George Floyd And Empathy Stories, Binny Miller Jan 2021

George Floyd And Empathy Stories, Binny Miller

Scholarly Articles in Law Reviews & Journals

In this essay, I explore the stories that lawyers tell on behalf of clients in the context of empathy, and also consider the power of proximity, particularly physical proximity, in forging deep connections with clients. Empathy has played a key, if sometimes silent, role in the endeavor of giving clients "back their lives," whether in case theory or in lawyering more generally. A renewed focus on empathy-informed by Bryan Stevenson's idea of proximity-can more securely ground lawyers in the lived experience of their clients.I use the context of the murder of George Floyd and the subsequent trial of Derek Chauvin …

Pandemics And International Law: The Need For Action [Chile], Claudio Grossman

American University International Law Review

INTRODUCTION

Let me start by stating that international law has developed principles, norms, institutions that provide an important basis for addressing pandemics; and stressing important values in the international community, including cooperation among States and the vital role of international organizations—among others. First, I will make some introductory remarks on whether international law has norms, principles, and institutions relevant to the topic of pandemics. Then, I will propose a path forward.

The Trade Secrecy Standard For Patent Prior Art, Camilla A. Hrdy, Sharon K. Sandeen Jan 2021

The Trade Secrecy Standard For Patent Prior Art, Camilla A. Hrdy, Sharon K. Sandeen

American University Law Review

A fundamental criterion of patentability is that an invention must be new as compared to the prior art—the corpus of preexisting knowledge and technology already available to the public. If an invention is in the prior art, or rendered obvious by it, it cannot be patented.

The U.S. Patent Act has traditionally envisioned a categorical approach for deciding what counts as prior art. Under this approach, courts are supposed to decide whether a particular disclosure about the invention (a reference) falls within one of the categories listed in Section 102 of the Patent Act, such as “described in a printed …

Comparing Dadd V. Anoka County With Corbitt V. Vickers: Why Defendants Should Bear The Burden Of Establishing Qualified Immunity In A Motion To Dismiss, Aisha Green Jan 2021

Comparing Dadd V. Anoka County With Corbitt V. Vickers: Why Defendants Should Bear The Burden Of Establishing Qualified Immunity In A Motion To Dismiss, Aisha Green

American University Law Review

In the wake of last summer’s George Floyd protests, qualified immunity is once again at the forefront of the debate. Officials, such as police officers, can raise qualified immunity as an affirmative defense in response to allegations that they have violated an individual’s constitutional rights. The different interpretations of qualified immunity’s meaning, use, and scope among the circuit courts have contributed to the development of strong opinions on both sides of the defense.

Particularly, circuit courts are split over who bears the burden of establishing qualified immunity when defendants use it as a basis for a motion to dismiss under …

Speaking Femicide, Caroline Davidson Jan 2021

Speaking Femicide, Caroline Davidson

American University Law Review

Femicide is typically defined as the killing of a woman because she is a woman. It has been the subject of mass protests in cities from Buenos Aires to Paris and in some places has made the leap to law as a crime unto itself or basis for a sentencing enhancement in homicide cases. Proponents of the label of femicide seek to bring attention to gendered violence against women and end a culture of tolerance and impunity for such violence. Meanwhile, in the United States, it is neither legislated nor discussed.

This Article explores the concept of femicide and asks …
