Unlocking The “Virtual Cage” Of Wildlife Surveillance, Henry Lininger, Tom Lininger Jun 2017

Unlocking The “Virtual Cage” Of Wildlife Surveillance, Henry Lininger, Tom Lininger

Duke Environmental Law & Policy Forum

The electronic surveillance of wildlife has grown more extensive than ever. For instance, thousands of wolves wear collars transmitting signals to wildlife biologists. Some collars inject wolves with tranquilizers that allow for their immediate capture if they stray outside of the boundaries set by anthropocentric management policies. Hunters have intercepted the signals from surveillance collars and have used this information to track and slaughter the animals. While the ostensible reason for the surveillance programs is to facilitate the peaceful coexistence of humanity and wildlife, the reality is less benign—an outdoor version of Bentham’s Panopticon.

Blood Biofuels, Nadia B. Ahmad Jun 2017

Blood Biofuels, Nadia B. Ahmad

Duke Environmental Law & Policy Forum

Modern energy policy aims to ratchet up the manufacture and use of biofuels, i.e. any fuel produced from biological materials. Yet biofuels derived from agricultural crops and residues, wood, forest residues, or other kinds of plant-based biomass feedstocks can be as environmentally and socially devastating as the finite fossil fuel resources they seek to replace. Often overlooked are their globalization impacts on land grabs, food security, greenhouse gas emissions, drought, deforestation, interference with climate change adaption measures, population displacement, desertification, sea level rise, biodiversity, and scalability. These environmental and social consequences result in food shortages, violent conflicts, urban riots, rural …

The Asymmetry Of Crimes By And Against Police Officers, Monu Bedi Jun 2017

The Asymmetry Of Crimes By And Against Police Officers, Monu Bedi

Duke Law Journal Online

Crimes by and against police officers during the performance of their duties are treated differently. If a police officer unlawfully harms a citizen, regular assault or homicide charges apply, whereas if a citizen unlawfully harms a police officer, aggravated assault or homicide charges apply. The enhancement stems from the fact that the citizen interfered with police activity. No one would dispute that states have a special interest in protecting this kind of important state-sanctioned behavior. But do they not also have an equal interest in deterring its abuse through commensurate charges?

This Essay is the first to tackle this asymmetry …

Embryos As Patients? Medical Provider Duties In The Age Of Crispr/Cas9, G. Edward Powell Iii May 2017

Embryos As Patients? Medical Provider Duties In The Age Of Crispr/Cas9, G. Edward Powell Iii

Duke Law & Technology Review

The CRISPR/Cas9 genome engineering platform is the first method of gene editing that could potentially be used to treat genetic disorders in human embryos. No past therapies, genetic or otherwise, have been intended or used to treat disorders in existent embryos. Past procedures performed on embryos have exclusively involved creation and implantation (e.g., in-vitro fertilization) or screening and selection of already-healthy embryos (e.g., preimplantation genetic diagnosis). A CRISPR/Cas9 treatment would evade medical malpractice law due to the early stage of the intervention and the fact that it is not a treatment for the mother. In most jurisdictions, medical professionals owe …

Outer Space: The Final Frontier Or The Final Battlefield?, Emily Taft May 2017

Outer Space: The Final Frontier Or The Final Battlefield?, Emily Taft

Duke Law & Technology Review

Current law concerning the militarization and weaponization of outer space is inadequate for present times. The increased implementation of “dual-use” space technologies poses obstacles for the demilitarization of space. This paper examines how far the militarization of space should be taken and also whether weapons of any kind should be placed in space. Further steps must be taken in international space law to attempt to keep the militarization and weaponization of space under control in order to promote and maintain a free outer space for research and exploration.
