US-Mexico Negotiations on Improved Colorado River Management: An Update (February 19)

The United States and Mexico are currently negotiating an international accord on a variety of Colorado River water matters, including the prospects for new water projects, conservation efforts, and operational improvements. Participants are invited to hear an update on these efforts from individuals directly involved in the negotiations, including Mario López Pérez, Engineering and Technical Standards Manager in the National Water Commission of México, who is responsible for binational water issues with the USA, Guatemala and Belize.

Water law is the field of law concerned with the ownership, control, and use of water resources, both surface and subsurface. Although most closely related to property law, recent developments in other legal fields, especially in environmental law, have heavily influenced the interpretation, application, and development of water law. As a result, water law today encompasses a broad perspective and often takes into account individual and community rights, environmental issues, commerce and economics, and other societal and legal concerns.

The Promise and Peril of Oil Shale Development (February 5)

The largest known oil shale deposits in the world are in the Green River Formation, which covers portions of Colorado, Utah, and Wyoming. Fully one-half of the world’s oil shale lies within 150 miles of Grand Junction, Colorado, and about 80% of these reserves are on federal land. Estimates of recoverable reserves in the Green River Formation range from 500 billion to 1.53 trillion barrels. At present consumption rates, this is enough oil to satisfy 100% of U.S. demand for well over 100 years.

Climate change driven by greenhouse gas emissions is substantially altering water availability while increasing water demand. Shifts in domestic energy policy and production, while needed to confront the challenge of climate change, may further stress the nation's water resources. These changes and new demands will be most severe in regions that are already experiencing water stresses and conflicts. This article assesses the extent to which the concepts of climate proofing and climate policy coherence have found expression in continental natural resource regimes established in North America and Europe. The article first examines the recognition of these concepts within three North American crossborder regimes directly impacted by climate change: the Waters Treaty between Mexico and the United States; the Pacific Salmon Treaty between Canada and the United States; and the North American Waterfowl Management Plan between Canada, Mexico and the United States. This article aims to contribute to the debate about the legal and regulatory failure to search for imaginative-and immediate-solutions to questions of wastewater management. Following this introductory section, Part I examines the existing, highly centralized models of wastewater treatment in the United States. To do so, Part I first examines federal environmental law and regulation relating to wastewater treatment. In addition, Part I briefly looks at a sampling of state laws affecting wastewater treatment and concludes that neither federal law nor typical state laws express a preference for centralized wastewater treatment-the dominant and default method for wastewater treatment in the …
