Tidal Title And The Boundaries Of The Bay: The Case Of The Submerged "High Water" Mark, John A. Humbach, Jane A. Gale Jan 1975

Tidal Title And The Boundaries Of The Bay: The Case Of The Submerged "High Water" Mark, John A. Humbach, Jane A. Gale

Fordham Urban Law Journal

There is no particular policy reason why the same line should be used for both the upland boundary of the jus publicum and the seaward boundary of parcels bounded "by the sea." In interpreting the language used in grants of private interests, the ostensible object of the inquiry is to ascertain the parties (particularly the grantor's) intent. Subject only to limitations on the grantor's estate or power to convey, it is that intention which controls the extent of his transfer. On the other hand, in setting the upland boundaries of lands subject to the jus publicum, the courts are essentially …

Federal Magistrates And The Implications Of Consensual References, Eileen J. Mccabe Jan 1975

Federal Magistrates And The Implications Of Consensual References, Eileen J. Mccabe

Fordham Urban Law Journal

The significance of the magistrate in the efficient operation of the federal court system makes it important to analyze the extent of the magistrate's powers as well as the limitations placed thereon. This note will examine the matters which may properly be referred to a magistrate and the standard of review which is used when the magistrate's decision goes before the district court. A major consideration in this discussion will be whether parties, by their consent, can expand the scope of magistrate's powers.

Challenging Exclusionary Zoning: Contrasting Recent Federal And State Court Approaches, James C. Quinn Jan 1975

Challenging Exclusionary Zoning: Contrasting Recent Federal And State Court Approaches, James C. Quinn

Fordham Urban Law Journal

The zoning power, though based on the police power of the states, has traditionally been granted to local communities through various state enabling statutes. These enabling statutes permit local enactment of zoning ordinances only to the extent that they bear a substantial relation to the "health, safety, morals, or general welfare" of the community. With the migration of middle-class city dwellers to thc suburbs after World War II, zoning has become more than a means of maintaining the proper mix of land-use patterns in a community. Rather, in fear of overly rapid development and irreversible alteration of their community character, …

Economic Tipping: An Approach To A Balanced Neighborhood, Frank J. Allocca Jan 1975

Economic Tipping: An Approach To A Balanced Neighborhood, Frank J. Allocca

Fordham Urban Law Journal

In the recent decision of Trinity Episcopal School Corp. v. Romney, a court, for the first time, was confronted with a proposal to apply a "tipping" standard solely on the basis of income, rather than racial grounds. The case involved a group of middle-income residents seeking to enjoin the State and City of New York, as well as the Department of Housing and Urban Development (HUD) from increasing an area's low-income population through the building of various housing projects. "Tipping" has been defined as "that point at which a set of conditions has been created that will lead to the …

Attorneys Must Not Enter Partnership Agreements Prohibiting Themselves From Representing Former Clients Upon Termination Of Partnership. Dwyer V. Jung, 133 N.J. Super. 343, 336 A.2d 498 (Ch. 1975), Appeal Docketed, No. 3378-74, App. Div., June 18, 1975., Robert L. Schonfeld

Fordham Urban Law Journal

Three attorneys entered into a partnership agreement for the practice of law. Their agreement included a provision that assigned the partnership's insurance carrier clients to individual partners upon the termination of the partnership and restricted the partners from doing business with a client designated as that of another partner for a period of five years. Of these insurance carrier clients, 154 were assigned to the defendant while five were allotted to the plaintiffs. After the partnership was dissolved, the plaintiffs sought a judicial accounting. The defendant counterclaimed, contending that the plaintiffs violated the restrictive covenant of the original partnership agreement …

The Magnuson-Moss Warranty Act: Making Consumer Product Warranty A Federal Case, Robert C. Denicola

Fordham Law Review

FOR many Americans the most recent anniversary of the nation's independence was little more than a prelude to the forthcoming Bicentennial. For American businessmen, however, the 199th anniversary was significant in its own right. On July 4, 1975, the Magnuson-Moss Warranty Act went into effect, having been signed by President Ford six months earlier. A supporter has described the Act as "one of the most important pieces of consumer protection legislation considered by Congress since the Federal Trade Commision Act itself was passed in 1914." This characterization should not be dismissed as mere partisan rhetoric. The Act may indeed have …
