The Internet is often described as inherently free from regulation; a space where freedoms and liberties are guaranteed by the design of the network environment. The naivety of this view has, however, been exposed by commentators such as Andrew Shapiro, Joel Reidenberg and Lawrence Lessig who have clearly demonstrated the inherent regulability of networked space. The question no longer is: can networked space be regulated? But rather: how and by whom is it regulated? This paper examines the regulation of rights in networked space. Civil Liberties And The Terrorism Prevention Paradigm: The Guilt By Association Critique, Robert Chesney

This piece, which appears in Michigan's annual Survey of Books issue, takes two books by David Cole (one co-authored with James Dempsey) as points of departure for a review of the liberty-security debate in the years shortly after 9/11. It begins with a discussion of theoretical models associated with "balancing" liberty and security, and then proceeds to review Cole's (and Dempsey's) work on a range of issues. The article includes my first efforts to explore the material support statutes, a topic I have explored in more detail in subsequent work.

This article considers the integral role played by patent law in respect of stem cell research. It highlights concerns about commercialization, access to essential medicines and bioethics. The article maintains that there is a fundamental ambiguity in the Patents Act 1990 (Cth) as to whether stem cell research is patentable subject matter. There is a need to revise the legislation in light of the establishment of the National Stem Cell Centre and the passing of the Research Involving Embryos Act 2002 (Cth). Where Does Creativity Come From? And Other Stories Of Copyright, Michael J. Madison

This Commentary on Lydia Pallas Loren, Untangling the Web of Music Copyrights, 53 Case W. Res. L. Rev. 673 (2003), observes that debates over a variety of copyright law issues can be - and in fact, often are - structured in narrative terms, rather than in terms of doctrine, policy, or empirical inquiry. I suggest a series of such narratives, each framed by a theme drawn from a feature film. The Commentary suggests that we should recognize more clearly the role of narrative in intellectual property discourse, and that intellectual property narratives should be examined critically.

Law enforcement in the United States relies on racial identifiers as a crucial part of suspect descriptions. Unlike racial profiling, this practice is regarded as both an essential tool for law enforcement and as an unproblematic use of race. However, given the racial history of the United States, such descriptors, particularly “Black,” have developed in such a way to create an extremely large and unreliable category. Due to these factors, the use of race as a physical descriptor in suspect decisions is both discriminatory and inefficient. In recent years, political disputes have constantly prevented governments in China and Taiwan from working with each other on important issues of mutual concern. However, cooperation between law enforcement authorities on both sides of the Taiwan Strait has steadily increased over the past decade and a half, regardless of ups and downs in political relations. While governments on both sides are still not speaking to each other, law enforcement authorities are boosting cooperation by sharing information on criminal cases, deporting each other's fugitives, exchanging visits of high-ranking police officials and participating in seminars on cross-strait crime-fighting. This paper aims to demonstrate that the terms 'mediation' and 'conciliation' are used to denote a general conciliatory procedure characterised by a 'nonadversary' but a 'cooperative' approach of the parties to a dispute towards reaching a settlement agreement by the assistance of a third neutral. A similarity between these procedures is based on the 'party control' of the proceeding, i.e. on the willingness of the parties to settle their dispute while the mediator or the conciliator only assist the parties in coming to a final agreement. The paper (I) outlines the nature and extent of the dissatisfaction with legal research instruction and demonstrates that the problem predates computer-assisted legal research, (II) presents the history of the debate (focusing on a heated exchange between advocates of a “process-oriented” approach and proponents of the traditional, “bibliographic” methods), and (III) presents the requisite elements of a satisfactory pedagogical model, discussing various issues surrounding each of these elements.

Modeling The Adoption Rates Of Manufacturing Technology Innovations By Small Us Manufacturers: A Longitudinal Investigation Feb. 2003, Pp. 351-366., Paul Swamidass

This study provides conclusive evidence to support the view that small plants are slower than larger plants to adopt manufacturing innovations. This empirical study based on over 1000 US manufacturing plants engaged in producing discrete products, studies the adoption of manufacturing technologies in small plants relative to large plants between 1993 and 1997.

Under the assumption that small manufacturers are disadvantaged, several federal and state programs have been created to assist small manufacturers in acquiring and adopting manufacturing innovations. Through quantification of technology adoption in small manufacturing firms, this study’s findings reveal which manufacturing innovations are in greater need of …

Az Európai Unió országaiban a termőföld jogi szabályozása az egyes országokban ugyan fejlettebb stádiumban van mint Magyarországon, ugyanakkor -az EU tagországok közötti összehasonlításban- a szabályozás eklektikus képet mutat.

Magyarországon -másfél évvel az uniós csatlakozás előtt- a termőföldet érintő jogi szabályozás viszonylag fejlett állapotba jutott el, ugyanakkor e szabályozásban még mindig jelentős koherencia zavar tapasztalható.

Ennek ellenére -a gyakori és hol erre, hol arra hangsúlyt tevő politikai áramlatok támogatásával vagy éppen velük ellentétben- kialakult a termőföldet érintő jogi szabályozás hatóköre és gerince. Covenant marriage laws have been defended as a way of strengthening marriage and decreasing divorce rates. However, these laws may actually work against the state’s interest by placing limitations on marriage. Arkansas’s Covenant Marriage Act of 2001 was based on similar statutes in Louisiana and Arizona. A philosophical analysis of the Arkansas act showcases problems that may arise from covenant marriage generally. Ultimately, covenant marriage does not prevent divorce but prolongs an irreconcilable marriage to the harm of its parties. State policies of marital stability may be better served by other premarital options that reinforce marriage’s contractual and religious significance.
