Operation Of Businesses By Trustees
Operation Of Businesses By Trustees
Duke Law Journal
Common law trust principles impose a duty of conservative prudence upon trustees administering the estates of decedents. This comment analyzes these traditional rules in terms of whether they provide realistic and workable standards when applied to trustees who are charged with the continuation of a decedent's business.
The Defense Of Entrapment In The Federal Courts, Lester B. Orfield
The Defense Of Entrapment In The Federal Courts, Lester B. Orfield
Duke Law Journal
Since 1932, the defense of entrapment has been firmly established in the federal courts; however, the doctrine itself is replete with basic confusion. In recent years, this underlying confusion has prompted the development of disparate rules governing the scope and application of the defense.
Banks And Banking: Authority Of State Banking Superintendent To Challenge Branching Activities Of National Banks
Duke Law Journal
The Comptroller of the Currency may authorize a national bank to establish a branch when such establishment would be permitted state banks by the local state statute. Competitor banks can challenge the Comptroller's determination alleging noncompliance with the state standard. This comment examines the question of the state's independent ability, proceeding under either state or federal law, to question a ruling by the Comptroller.
The Rights Of A Witness Before A Grand Jury
The Rights Of A Witness Before A Grand Jury
Duke Law Journal
The implications of recent decisions of the Supreme Court which have given new and expanded meanings to the procedural safeguards owing to a criminal defendant have not yet been fully realized. Most immediately, they will undoubtedly affect established practices of law enforcement agencies. An important consequence of these changes, however, may also be the extension of the right to counsel to the grand jury witness.

Duke Law Journal
The First Circuit in United States v. Rhode Island Hosp. Trust Co. has held that the form of the insurance contract, rather than an assessment of all the facts or the decedent's intent, is determinative of "incidents of ownership" for purposes of section 2042 of the Internal Revenue Code.

The Anatomy Of A Spin-Off, Robert A. Jacobs
Duke Law Journal
Section 355 of the Internal Revenue Code, which specially treats certain forms of corporate reorganization, has been the constant subject of both scholarly commentary and litigation. The experience of functioning under these spin-off provisions has resulted in clarification of the law and has also raised significant questions as to its scope. The precise limits of the section remain to some extent in a state of flux and await further exposition by the courts.
Federal Jurisdiction: The Civil Rights Removal Statute Revisited
Federal Jurisdiction: The Civil Rights Removal Statute Revisited
Duke Law Journal
For the first time in sixty years, the Supreme Court in Georgia v. Rachel and City of Greenwood v. Peacock re-examined the civil rights removal provisions of section 1443 of the Judicial Code, which until recent years have remained dormant because of the restrictive interpretation assigned to this remnant of Reconstruction legislation. The Supreme Court as late as 1906 apparently relegated the statute's principal remedy to instances involving a state enactment discriminatory on its face, a standard which rendered the legislation impotent as more subtle devices for denying equal civil rights developed. However, when the Civil Rights Act of 1964 …
