Congressional Committee Reports: Their Role And History, Thomas F. Broden
Congressional Committee Reports: Their Role And History, Thomas F. Broden
Journal Articles
Most lawyers have an extremely limited understanding of the function of a congressional committee report. In general, lawyers think of such reports as aids to the interpretation of statutes on the books and much has been written about this role of the committee report. This role is considered by many as the committee report's primary, if not its only, function. Nothing could be further from the truth. It is the purpose of this article to explain its other, more important roles, those in the legislative process and to examine the historical development of the use of written committee reports in …

The Legal Status Of Joint Venture Corporations, Thomas F. Broden, Alfred L. Scanlan
Journal Articles
American industry employs many forms of business organizations. The sole proprietorship, the partnership, general and limited, the joint venture, the joint stock company, the corporation, public issue and close, and many others are all familiar and well established in their use. This article deals with the use by American industry of the close corporation to carry on a joint venture. With due deference to purists in legal terminology we have elected to refer to this particular type of corporate entity as the joint venture corporation. In this article we not only look at the use made of the joint venture …

Mr. President Betts, Mr. President-Elect, gentlemen of the International Association of Insurance Counsel and your lovely ladies: I am particularly grateful and edified to a very great extent by the intelligent interest of the advocates of the advocates—may I say that of your lovely wives—for their sustained interest in these legalisms that you have heard here this morning. It is very impressive, and it encourages me to say primarily to the ladies present that what I am ostensibly addressing to the gentlemen, I am really addressing to you. I know, of course, that you are defense lawyers primarily, and I …

Nowadays, there is no more discredited era in our judicial history than that represented by such cases as Lochner v. New York.' During this era, we are told, our ancestors were so benighted economically as to embrace economic principles incapable of producing the good life, and so benighted judicially as to read their economics into the Constitution. We have barely left behind us the bulk of the advocates and judges whose role in history it was to slay the giant laissez-faire, so it is not surprising that we should have no picture of their adversary but the dne that was …
