, which I label “political holdouts,” are added to the analysis, it becomes clear that the payment of just …

IPR Issues in Space Activities- A Comparative Study of India, USA and Canada
ABSTRACT
The constant evolution of high technology and the ever-changing geopolitical situation underlines the need for the universal harmonization of industrial and intellectual property laws. Building a strategic IP portfolio is economically important from both an offensive and defensive standpoint. At a fundamental level, intellectual property is the core work product of a technical organization. The National Aeronautics and Space Administration (NASA) produce a variety of intellectual property including: patents, trademarks, data rights, copyright and rights associated with National Security. For a scientific organization to properly …

Using The Actual-Trader Model In Federal Securities Cases To Meet Daubert Standards And To Offset Inflationary Gains Against Inflationary Losses, Ran Wei, Ricardo Cossa, Mark Zmijewski

Aggregate damages in securities class action lawsuits have two distinct elements: inflation in the prices of the subject company’s securities and the trading behavior of the subject company’s investors. Experts typically have not been able to use statistical and empirically-based methods to measure the trading behavior of all investors in the class. In this paper we outline a methodology, the actual-trader model, to quantify aggregate damages for non-institutional investors. This methodology provides appropriate and sufficient empirical foundation for the aggregate damage calculations in securities class action lawsuits. When implemented appropriately, we believe this methodology meets Daubert and other standards of …
Collateral Conflict: Employer Claims Of Rico Extortion Against Union Comprehensive Campaigns, James J. Brudney
Collateral Conflict: Employer Claims Of Rico Extortion Against Union Comprehensive Campaigns, James J. Brudney
James J. Brudney
Over the past 30 years, facing volatile economic conditions and complex corporate relationships, unions have mounted coordinated campaigns (aimed at consumers, public officials, lenders, the media, and the public) in order to help organize new workers and to renew collective bargaining relationships. These often high-profile campaigns have at times been quite successful. In response, employers since the late 1980s have invoked civil RICO’s broad language to claim that the campaigns constitute actionable extortion. When these employer claims survive a motion to dismiss, they carry the threat of treble damages, attorneys’ fees, and reputational harms associated with unions being labeled mobsters. …

A tanulmány röviden áttekinti a természeti –a meteorológiai és geofizikai stb.– hadviselés lényegét, jelenlegi állását, formáit, eszközeit és hatásait. A természeti hadviselés lényege a környezet irányított megváltoztatásának –vagyis a környezetmódosító technikák alkalmazásának– fegyverként való használata.

Multiculturalism: A Challenge For Modern Criminal Justice. A Latin American Perspective, Raúl A. Carnevali
Multiculturalism: A Challenge For Modern Criminal Justice. A Latin American Perspective, Raúl A. Carnevali
Raúl A. Carnevali
Increased migratory flow has given rise to the formation of culturally heterogeneous societies, and with it the discussion of multicultural states. Specifically, what we call multiculturalism is presenting new challenges for criminal law, as certain conduct may be evaluated differently according to the cultural context of the perpetrator. In order to determine the scope of multiculturalism and exactly how criminal law should deal with the issue, it is necessary to examine the theses that address the typical problems of cultural diversity, specifically, liberalism and communitarianism. One can then understand what is meant by “culturally motivated crimes” and whether the key …

This paper analyses the enduring partnership between India and ASEAN and the reasons for the proximity between the two. It details why India has adopted a “Look-East” policy, what the policy is, its necessity and whether it is a success or failure. The article also scrutinises the steps taken by the Indian government to improve relations with ASEAN countries, the obstructions in the way and finally looks at the ASEAN–India free trade agreement.

