The Act allows a court to require that a first time offender of aggravated child molestation, before sentencing, undergo a psychiatric evaluation to determine whether medroxyprogesterone acetate treatment would be effecting in changing the person's behavior. The Act provides that chemical treatment and treatment by a qualified medical health professional may be required as a condition of probation, and allows such treatment to begin before the person is released from custody. The Act allows individuals arrested but not charged, or who have had charges brought against them but dismissed by the prosecuting attorney, to have their criminal records relating to the incident expunged. The Act requires the individual to submit a written request to have his or her record expunged from the arresting agency's files. The Act allows the individual to appeal a refusal to expunge the record. The Act also allows the prosecuting attorney to appeal a decision by the agency to expunge the record. The Act provides criteria which must be met for the record to be expunged. The …

The Act requires that additional information be provided by creditors to banks and other financial institutions on certain affidavits and summonses when creditors attempt to garnish funds form a debtor's account. The Act immunizes banks and other financial institutions from liability if the fail to pay money from a debtor's account if the information needed to positively identify the debtor's account is not received by them. The Act further details the procedures a bank must follow when it has property or money in its safe deposit box, which is subject to garnishment by a creditor. The Act immunizes certain association …

The Act relates to the general provisions regarding offenses against health and morals, specifically adding sections prohibiting people who have committed certain crimes from residing, being domiciled, or being employed by a facility. The Act refers to a facility as any daycare center, family daycare home, groupcare facility, or group daycare home, or similar facility. The Department of Human Resources shall deny the issuance or revoke the license, commission, or registration of a facility that violates the Act.

The Act concerns issuing subpoenas for taking depositions and for producing documents and tangible things at deposition. The Act provides that, upon agreement of the parties, an attorney may compel the presence of a witness at a deposition or command the production of documents and tangible things at the examination by issuing a subpoena under the attorney's own signature. Commerce And Trade Selling And Other Trade Practices: Provide Conditions Under Which A Revolving Credit Account Shall Be Presumed To Be Signed Or Accepted By A Buyer, Jeremy Emanuel Citron

The Act provides that in a court action brought under the Retail Installment and Home Solicitation Sales Act, in which a seller brings a claim against a buyer whose account is in default, the seller will no longer have to produce an original copy of the credit agreement. The Act provides conditions that, once met, provide presumptive proof that the account has been accepted or signed by the buyer. The Act also provides conditions under which a revolving account becomes effective.

The Act gives the superior court jurisdiction over family violence proceedings when the victim resides in the jurisdiction or when the act occurs in the jurisdiction, regardless of where the offender resides, as long as personal jurisdiction is otherwise satisfied. This Act assigns the State Commission on Family Violence to the Administrative Office of the Courts for administrative purposes only. In addition, the Act makes it a misdemeanor to knowingly reveal the location of a family violence center.

The Act relates to corporations and provides procedures and requirements for a new or existing partnership to become or continue to be a limited liability partnership. The Act further provides for a determination of when a limited partnership becomes a limited liability partnership. The Act provides for changes that occur in a partnership, including real property transfers and agreements for obligations. The Act also provides for one member partnerships. The Act simplifies some election parameters, clarifies tax treatment, and paperwork.
