Refuge From Climate Change-Related Harm: Evaluating The Scope Of International Protection Within The Common European Asylum System, Matthew Scott

Matthew Scott

Extreme weather events have the potential to cause serious harm and can contribute to displacement. Such events are expected to increase in frequency and/or intensity as a consequence of climate change. It is therefore of concern that there is widely considered to be a protection gap when affected individuals cross an international border. However, apart from a handful of cases in Australia and New Zealand, the contours of this perceived gap have not been fully explored in practice. In its judgment in Teitiota v Chief Executive of the Ministry of Business Innovation and Employment, the High Court of New Zealand …

The Doctrine Of Resurrection In The Book Of Mormon, Anthony Thompson Dec 2014

The Doctrine Of Resurrection In The Book Of Mormon, Anthony Thompson

Keith Thompson

The doctrine of resurrection was taught by Lehi and Jacob among
the first Nephites but was not mentioned again in the record until the
time of Abinadi, perhaps 350 years later. In the court of King Noah that
doctrine and the idea of a suffering Messiah who would bear the sins of his
people and redeem them, were heresies and Abinadi paid for them with
his life. While Abinadi’s testimony converted Alma1 and the doctrine of theresurrection inspired Alma2 after his conversion, it was a source of schism
in the church at Zarahemla along lines that remind us …

Should 'Public Reason' Developed Under Us Establishment Clause Jurisprudence Apply To Australia?, Anthony Thompson Dec 2014

Should 'Public Reason' Developed Under Us Establishment Clause Jurisprudence Apply To Australia?, Anthony Thompson

Keith Thompson

John Rawls’ idea of public reason holds that comprehensive doctrines including religion should not be
allowed a voice in the public square. Such ideas prevent society achieving that ‘overlapping consensus’
which is said to be a requirement for enduring peace and progress. However, the suggestion that some
ideas should be excluded from public debate is anti-democratic. This article reviews Rawls’ idea of
public reason’ against its US legal context and suggests it was a response to US Supreme Court decisions
concerning their First Amendment. Though our framers copied most of that clause into the Australian
Constitution, the High Court has …

Spousal Privilege - Not A Principle Well Established At Common Law? Accc V Stoddart [2011] Hca 47, Anthony Thompson

Keith Thompson

It is unusual that a decision of the High Court of Australia runs so clearly in the face of expectation.1 But decisions that surprise get publicity especially when their concepts are readily intelligible in the lay community. Though Legal Professional and Self-Incrimination Privilege have been narrowed and abrogated by Australian legislatures during the last 50 years,2 press reportssuggest that the High Court decision in ACCC v Stoddart,3 which declared that there never was a spousal incrimination privilege in Australia, have been shocking to the community and even to the profession.4 There may be other larger issues caught up in this …

Who Was Sherem?, Anthony Thompson Dec 2014

Who Was Sherem?, Anthony Thompson

Keith Thompson

The Book of Mormon’s first anti-Christ, Sherem, “came among”
the Nephites before their first generation was ended. Because he was an
eloquent believer in the Law of Moses, there has been a variety of surmise
as to his background. Was he a Lamanite, or a Jaredite or Mulekite
trader? Was his presence among the separated Nephites evidence of early
interaction between the Nephites and other civilisations in Nephite lands
from the time of their first arrival? This short article reviews the various
suggestions about Sherem’s identity and suggests he was most likely a
descendant of the original Lehite party but …