"Iussum" Y "Nominatio" En Las Adquisiciones A Través De Dependientes, Patricio Lazo

Roman jurisprudence analysed the consequences of acquisition carried out by a common slave based on the following; the fact that either the slave acted under the iussum of one of his co-owners or that one of the co-owners expressely appointed him for that purpose (nominatio). Sabinian opinion, that finally prevailed in classic jurisprudence, was built based on this problem. This work studies the construction process of this prevailing opinion based on the analysis of jurisprudencial fragments that aims to show the most relevant landmarks in shaping the analysis structure of the problem, The author thinks that Salvius Iulianus' intervention is …

In the discussion on religion-democracy-secularism, several Catholic authors make some mistakes. Firstly, they accept a historical «mea culpa» that is not always well founded, and they accept to discuss on State’s terms. They also indulge in «Eurocentrism», and undervalue certain factors in the conflict: the State’s «vocation of Church», Sovereignty, the displacement of politics towards what is personal and the loss of public validity of three important visions: the specific nature of politics, the basic agreement, and the general legal mass of rules and fundamental principles.

Stopping For Death: Re-Framing Our Perspective On The End Of Life, Ruth C. Stern, J. Herbie Difonzo
J. Herbie DiFonzo
How we die is increasingly becoming a matter of law and public policy. We grapple with issues of patient autonomy, the proper parameters of doctor-patient discussions on the end of life, the right to hasten death, and the right to control our own medical treatment. But it is physicians and patients, not judges and legislators, who are the principal actors in events at the end of life. Palliative medicine is just beginning to probe the multi-dimensional totality of suffering in dying and seriously ill patients. What we learn will influence our options at the end of life and tell us …
All Who Live In Love: The Law & Theology Behind Same-Sex Marriage, Frank R. Flaspohler
All Who Live In Love: The Law & Theology Behind Same-Sex Marriage, Frank R. Flaspohler
Frank R Flaspohler
The issue of same-sex unions in the United States intertwines two fields of study that do not often intersect: constitutional law and religious theology. This essay seeks to present a summary of the constitutional law issues considered by several states courts and multiple legal scholars in presenting a modern approach to legal same-sex marriage. Additionally, this essay includes an overview of several Catholic Christian theologians who have presented grounds for a sexual theology that is more responsive to our modern understanding of sexual orientation. Together, these viewpoints show that same-sex unions can grow from our constitutional understanding of the rights …

Social Networking: A Conceptual Analysis Of A Data Controller, Rebecca Wong
Dr Rebecca Wong
This article updates a working party looking at the definition of a "data controller" under the Data Protection Directive 95/46/EC within the context of a social networking environment. In brief, the article considers twhether the phenomenom of social networking (through Facebook (FB), MySpace and Bebo) has produced unintended consequences in the interpretation and application of the Data Protection Directive 95/46/EC to the online environment. The Data Protection Directive 95/46/EC defines a "data controller" broadly to refer to the 'natural or legal person, public authority, agency or any other body which alone or jointly with others determines the purposes and means …

Al Maqaleh V. Gates: An Unworkable Application Of The Boumediene Factors, Tarik N. Jallad
Tarik N. Jallad
This paper analyzes the recent D.C. District Court decision in al Maqaleh v. Gates. The issue in al Maqaleh was whether the Suspension Clause of the U.S. Constitution reaches four detainees held at the Bagram military facility in Afghanistan. The court answers this question by invoking the three factors used in Boumediene v. Bush, splitting them into six factors and systematically applying each one to the alleged facts surrounding the Bagram detainees and their detention facility. In this application, the court relies primarily on a model, comparing on one hand, the facts and facility involved in the post-World War Two …

The Sorcerer Ii Expedition: Intellectual Property And Biodiscovery, Matthew Rimmer

This article considers the significance of a leading marine biodiscovery initiative. In March 2004, Dr. J. Craig Venter announced the official launch of the Sorcerer II Expedition, a scientific expedition of discovery, which would survey marine and terrestrial microbial populations. The Expedition has the potential to uncover tens of thousands of new microbial species and tens of millions of new genes. Venter has disavowed that the Sorcerer II Expedition has any commercial ambitions. However, some have viewed the Sorcerer II Expedition with suspicion. Various civil society groups have accused the Expedition of engaging in ‘biopiracy’. This article investigates the Convention …
