Plea Bargaining: Critical Issues And Common Practices, Us Department Of Justice, William F. Mcdonald
National Institute of Justice Office of Justice Programs
This analysis of critical issues in the plea bargaining controversy is based on data obtained in six jurisdictions including structured observations of 711 in-court acceptances of guilty pleas; structured interviews with a total of over 200 judges, prosecutors, defense counsel, defendants, and police officers; a plea bargaining decision simulation and quasi-experiment administered to 138 prosecutors and 105 defense attorneys; and a statistical analysis of case file data from 3,397 robbery and burglary cases. The findings suggest that plea bargaining cannot be abolished but can be changed. The policy choices are: how much of a concession should be given to defendants; …

An Evaluation Of The California Community Crime Resistance Programs, Assembly Office Of Research
California Assembly
The Assembly Office of Research has been studying the appropriateness, costs, and results of punishments available under California law and comparing them to other possible sanctions which could be more effective and/or less costly. A previous report, "The Costs and Benefits of Prison Sentences for Burglars," issued in February 1984, examined the costs and benefits of recent sentencing laws for the crime of burglary. This report evaluates the California Community Crime Resistance Program and makes recommendations for continuing the program, which is scheduled to terminate in January 1986. The report also suggests possible improvements in the program.

Seventh Report On Jurisdictional Immunities Of States And Their Property, Sompong Sucharitkul
Publications
This report is the seventh in the series of reports on jurisdictional immunities of States and their property submitted to the International Law Commission by the Special Rapporteur. Since the present report was begun a few months after the end of the Commission's thirty-sixth session and completed shortly after the conclusion of the thirty-ninth session of the General Assembly, it was not possible to include any account of the discussion on the topic in the Sixth Committee of the General Assembly. However, sufficient progress has been made in the examination of the draft articles in first reading to warrant consideration …

Hearing Of The Assembly Judiciary Committee On The State Of Legal Education In California And The Process Of Preparing For Admission To Practice, Assembly Committee On Judiciary
California Assembly
During the spring of 1984, the Judiciary Committee of the California Assembly conducted a hearing which investigated the controversy surrounding the July 1983 bar examination. Although that particular bar examination's grading procedure is no longer under scrutiny, several unanswered questions have arisen regarding both the State Bar of California and the Committee of Bar Examiners.
Therefore, the Judiciary Committee will conduct two hearings which will focus on several issues related to the practice of law in California. The first hearing is scheduled for March 12, 1985, and will commence at 3:00 p.m. in Room 126 in the State Capitol. That …

A New Approach To The Fourth Amendment In Light Of Proposition Eight, Robert K. Calhoun
Publications
The purpose of this article is quite simple. It confines itself to the area of search and seizure law and begins by assuming the worst-that the Court eventually rules that a federal standard applies to all such suppression issues. It then goes on to propose an argument which is intended to rescue as much of California's independent search and seizure law as is possible.

In accordance with our legislative mandate, we have adopted a new energy policy for California. The policy, described in the California Energy Plan, is one which we believe will stabilize energy prices and directly contribute to the state's future economic growth. By following its recommendations for a balanced development of California's many energy resources and energy efficiency opportunities, a least-cost energy path can be provided for our citizens and businesses into the next century.

Proceedings Of The Attorney General's Crimeconference85:, California Department Of Justice

Crime in California and the Nation reached an all time high in 1980 and then began a decrease that lasted through 1984. In March 1985, the Bureau of Criminal Statistics (BCS) of my office convened the CR/MECONFERENC85: to explore the issue of crime trends in depth. Preliminary mid-year 1985 California data indicate this downward trend may be over, making such examinations particularly valuable. So that the Conference might live beyond its original two days and with the intent of communicating the meeting's results to a broad audience, we are publishing these proceedings. Verbatim transcripts were edited with the assistance of …
