Community Determinants Of Volunteer Participation: The Case Of Japan, Mary Alice Haddad Aug 2004

Community Determinants Of Volunteer Participation: The Case Of Japan, Mary Alice Haddad

Mary Alice Haddad

Why are some communities more civically engaged than others? Why do some communities provide services with volunteer labor whereas others rely primarily on government provision? When communities provide both volunteer and paid labor for the same service, how do they motivate and organize those volunteers? This article addresses these questions through quantitative tests of prevailing explanations for levels of civic engagement (e.g., education, TV viewing, urbanization) and qualitative analyses of case studies of three medium-sized cities in Japan, focusing particularly on the service areas of firefighting and elder care. The statistical analyses demonstrate that current explanations that rely on individual …

7. The Supreme Court And Reluctant Witnesses: Crawford V. Washington., Thomas D. Lyon

Thomas D. Lyon

A recent U.S. Supreme Court case is sure to have a major impact on the prosecution of family violence cases in which the victim fails to testify at trial.  A number of states have special hearsay exceptions for statements from victims of spouse abuse and child abuse.  Those exceptions often allow the statements into evidence even when the victim does not testify (usually with additional requirements, such as corroborative evidence or a finding that the statement has "indicia of reliability").  The U.S. Supreme Court has recently held that if the victim does not testify, "testimonial" hearsay is inadmissible unless the …

Rhetoric Or Rights?: When Culture And Religion Bar Girls' Right To Education, Elizabeth Chamblee Burch Aug 2004

Rhetoric Or Rights?: When Culture And Religion Bar Girls' Right To Education, Elizabeth Chamblee Burch

Elizabeth Chamblee Burch

Women account for almost two-thirds of the world's illiterates. In the year 2000, the World Education Forum met in Dakar, Senegal and set goals to (1) eliminate gender disparities in primary and secondary education by 2005, and (2) achieve gender equality in education by 2015. Two months before 2004, the United Nations Educational, Scientific, and Cultural Organization (UNESCO) reported that sixty percent of the 128 countries that attended the Dakar Conference would not meet these goals. The report attributed the failure to sharp discrimination against girls in social and cultural practices. The report failed to mention that social and cultural …

Matthew Rimmer

This article considers the ground-breaking Supreme Court of Canada decision in CCH Canadian Limited v. The Law Society of Upper Canada. The matter involved legal publishers bringing an action for copyright infringement against the Law Society of Upper Canada for operating a photocopy and custom copy service at the Great Library of Osgoode Hall. The Supreme Court of Canada decision laid down important precedents in relation to originality, authorisation, and the defence of fair dealing. The ruling has been hailed as 'one of the strongest pro-user rights decisions from any high court in the world, showing what it means to …

La Tutela Del Consumidor Desde La Óptica Concursal En El Régimen Argentino, Carlos Molina Sandoval

Carlos Molina Sandoval

Putting The S Back In Corporate Social Responsibility: A Multi-Level Theory Of Social Change In Organizations, Ruth V. Aguilera, Cynthia A. Williams, Deborah Rupp, Jyoti Ganapathi Jun 2004

Putting The S Back In Corporate Social Responsibility: A Multi-Level Theory Of Social Change In Organizations, Ruth V. Aguilera, Cynthia A. Williams, Deborah Rupp, Jyoti Ganapathi

Cynthia A. Williams

This paper provides a multi-level theoretical model to understand why business organizations are increasingly engaging in corporate social responsibility (CSR) initiatives, and thereby exhibiting the potential to exert positive social change. Our model integrates theories of micro-level organizational justice, meso-level corporate governance and macro-level varieties of capitalisms. Using a theoretical framework presented in the justice literature, we argue that organizations are pressured to engage in CSR by many different actors, each driven by instrumental, relational and moral motives. These actors are nested within four levels of analysis: individual, organizational, national and transnational. After discussing the motives affecting actors at each …

Obituary Thakor Shah By Amar Jesani & Vibhuti Patel, Professor Vibhuti Patel May 2004

Obituary Thakor Shah By Amar Jesani & Vibhuti Patel, Professor Vibhuti Patel

Professor Vibhuti Patel

At a time when the nation needs people who could keep alive the secular conscience of Gujarat, the passing away of Thakor Shah on April 10, 2004 in Vadodara due to massive heart attack has come as a big jolt. He died while participating in the meeting of the network of social movements in Gujarat. Of the 76 years he lived, he spent over 60 years in public life, making personal sacrifices, fearlessly withstanding all attacks – physical and political – in his incessant struggle for organising working masses for their rights and justice. His life was a political journey …

Unrepresented Parties In Mediation, Cynthia Nance Apr 2004

Unrepresented Parties In Mediation, Cynthia Nance

Cynthia Nance

IT'S THE DILEMMA that every mediator knows well, but no one has yet solved: What to do when one of the parties is unrepresented. The legal system, of course, assumes that the parties are on an equal footing--though this is arguably a fiction (and a potentially harmful one where indigent, pro se litigants are concerned.) See Craig Haney, Making Law Modern: Toward a Contextual Model of Justice, 8 Psychol. Pub. Pol'y & L. 3 (Mar. 2002). And most rules regarding professional responsibility relate to the adversarial context-- not ADR. So “[w]hile the *48 Code of Professional Responsibility and the Model …

Gazdaság És Jog Viszonya A Marxista Jogelméletben És A Jog Gazdasági Elemzésében [The Relation Of ‘Economy’ And ‘Law’ In Marxist Legal Theory And In ‘Law And Economics’], Peter Cserne

Péter Cserne

This contribution to a conference on the "heritage" of Marxist legal theory in Hungary
(1) summarises the views of Hungarian Marxists on law as the "superstructure" over an economics "base" and
(2) the debates on the systemic and doctrinal role of "economic law" in the legal system
(3) argues that Marxist legal theory and Law and Economics, while both aim at "demystifying" law, fundamentally differ in terms of both method and substance
(4) recounts how in the 1980s Analytical Marxists who shared the commitment of Law and Economics to rational choice theory, (in Jon Elster's words) "engaged in a form …
